1. This agreement is made between Rushton Stables, herein after referred to as LESSOR and LESSEE. The Lessor understands and agrees to the following terms of this Lease Agreement. 2. The term of the lease shall begin on the specified date and shall be through December 31, 2023. There are no promises of a horse being available to lease again after a lease is terminated. 3. The horse shall be used for the purpose of riding lessons for the Lessee or their child at Rushton Stables under the supervision of an instructor employed by Rushton Stables and, if desired and discussed, showing. 4. The Horse shall be kept at Rushton Stables 18255 Idaleona Rd Perris, Ca. 92570 at the Lesseeās expense. The Lessee will pay a monthly flat fee of $1000.00 by 5th of each month. This fee shall include board, training, shoeing, and regular vetwork (vaccines, worming). Should any out of the ordinary vetwork be needed, the lessees will be informed and a decision can be made to pay the additional cost or to end the lease. Should the horse become ill or hurt and not be able to fulfill the job, the lease will end and all future financial costs will go to the Lessor. 5. Lessee agrees to hold Lessor harmless from any act of negligence (short of cruelty, neglect, or abuse)of lessee or any of his/her/their agents. In addition, it is understood that the lessee has signed a release of liability that is on file and the lessor will not be held responsible for any liability where the horse is concerned. 6. It is understood that the horse being leased will be in a partial training situation, being worked a maximum of 3 days a week by a professional employed by Rushton Stables in preparation for the Lessee to ride and/or show it. 7. The lease will include 2 lessons per week given by an instructor at Rushton Stables on the leased horse unless it is unable that day due to illness or issue. The lessee will have first priority at shows to show the horse being leased but may not be the only person showing it. 8. It is fully understood that a partial lease does NOT imply any exclusivity in terms of others riders riding the leased horse. In some situations there may be an opportunity to have a second person partially lease the same horse and consideration will be taken to assure that no conflict exists between the 2 parties partially leasing the same horse. In the case of 2 parties partially leasing the same horse, there is still NO promise of exclusivity for those 2 riders to be the only ones that ride the horse. The lessee will always have priority over a non leasing party both for home lessons and for showing. 9. The horse may go to shows with Rushton Stables for the purpose of the Lessee showing or preparing to show it. All show fees will be due to Rushton Stables for any shows. 10. The lessee, once deemed capable, may come 1 day a week, which they must schedule with their instructor, and either get their horse out and groom it or, if safely able may tack their horse up and ride for a maximum of 30 minutes with an instructor present. This is a chance for a rider to relax and enjoy the horse without direct instruction but they must listen to and obey any direct instructions from any instructors present which deem an activity or process dangerous or not in the best interest of the horse. It is agreed that this will NEVER be done without scheduling with their instructor AND without one of the instructors present, for the safety of both the horses and the riders. 11. It is understood that a lessee must have a signed lease on a horse for a minimum of 60 days before taking it to a show. 12. It is understood that leases are on a first come first served basis and horses will not be 'saved' to be leased by particular riders without a signed lease agreement.
