WAIVER AND RELEASE OF LIABILITY

La Cantera Retail Limited Partnership, Brookfield Properties Retail Holding LLC, Brookfield Properties Retail Inc., Brookfield Property Partners LP and their respective affiliates, officers, directors, agents, employees, shareholders, successors and assigns (“Released Parties”) from any and all claims, demands, causes of actions, suits, damages, costs and expenses for any and all personal injuries; loss of profit; pain and suffering; property damage, theft or other loss arising out of or occurring in connection with my participation in the (name of the event)_______________ on(date) ____________________(the “Event”). I hereby attest that I am fully cognizant of the risks involved in participating in the Event and agree to abide by and adhere to all of the rules and instructions regarding participation in the Event.  I further attest that I do not suffer from any heart, lung or other medical condition or disease that might in any way hinder or prevent me from fully participating in the Event.


I acknowledge that this activity or Event may involve risks and dangers of serious physical bodily injury and may carry with it the potential for death. The risks may include, but are not limited to, those caused by equipment, lack of hydration, actions of other people including, but not limited to, participants and Event coordinators.


In consideration of my participation in the Event, to the extent permitted by applicable law, I hereby release, discharge, and hold harmless the Released Parties from any and all liability that may arise, directly or indirectly, now or in the future, by reason of any injury, damage, loss, or expense incurred in connection with my participation in the Event, This Waiver and Release of Liability shall be binding on my heirs, executors, administrators, successors and assigns.



I ACKNOWLEDGE THAT I AM AGE 18 OR OLDER, HAVE READ AND FULLY UNDERSTAND THIS RELEASE, INCLUDING THE FACT THAT I AM RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY ME AND VOLUNTARILY AND FREELY AGREE TO THE TERMS AND CONDITIONS SET FORTH HEREIN AND I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS RELEASE IS HELD TO BE INVALID, THE BALANCE OF THE RELEASE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
