RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”)

Under South Carolina law, an agritourism professional is not liable for an injury to or the death of a participant in an agritourism activity resulting from an inherent risk associated with the agritourism activity. (Chapter 53, Title 46, Code of Laws of South Carolina, 1976). ​

RELEASE OF LIABILITY

I, hereby represent that I am at least 18 years old and voluntarily, for valid consideration, enter into this Guest Release and Waiver of Liability Indemnity and Hold Harmless agreement (“Agreement”).

I acknowledge, as a visitor of The Willowcroft Corporation dba Hall Family Farm (“The Farm”), located generally at 445 West Rebound Rd, Lancaster SC 29720, that my use of any of the facilities owned or operated by The Farm is voluntary, gratuitous and inures solely to my benefit.

I acknowledge that my use of any facilities at or of The Farm, and/or my participation in any activity at or of The Farm shall be in accordance with the rules and regulations of use posted and/or published by The Farm, as they may be amended from time to time.

IT IS MY RESPONSIBILITY, ON BEHALF OF MYSELF, OR ON BEHALF OF ANY MINOR OF WHOM I ACT AS GUARDIAN TO BE FAMILIAR WITH AND ADHERE TO THE RULES AND REGULATIONS OF USE APPLICABLE TO THE FARM, AS THEY MAY BE AMENDED FROM TIME TO TIME.

I also acknowledge that my use of any facilities owned or operated by The Farm and/or my participation in any activity at or of The Farm facilities involves, or may involve inherent risk of injury, whether caused by The Farm and/or their parents, subsidiaries, affiliated entities, members, officers, directors, agents, employees, independent contractors, shareholders, or partners, and other guests or others acting by or on behalf of The Farm. Such risk varies depending on the use of any particular facility, or any particular activity and I acknowledge that risks include accidents, injuries and death. Risks may result in minor injuries to catastrophic injuries or even death. Without limitation, injuries may result from the unpredictable nature of animals, exposure to allergens, physical exertion, agricultural equipment, rough or uneven terrain, water irrigation equipment, slippery surfaces, aerial activities, equipment malfunction, maintenance, supervision, training, notice or nature of notice, all or any of which may be either within or not within the control of the Released Parties, as they are defined below. 

In consideration of the privilege to use facilities owned or operated by The Farm and/or the privilege to participate in activities at or of The Farm, all of which are solely for my benefit, the receipt and sufficiency of which is hereby acknowledged, I hereby release The Willowcroft Corporation, Hall Family Farm, their successors and assigns, and each of their respective members, directors, officers, partners, shareholders, employees, agents and affiliates (“Released Parties”) of and from any and all claims, actions causes of action for damages, including actual, consequential, punitive and any multiple damages resulting from or alleged to have resulted from my use of any facilities of The Farm and any activities at or sponsored by The Farm, and all risks that may be involved therewith, whether known or unknown, and I waive any and all rights or claims to damages for any injury or damage, as set forth above.

I agree the Released Parties are not responsible for or liable to me for any property damaged, lost or stolen in or about The Farm facilities, including the lockers, and the parking areas, or lost or stolen relative to my participation in any activities at or sponsored by The Farm. 

  I understand and acknowledge that The Farm does not manufacture any equipment in use at its facilities but purchases the equipment from third parties. I further understand and acknowledge The Farm merely provides the opportunity to use such equipment. I shall not seek to hold the Released Parties responsible for defective equipment or products at or on the The Farm’s premises. 

ASSUMPTION OF RISK:

I voluntarily accept and assume any and all risks, whether known or unknown, associated in any fashion with my use of facilities at or of The Farm and/or my participation in any activity at or sponsored by The Farm, including without limitation, the inherent risks involved in agritourism. The Released Parties will not be liable for or responsible to me for any injury, including, without limitation, personal, bodily or emotional injury, economic loss or any property damage arising of or from or in any way resulting from my use of any facilities of The Farm or my participation in any activity at or sponsored by The Farm. 

