YOUTH BALLET MASTERS COMPETITION

I, (“Participant” 18+ or parent / guardian) who is (the “Participant”), acknowledge and agree to the following:

Liability Waiver

By signing these policies, I agree to hold Youth Ballet Masters (herein after YBM) and it’s host Art-E Foundation, a California not-for-profit charitable arts organization (herein after Art-E) harmless from any and all claims, costs, liabilities, expenses or judgments resulting from any participation in YBM competition, events, functions and activities or classes. I hereby further agree to indemnify and hold harmless YBM and its staff and all officers of Art-E from any lawsuits and all claims. I understand that physical activities can result in injury and I agree to waive the right to any legal action for any injury sustained on event property before, during or after the event. I acknowledge that the Participant is competing to receive cash and other prizes in the competition, events, functions and activities. I will not hold YBM liable for the breach of any agreement previously made or herein made as a result of the participant's participation in the competition, events, functions and activities or related events.

Lost or Theft Waiver

Students and Parents are to be aware that YBM is not responsible for lost and/or left items at YBM competition, events, functions and activities, events, functions or activities. All items left will be placed in lost and found for 2 weeks which will them be donated to the Salvation Army. I hereby forever release and discharge YBM and Art-E its officers, directors, employees and any party that is affiliated with, sponsors or organizes the competition, events, functions and activities from liability for loss or theft of articles left in changing rooms, the performance space, classrooms, or hotel rooms and injuries sustained by the participant while participating in this event. I acknowledge that the participant attends this event at his or her own risk. I will defend, indemnify and hold YBM and its officers and directors harmless from and against any and all claims, demands, losses, suits and expenses relating to this Release Agreement arising out of my actions or negligence. This Consent and Release does not in any way conflict with any existing commitment on the part of the undersigned.

Multimedia Release

I, authorize YBM, its assigns, successors, subsidiaries, affiliates, employees, agents, nominees, licensees, their successors and assigns, and those acting with its authority (collectively, “YBM”), to make, use, sell or otherwise use the materials in any form or medium now or hereafter known including, but not limited to printed, recorded, audio, audiovisual material, or any similar material or material derived therefrom or based thereon, whether or not altered or enhanced, bearing or containing the participant's “Name and Likeness” (defined below) and made before, during, after or in relation to YBM’s competition, events, functions and activitiess, events, functions or activities including, but not limited to outtakes, interviews and “real-life” portrayals of the circumstances leading up to participant's participation in current and all prior YBM competition, events, functions and activitiess, events, functions or activities and authorize YBM and others working on behalf of YBM to do so in any media now or hereafter known through exhibition, distribution, reproduction, publication, performance, broadcast, transmission, advertising, promotion, or otherwise including, but not limited to, the Internet and in connection with other products and services, and for advertising and trade. The participant's “Name and Likeness” shall include the participant's name, signature, likeness, still, moving and digital image, voice, and/or performances and any other identifiable attributes, whether or not altered or enhanced.

YBM may edit, adapt, upload and post online, modify, alter and enhance the Works as it desires and may use the Works or excerpts therefrom in any way without limitation, including the right to substitute the voice of other persons for the participant's voice. YBM shall be under no obligation to use or exploit the Works or the participant's Name and Likeness. On behalf of the Participant, I hereby waive all rights and claims under privacy, publicity, defamation, compensation and proprietary rights law relating to the Works, or their exploitation and acknowledge that YBM shall own all copyrights and related rights in and to the Works and all derivatives thereof.

I acknowledge that the information (physical and email addresses) that I share with YBM and its trusted third Party Partners may be used to market products and/or services related to dancers.

I represent that I am the legal guardian and/or parent of the participant and that I have the right, power and authority to enter into this Release Agreement. On behalf of the participant, I release, indemnify, and hold YBM, its subsidiaries, licensees, successors, and assignees harmless against all claims, liabilities, and expenses arising out of the breach of any of my representations or promises. I further agree and warrant that the above-mentioned participant, will not disaffirm or disavow this consent and permission on the ground that the participant was a minor on the date of execution hereof or any similar grounds whatsoever, or endeavor to recover from YBM or Art-E Foundation, or any of its directors, officers, employees or other associated persons, or through any guardian, any cash, prizes or other sums for participating in the competition, events, functions and activities, other than cash and other prizes won during the course of the competition, events, functions and activities. I have read and understand the terms and conditions of this Release Agreement. Signed as a sealed instrument under California law, which shall govern this agreement.
