PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK


WARNING: ASSUMPTION OF RISK – OBSTACLE COURSE ACTIVITIES

WARNING: There are significant elements of risk involved in participating in an obstacle course, ninja-style training activities, climbing elements, balance obstacles, jumping features, and related physical fitness equipment (collectively referred to herein as the “Activity”).

Participants and parents/guardians must understand that these activities are physically demanding and are not without risk. Certain risks are inherent to obstacle course activities and cannot be eliminated without fundamentally changing the nature of the experience.

The same elements that make obstacle course training exciting, challenging, and rewarding — including heights, dynamic movements, speed, strength-based challenges, and physical exertion — may also result in loss or damage to personal property, accidental injury, illness, or, in rare and extreme cases, permanent disability or death.

The purpose of this document is to ensure that all participants are fully informed of the inherent risks and understand what to expect before taking part.

ACKNOWLEDGMENT OF RISKS

I ACKNOWLEDGE THAT THE FOLLOWING DESCRIBES SOME, BUT NOT ALL, OF THE RISKS ASSOCIATED WITH OBSTACLE COURSE AND NINJA-STYLE ACTIVITIES:

  • Slips, trips, or falls from obstacles, platforms, climbing elements, or equipment
  • Collisions with obstacles, equipment, walls, floors, or other participants
  • Loss of grip or footing while climbing, swinging, balancing, or jumping
  • Failure, misuse, or malfunction of equipment
  • Physical strain including sprains, muscle tears, ligament injuries, fractures, bruises, cuts, abrasions, or contusions
  • Head, neck, or spinal injuries resulting from falls or impact
  • Fatigue, dehydration, dizziness, or reduced reaction time that may increase risk of injury
  • The actions or inactions of other participants
  • Unanticipated or unforeseen risks that may arise during participation

I understand that this list is not complete and that other known or unknown risks may result in injury, illness, permanent disability, or death.

I voluntarily choose to participate (or allow my child to participate) with full knowledge and acceptance of these risks.

RELEASE OF LIABILITY

In consideration of being permitted to participate in activities offered by Atlantic Ninja, I, on behalf of myself (or my minor child), my heirs, executors, administrators, assigns, and personal representatives, hereby fully release, waive, discharge, and hold harmless Atlantic Ninja, its owners, directors, officers, employees, contractors, instructors, volunteers, agents, and affiliates (collectively referred to as the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to any injury, illness, loss of property, disability, or death that may result from participation in the Activity.

This release includes claims arising from negligence on the part of the Released Parties, to the fullest extent permitted by the laws of the Province of Nova Scotia.

I understand that by signing this agreement, I am giving up certain legal rights, including the right to sue.

INDEMNIFICATION AGREEMENT

I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, liabilities, damages, costs, or legal fees arising from:

  • My (or my child’s) participation in the Activity;
  • Any breach of this agreement;
  • Any actions or conduct by me (or my child) that cause injury or damage to others or property.

AGREEMENT TO ABIDE BY RULES AND SAFETY POLICIES

I agree to follow all rules, safety guidelines, and instructions provided by Atlantic Ninja, including those posted within the facility, communicated verbally by instructors, or provided in writing.

I understand that Atlantic Ninja reserves the right to refuse participation or remove any individual who:

  • Fails to follow safety rules
  • Behaves in a reckless or unsafe manner
  • Demonstrates conduct that may endanger themselves or others

Removal for safety reasons may occur without refund.

GOVERNING LAW & SEVERABILITY

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Nova Scotia.

If any portion of this agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
