1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS I acknowledge that I am voluntarily participating in the shuttle service provided by Red River Gorge Shuttle LLC ("Service"), which involves transportation by bus, including but not limited to, the transport of myself and my luggage (collectively "Passengers and Luggage") approximately 150 miles each way to and from the Red River Gorge in Kentucky (the "Trip"). I understand and acknowledge the following risks, including but not limited to: - Vehicular accidents: The possibility of accidents or collisions while traveling to and from the Red River Gorge.
- Slips and falls: The risk of slipping, tripping, or falling while on or around the bus or other areas associated with the trip.
- Injuries due to bumpy or uneven roads: The possibility of injury resulting from the physical conditions of the roads, including bumps, potholes, and other hazards.
- Damage to personal effects and luggage: There is a risk that my personal belongings or luggage may become damaged, lost, or misplaced during the trip.
- Food-related allergens: I understand that other passengers may bring food aboard the bus, which could contain allergens such as nuts or other substances that may trigger allergic reactions. If I have any life-threatening or serious food allergies, I acknowledge that it is my responsibility to disclose this information to the driver via the booking form prior to boarding the shuttle. I agree that I am responsible for managing my condition, avoiding exposure to known allergens, and carrying my personal epinephrine auto-injector (e.g., EpiPen) in the event of a medical emergency.
- Environmental exposure risks: I understand there is a possibility of exposure to stinging insects (such as bees or wasps), ticks, and poisonous plants including poison ivy, poison oak, or poison sumac. I acknowledge that the Company is not responsible for any injuries, allergic reactions, or discomfort resulting from such exposure during or after transport.
I am aware of and accept these risks and any other hazards that may arise in connection with the transportation or other activities related to this Service. 2. RELEASE OF LIABILITY
In consideration of being allowed to participate in the Service, I, for myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge Red River Gorge Shuttle LLC and its officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action that may arise from personal injury, death, or damage to personal property occurring during or as a result of my participation in the Service. This waiver and release shall apply to all claims, whether arising from the negligence of the Company or otherwise. 3. SAFETY RESPONSIBILITIES AFTER DROP-OFF
I acknowledge and agree that upon being dropped off at my destination in the Red River Gorge, I will be solely responsible for my own safety. I understand that Red River Gorge Shuttle LLC is not responsible for any injuries, accidents, or other incidents that may occur after I am dropped off at the designated drop-off location for the day. I understand that I will be responsible for my own actions, decisions, and conduct while recreating in the Red River Gorge or engaging in any activities after being dropped off, and that Red River Gorge Shuttle LLC shall have no responsibility for any incidents occurring during that time. 4. MINOR PASSENGERS
I acknowledge that all minors (under the age of 18) must be accompanied by a parent or legal guardian on the shuttle service. The parent or legal guardian is fully responsible for ensuring the safety, behavior, and conduct of the minor passenger(s) during the entire trip, including while on the bus and at the destination. The parent or legal guardian must ensure that the minor passenger(s) follow all safety guidelines and behave appropriately. The Company will not assume responsibility for any actions or conduct of the minor passenger(s) or their safety, and the parent or legal guardian shall remain responsible for their child’s actions throughout the trip. 5. AGREEMENT TO FOLLOW INSTRUCTIONS
I agree to follow all instructions provided by the Company, its employees, and agents during the trip, including instructions related to safety, boarding, and deboarding the shuttle bus. Failure to comply with such instructions may result in removal from the shuttle service without refund. 6. INDEMNIFICATION
I agree to indemnify and hold harmless Red River Gorge Shuttle LLC, its officers, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising from my participation in the Service, including but not limited to claims arising from my own negligence or the negligence of others. 7. MEDICAL TREATMENT
In the event of an emergency, I authorize the Company to secure medical treatment for me if necessary. I agree to be responsible for all costs associated with any medical treatment I may require. 8. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof. No oral or written representations, understandings, or agreements that are not expressly set forth herein shall be binding. 9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. 10. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. By signing this Agreement, I confirm that I have read and understood its terms, that I am voluntarily agreeing to them, and that I am legally competent to do so. |
