Apex Snow Academy Waiver and Release of Liability

1. Acknowledgment of Risks I, the undersigned, acknowledge that participating in snow sports (including skiing, snowboarding, and related activities) involves inherent risks, including but not limited to falls, collisions, equipment failure, and adverse weather conditions. I fully understand that these activities can result in serious injury, permanent disability, or death. I willingly and voluntarily choose to participate, knowing these risks.

2. Release of Liability To the fullest extent permitted by law, I hereby release, waive, and discharge Apex Snow Academy, its owners, instructors, employees, agents, volunteers, and affiliated parties from any and all liability, claims, demands, actions, and causes of action that I may have for injuries, damages, or losses arising out of or in connection with my participation in snow sports activities, even if caused by the negligence of those released. This release applies to all claims, whether known or unknown, and extends to any claims arising after the date of this waiver.

3. Medical Clearance I certify that I am physically fit and have no medical condition that would prevent my participation in snow sports. I understand that it is my sole responsibility to seek medical advice if I have any concerns regarding my fitness to participate. I accept full responsibility for any health issues that may arise during participation.

4. Indemnification I agree to indemnify, defend, and hold harmless Apex Snow Academy from any and all claims, damages, losses, or expenses, including legal fees, arising from my participation in snow sports activities or my breach of this waiver.

5. Photo Release I grant permission to Apex Snow Academy to use photographs or videos taken during the activities for promotional purposes, including but not limited to social media, websites, and advertising materials, without compensation to me.

6. Governing Law This waiver shall be governed by and construed in accordance with the laws of Ontario. Any disputes arising under this waiver shall be resolved in the courts of Ontario.

7. Acknowledgment of Understanding I have read this waiver carefully and fully understand its contents. I acknowledge that I am signing this waiver voluntarily and that it is a legally binding agreement. I understand that by signing, I am giving up certain rights, including the right to sue.
