For the purposes of this agreement, “Host” refers to The Spa Under The Stars DBA The Zen Den, its owners, agents, contractors, employees, representatives, volunteers, event organizers, and affiliates.

**Guests:**  

The person/customer booking the spa booking ("Guest") and their invitees. The Guest is responsible for ensuring all invitees comply with the terms of this Waiver.

Terms of Agreement

To book, stay, or participate in any activity or event hosted by the property (“Host”), you must accept this Guest Release and Waiver. This waiver becomes effective upon booking, arrival, or participation in any activity.

Definitions:

“Host” refers to The Spa Under The Stars DBA The Zen Den, including its owners, agents, contractors, employees, representatives, volunteers, event organizers, and affiliates.

All undefined terms follow the meaning given in the Airbnb Terms of Service or Additional Terms for Hosts.

Age and Responsibility

You affirm that you are at least 18 years old. If bringing a minor, you assume full responsibility for their supervision and accept this waiver on their behalf. If booking for others, you confirm they have read and accepted this waiver. A parent or legal guardian must sign on behalf of any minor participant.

Assumption of Risks

You acknowledge that use of the property, amenities, and participation in any activity or event involves inherent risks of injury, illness, property damage, or death. These may result from natural conditions, guest behavior, or facility use.

Risks include, but are not limited to:

  • Water-related injuries, including slips, falls, drowning, muscle strain, fainting, hypothermia, or other bodily harm around hot tubs, saunas, cold plunges, showers, or wet surfaces.
  • Temperature-related effects such as overheating, cold shock, dehydration, or heat exhaustion.
  • Fire or heat sources including fire pits, candles, or heaters.
  • Outdoor and environmental hazards such as uneven terrain, insects, wildlife, and delayed emergency response, and allergic reactions.
  • Participation in events or group activities such as yoga, workshops, or retreats involving physical or emotional exertion.
  • To the fullest extent permitted by Washington State law, you voluntarily assume all known and unknown risks, including those arising from negligence, equipment defects, or slippery and wet surfaces.

You agree to fully waive and release the Host, including event facilitators, contractors, or collaborators, from any and all claims, demands, damages, or causes of action arising from your participation, to the fullest extent permitted by law.

This includes, but is not limited to:

  • Bodily injury
  • Emotional or psychological harm
  • Damage to or loss of personal property
  • Infections, allergic reactions, or medical episodes
  • Accidents resulting from negligence (but not gross negligence)

Release, Waiver & Indemnification

In consideration of your stay or participation, you fully release, waive, and discharge the Host from all liability, claims, or causes of action for personal injury, illness, death, or property damage arising out of your stay or participation—whether caused by negligence or otherwise.

You further agree to indemnify and hold harmless the Host and its affiliates from any claims, damages, or expenses (including attorney fees) arising from your own actions, omissions, or those of your guests.

This release does not apply to liability caused by gross negligence or intentional misconduct by the Host. If any portion of this waiver is found invalid, the remainder shall remain enforceable.

Property Conduct, Damage & Safety

You agree to treat the property respectfully and to follow all safety guidelines provided by the Host.

Rules:

  1. You are responsible for damages or excessive cleaning caused by you or your guests.
  2. Smoking only in designated outdoor areas. Unauthorized indoor smoking incurs a $500+ cleaning fee.
  3. Fire pits must never be left unattended; you are responsible for all fire-related damages.
  4. Parking must be in designated areas. The property is in a flood zone—Host is not responsible for towing, theft, or weather-related damage.
  5. Wet Surfaces: Use caution in all spa and outdoor areas; floors and walkways may be slippery when wet. Host assumes no liability for slips, trips, or falls resulting from wet or uneven surfaces.
  6. Use of Spa Amenities (Hot Tub, Sauna, Cold Plunge, Outdoor Shower)
  7. Use of spa features is entirely at your own risk. The Host is not liable for injuries, illness, or death related to their use.

Safety Rules:

  1. Do not use if pregnant, intoxicated, ill, or on medication without medical clearance.
  2. Shower before entering; limit use to 15 minutes.
  3. No glassware, smoking, or sexual activity in or near spa features.
  4. Hot tub max temperature: 104°F. Cold plunge may reach 39°F (cold shock risk).
  5. Exercise extreme caution when entering/exiting or walking on wet decks.
  6. $500+ cleaning or damage fee applies for violations.

Hosted Events, Retreats & Group Activities

This waiver applies equally to all hosted or facilitated events, workshops, retreats, or group bookings, whether or not lodging is included.

Voluntary Participation: Participation is voluntary and may involve physical exertion, emotional release, or environmental hazards. You are solely responsible for determining your fitness to participate.

You assume all risks and waive all claims against the Host, facilitators, or collaborators except in cases of gross negligence or intentional misconduct.

Media Release: You consent to photography or video recording during such events for promotional or documentation purposes unless you opt out in writing before participation.

No Medical or Professional Claims

The Guest acknowledges that the Host, property owners, and affiliates, employees, owners do not provide medical, therapeutic, psychological, or professional advice, diagnosis, or treatment of any kind.

All services, facilities, and activities — including hydrotherapy, sauna, cold plunge, hot tub, or other wellness experiences and events — are recreational and voluntary and intended solely for relaxation and personal enjoyment.

The Host makes no guarantees or representations regarding health outcomes or benefits. Participation is entirely at the Guest’s own risk, and any perceived benefits are subjective and incidental.

Guests are responsible for consulting a licensed medical professional before participating if they have health concerns. The Host’s services and materials must not be relied upon as medical advice or treatment under any circumstance.

Insurance & Liability Disclaimer

The Host’s insurance does not cover guest belongings, medical expenses, or injuries. Guests are encouraged to carry their own travel or renter’s insurance. All facilities and amenities are provided “as is” without any express or implied warranties, including safety, quiet enjoyment, or fitness for purpose.

Compliance, Privacy & Conduct

Guests must comply with all applicable laws, noise ordinances, and property rules. Violations may result in immediate eviction without refund.

Privacy Policy:

Data collected: name, contact info, booking details, and security footage.

Purpose: manage stays, ensure safety, and comply with laws.

Data will never be sold and may be deleted upon written request.

Emergency Medical Consent

You authorize the Host, staff, or emergency personnel to provide or obtain emergency medical treatment if necessary and agree to pay all related costs. You release the Host from any liability for medical care actions taken in good faith.

Legal Provisions

No Guarantee of Safety: The Host cannot guarantee your safety or that of your property. You participate voluntarily and assume all risks which may include but not limited to, serious injury or death.

Waiver of Jury Trial & Class Action: You waive the right to a jury trial and to participate in any class or collective action. All disputes will be resolved individually through negotiation or mediation. 

Digital Consent: Checking in, submitting, or signing this waiver electronically constitutes a legally binding signature under Washington’s UETA and the federal ESIGN Act.

By signing below, you affirm that:

  1. You have read and understood this Guest Release and Waiver.
  2. You agree to all terms voluntarily and with full authority.
  3. You understand this waiver is governed by the laws of the State of Washington and intended to be interpreted as broadly as permitted.
  4. If you reside within the European Economic Area (EEA) or Australia, this Guest Release and Waiver does not apply to you.
