LIFETIME LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK

PRIVATE PROPERTY – READ CAREFULLY BEFORE SIGNING

THIS WAIVER APPLIES TO ALL FUTURE VISITS

1. DEFINITIONS – PROPERTY COVERED

For purposes of this Agreement, “the Property” includes all land, buildings, structures, trails, disc golf courses, parking areas, access roads, and facilities, whether improved or unimproved, owned, leased, licensed, operated, or managed by Lucky Mud Disc Golf, LLC and/or the Released Parties, including multiple locations, whether existing now or acquired or used in the future.

This waiver applies to all Lucky Mud Disc Golf locations.

2. ACKNOWLEDGMENT OF RISK

I understand that disc golf and related activities involve inherent risks, which may vary by location and over time and include, but are not limited to: uneven or slippery terrain, steep or wooded areas, natural obstacles, falling, collisions, thrown or rebounding discs, weather conditions, wildlife encounters, remote rural settings, limited access to emergency services, and the actions of other participants.

I voluntarily choose to enter and use the Property with full knowledge of these risks, understanding that serious injury, permanent disability, or death may occur.

3. ASSUMPTION OF RISK

I voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with my presence on and use of the Property, including casual play, practice, spectating, walking, and travel within designated areas, for this visit and all future visits.

4. RELEASE OF LIABILITY (LLC, OWNERS & MULTIPLE PROPERTIES)

In consideration for being permitted to enter and use the Property, I hereby release, waive, discharge, and covenant not to sue:

Lucky Mud Disc Golf, LLC, all individual property owners, co-owners, members, managers, officers, agents, employees, volunteers, contractors, event staff, sponsors, insurers, successors, assigns, residents, and any other persons or entities with an ownership, leasehold, residential, or operational interest in the Property

(collectively referred to as the “Released Parties”)

from any and all liability, claims, demands, actions, or causes of action, including those arising from the negligence of the Released Parties, for injury, illness, death, or property damage arising from my presence on or use of the Property at any Lucky Mud Disc Golf location, now or in the future.

5. PRIVATE RESIDENCES & RESTRICTED AREAS

I acknowledge that private residences and residential areas exist on one or more Properties. I agree to:

  • Respect all posted signs, boundaries, and restricted areas 
  • Remain within designated disc golf and access areas
  • Avoid private yards, buildings, equipment, and dwellings 
  • Supervise minors at all times 

Unauthorized entry into residential or restricted areas is prohibited and may result in removal from the Property.

6. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost (including attorney fees) arising from my actions, the actions of minors in my care, or my violation of posted rules, boundaries, or this Agreement.

7. MEDICAL RESPONSIBILITY

I certify that I am physically capable of participation and have no condition that would prevent safe use of the Property. In the event of injury, I authorize the Released Parties to obtain emergency medical treatment if necessary and accept responsibility for all related costs.

8. RULES, CONDUCT & REMOVAL

I agree to follow all posted rules, signage, and verbal instructions at all locations. Unsafe, reckless, destructive, or intoxicated behavior may result in immediate removal without refund.

9. GOVERNING LAW & VENUE

This Agreement shall be governed by and interpreted under the laws of the State of Washington. Any legal action shall be brought exclusively in a court of competent jurisdiction within Washington State.

10. SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

11. DURATION OF AGREEMENT – LIFETIME / ALL FUTURE VISITS

This Agreement applies to this visit and all future visits, activities, and participation by the undersigned at any Lucky Mud Disc Golf location, for the lifetime of the participant, unless revoked by the participant in writing and acknowledged by Lucky Mud Disc Golf, LLC.

I understand that conditions, terrain, layout, and risks may change over time, and I voluntarily accept all risks associated with future visits.

12. ADULT PARTICIPANT ACKNOWLEDGMENT

I certify that:

  • I am 18 years of age or older, or a parent/legal guardian signing below
  • I have read and understand this Agreement 
  • I am signing voluntarily
  • I understand that I am giving up legal rights, including the right to sue

MINOR PARTICIPANT CONSENT & RELEASE

I am the parent or legal guardian of the minor named below. I consent to the minor’s participation and agree to all terms of this Agreement on their behalf, including the release and indemnification of the Released Parties.

This waiver for a minor remains valid only until the minor reaches eighteen (18) years of age, at which time the individual must execute their own waiver to continue participation.