INDEMNITY AND HOLD HARMLESS:

To the fullest extent allowed by law, I shall defend, indemnify, and hold harmless the Released Parties against and in respect of any injury, damage, death or property damage caused to any third party by the negligence, gross negligence, carelessness or willful misconduct of me or any Minor (as hereinafter defined) in connection with use of The Farm facilities or participation in any activity sponsored by The Farm. I am financially responsible for any damage to The Farm’s property caused by me or any Minor and shall reimburse The Farm’s loss, upon demand.

RELEASE AND WAVIER OF LIABILITY FOR MINOR’S CLAIMS: 

On behalf of the minor children registered on The Farm’s Smartwaiver.com waiver form (“Minor”), and in consideration of their privilege to use The Farm’s facilities and/or participate in The Farm activities, the receipt and sufficiency of which is hereby acknowledged, I, as the parent or natural guardian of such Minor(s), release the Released Parties from and waive any and all claims for injury, including personal, bodily or emotional injury, or damage, including property damage, that may inure to said Minor(s) or could be made on by or on behalf of said Minor(s) against any Released Parties as a result of Minor's use of The Farm’s facilities or participation in any activity sponsored by The Farm. Without limitation, I hereby release the Released Parties from any liability or responsibility for injuries to the Minor(s) that may result from the unpredictable nature of animals, exposure to allergens, physical exertion, agricultural equipment, rough or uneven terrain, water irrigation equipment, slippery surfaces, aerial activities, equipment malfunction, maintenance, supervision, training, notice or nature of notice, all or any of which may be either within or not within the control of Released Parties.  

ASSUMPTION OF RISK FOR MINOR’S CLAIMS:

To the fullest extent allowed by law I, as the parent or natural guardian of such Minor(s) assume and accept any and all risks of injury or loss to each Minor, whether known or unknown, associated in any fashion with use of facilities at or of The Farm and/or participation in any activity at or of The Farm.

I hereby represent to The Farm that I have the authority to release the prospective claims of each Minor.

CONSENT TO USE AND OWNERSHIP OF PHOTOGRAPHS: 

 I authorize The Farm to photograph or film me and or any Minor, and consent to the use of the likeness and images of me and/or any Minor in all publications, educational materials, marketing materials, websites, advertising and brochures of or for The Farm. I understand and agree that all such images and recordings shall become the sole property of The Farm. I further agree The Farm does not owe me any compensation for the use of such photography likenesses.

 GOVERNING LAW:

   This Agreement shall be governed by, construed and enforced in accordance with the law of the State of South Carolina. Any dispute arising hereunder, or in any way associated with this Agreement or its terms and conditions shall be subject to the sole and exclusive jurisdiction of the State or Federal Courts in and of Lancaster County, South Carolina.

ENTIRE AGREEMENT:

This Agreement constitutes the entire understanding between the undersigned and the Released Parties and there are no other understandings or agreements between the undersigned and the Released Parties not specifically stated herein.

MISCELLANEOUS:

This Agreement, and all terms hereof, shall be binding upon and insure to the benefit of and be enforceable by the undersigned and by the Released Parties and their respective successors and permitted heirs and assigns, whether so expressed or not. If any part of this Agreement or any other agreement entered into pursuant hereto is contrary to, prohibited by or deemed invalid under applicable law or regulation, such provision shall be inapplicable and deemed omitted to the extent so contrary, prohibited or invalid but the remainder of this Agreement shall remain in full force and effect. If any provision of this Agreement may be construed in two or more ways, one of which would render the provision invalid or otherwise voidable or unenforceable and the other would render the provision valid and enforceable, such provision shall have the meaning that renders it valid and enforceable. All covenants, agreements, representations and warranties made herein shall survive the execution and delivery of this Agreement and the consummation of the transactions contemplated hereby.
