Terms and conditions and waiver

WAIVER, INDEMNITY, AND RELEASE OF LIABILITY:

Passenger expressly acknowledges and agrees that the Mud Boat tour involves some risks, and Passenger hereby knowingly, freely, and voluntarily assumes all risk and liability for any damage or injury that results or may result directly or indirectly from Passenger’s or Passenger’s child/ward’s participation in the activity described herein, and further agrees to release, waive discharge, and covenant not to sue WILD EDVENTURES LLC, their respective officers, agents, employees, and volunteers (all for the purposes herein referred to as the “Releasees”) from any and all liability and causes of action whatsoever which Passengers, Passenger’s heirs, legal representatives and assigns may have against any of the Releasees due to Passenger’s and/or Passenger’s child/ward’s participation in the activity described herein, whether caused in whole or in part by the negligence of the Releasees. Passengers further agree to indemnify and hold harmless the Releasees from any and all liability, including all fees and costs, resulting from claims, causes of action, or losses sustained by third parties arising out of actions or alleged actions in connection with Passenger’s and/or Passenger’s child/ward’s participation in the activity described herein. At this time, WILD EDVENTURES LLC does not carry liability insurance. This waiver is good through 3/1/2026.

I understand and agree that WILD EDVENTURES LLC records all tours for safety and liability purposes. These recordings will not be used for social media or promotional purposes. I acknowledge that participation in the tour requires consenting to this recording, and if I do not agree, the tour will not proceed, and I will not be eligible for a refund.

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE WILD EDVENTURES LLC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
