LIABILITY WAIVER

FOR USE OF THE SAN MATEO COUNTY SHERIFF’S OFFICE

COYOTE POINT RIFLE AND PISTOL RANGE WITH THE COYOTE

POINT RIFLE & PISTOL CLUB

By indicating your acceptance, you understand, agree, warrant, and covenant as follows:

 

I understand that handling and shooting firearms and being in the presence of others handling and shooting firearms is potentially hazardous. In consideration of use of the San Mateo County Sheriff’s Office Coyote Point Rifle and Pistol Range, I assume full and complete responsibility for any injury that may occur while I am on the Range premises.

 

Handling and shooting firearms and being in the presence of others handling and shooting firearms carries with it certain inherent risks that cannot be eliminated completely, ranging from minor to catastrophic injury, including death. I understand and agree that in consideration for use of the premises, I and my heirs, personal representatives, and assigns do hereby release, waive, discharge, and covenant not to sue the County of San Mateo, the San Mateo County Sheriff’s Office, or the Coyote Point Rifle & Pistol Club for any and all liability from any and all claims arising out of my handling and shooting of firearms and/or presence at the Range.

 

I, for myself, my personal representatives, and my heirs and executors, hereby waive, release and forever discharge the County of San Mateo, the San Mateo County Sheriff’s Office, the Coyote Point Rifle & Pistol Club, and each of their employees, representatives, or agents for all liabilities, claims, actions, or damages that I may have against them arising out of or in any way connected with my participation in handling or shooting firearms, or my presence at the Range. I understand that this waiver includes any claims, whether caused by negligence, action, or inaction of any of the above parties, or otherwise. The County of San Mateo, the San Mateo County Sheriff’s Office, the Coyote Point Rifle & Pistol Club, and their officers, agents, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from my participation in handling or shooting firearms, or presence at the Range. I expressly agree that I am using the Range at my own risk.

 

I agree to indemnify and hold harmless the County of San Mateo, the San Mateo County Sheriff’s Office, the Coyote Point Rifle & Pistol Club, and their officers, agents, and employees, from all claims, suits, damages, costs, or actions of every name, kind, and description, including reasonable attorneys’ fees, resulting from my participation in handling or shooting firearms, or presence at the Range or on account of any of the following: injury or death of any person, damage to any property, or any other loss or cost, including but not limited to that caused by the active or passive negligence of County and/or Coyote Point Rifle & Pistol Club and/or their officers, agents, employees, or servants.

 

Applicable Law; Consent to Jurisdiction. I agree that the statutes and laws of the State of California will apply to all matters relating to my presence at the Range and this waiver. I agree that any action relating to or arising out of this waiver shall be brought in the Superior Court, County of San Mateo, or the United States District Court for the Northern District of California.

 

The San Mateo County Sheriff’s Office and/or the Coyote Point Rifle & Pistol Club reserve the right to remove from the premises any individual or group of people posing a danger to themselves or others while at the Range and shall have absolute discretion in this regard.

You understand that you are giving up substantial rights, including the right to sue. You acknowledge that you are signing the agreement and waiver freely and voluntarily, and you intend your acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
