Terms and Conditions TERMS JUSTCLIMBER 計劃期限 / Renewed Automatically 自動續期 I, the undersigned, hereby agree and acknowledge that all memberships of JUST CLIMB are either month-to-month payments or annual one-off payments, and payments are due in advance. I understand such membership will be renewed automatically after the membership has expired (JUST CLIMB will charge me a membership fee every month equivalent to 1-month membership according to the price list in effect at the time being (which may be revised from time to time), until I terminate the membership in the situations set out hereinbelow) and payment will still be made through my designated automatic drafts. The membership of JUST CLIMB can only be terminated upon (1) the expiry of the full minimum term and (2) before 25th of the month with written notice has been given to JUST CLIMB to terminate the membership (by completing the relevant Termination Form). No refunds will apply in any events. 本人，下述簽署人，已同意和知悉JUST CLIMB的JUSTCLIMBER 計劃都要按月收費而且費用必須預先繳付。本人明白即使JUSTCLIMBER 計劃期限已完結，本人JUSTCLIMBER 計劃仍然會自動續期。(JUST CLIMB會根據當時適用的收費表上一個月JUSTCLIMBER 計劃的月費每月收取JUSTCLIMBER 計劃費用（可能不時對收費表作出修改），直至本人按下述情況終止戶籍），而且會經由本人設立的自動轉賬繳交費用。中心的JUSTCLIMBER 計劃只會在以下情況終止：(1)最低承諾期已過，並且（2）在每個月25號之前以書面通知JUST CLIMB終止有關JUSTCLIMBER 計劃（需填寫相關終止服務表格），在任何情況下將不獲退款。 DEFAULT/REMEDIES I, the undersigned, hereby agree and acknowledge that all monthly payment received more than (10) days after the due date shall be subject to a late charge of ten percent (10%) of the amount due. 本人，下述簽署人，現同意和知悉所有月繳費用如在到期日10天後才繳付，需額外繳付應繳費用的10%作逾期費用。 FACILITY AND HOURS OF OPERATION I, the undersigned, hereby agree and acknowledge that the Facility may be subject to closure for maintenance or any mandatory shutdowns by property management or any government authority or other circumstances causing the Facility unable to operate, which shall be determined in the absolute discretion of JUST CLIMB. 本人，下述簽署人，現同意和知悉有機會會因閉門進行維修，或管業處或政府機構強制要求暫停營業，或其他情況，導致設施無法使用，JUST CLIMB擁有絕對的酌情權去作出決定。 RELEASE AND WAIVER OF LIABILITY 免除負任 I, the undersigned, hereby agree and acknowledge that there are hazards and risks connected with physical fitness training. These risks include, but not limited to, abnormal blood pressure, fainting, here disorders, heart attack, dehydration, heat exhaustion, sprains, muscle strain, blisters, stress fracture, shin splints, tendonitis, cartilage tears, bursitis, back pain and bruising of joint, Exercise beyond one’s physical limits and/or accidents involving exercise equipment may result in serious injury or even death. 本人，下述簽署人，現同意和知悉進行體能訓練會涉及危險和風險，這些風險包括但不限於不正常的血壓、昏厥、聽覺障礙、心臟病、缺水、中暑、扭傷、肌肉拉傷、水泡、壓力性骨折、脛痛症侯群、肌腱炎、軟骨撕裂、消囊炎、背痛或關節瘀傷。如超越自身能力的訓練和/或涉及使用設施的意外都有可能引致嚴重創傷甚至死亡。 I, the undersigned, agree to defend, indemnify and hold harmless JUST CLIMB against any loss, damage and expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising out of my negligent or intentional action. 本人，下述簽署人，現同意保障、彌償及使用JUST CLIMB免受任何由於本人疏忽或故意行為引致人身傷害（包括死亡）或財物損失的索償或責任而造成的損失、傷害和費用。 I, the undersigned, further agree to release JUST CLIMB and its owners, officers, agents, employees and/or affiliates from any and all loss. liability and costs arising out of injury to myself and further and to defend, indemnity and hold JUST CLIMB and its owners, officers, agents, employees and/or affiliates free and harmless from against the same. 本人，下述簽署人，現同意免除JUST CLIMB及其擁有者、高級人員、代理、員工和/或關鍵人士因本人受傷而導致的任何損失、責任和費用，並同意保障、彌償和使用JUST CLIMB及其擁有者，高級人員、代理、員工或有關人士免受和免除前述的損失，責任和費用。 I, the undersigned, acknowledge that surveillance cameras (CCTV) are in use for the protection of the Facility, its equipment and its members and hereby consents to being photographed and/or recorded for such purposes. 本人，下述簽署人，現知悉閉路電視系統（ CCTV ）會被使用以保障其設施，設備及其他用場人仕，並基於前述原因同意拍攝和/或記錄本人。 I, the undersigned, hereby agree and acknowledge that JUST CLIMB utilizes facial recognition technology to permit access to the Facility by its members only. I consent to JUST CLIMB collecting my biometric information (including the shapes and colours that make up my face) for such purpose and agree to promptly update JUST CLIMB of any change in my biometric information. I understand it is necessary to give such consent if I decide to join the membership at JUST CLIMB and my membership application may be rejected if such consent is not given. 本人，下述簽署人，現同意和知悉JUST CLIMB使用人像識別技術去容許只有JUSTCLIMBER進入設施。本人同意JUST CLIMB採集本人的生物資料（包括本人臉部的形狀和顏色）以作上述用途，並同意在本人生物資料發生任何變更時立即通知JUST CLIMB。本人明白如本人決定加入JUST CLIMB的JUSTCLIMBER 計劃，上述同意是必須的，與本人沒有給予上述同意，本人的JUSTCLIMBER 計劃申請可能會被拒絕。 I, the undersigned, further agree to release JUST CLIMB and its owners, officers, agents, employees and/or affiliates from any and all loss. liability and costs arising out of injury to myself and further and to defend, indemnity and hold JUST CLIMB and its owners, officers, agents, employees and/or affiliates free and harmless from against the same. 本人，下述簽署人，現同意和知悉JUST CLIMB有可能在JUSTCLIMBER欠交JUSTCLIMBER 計劃資料或違反任何JUST CLIMB制定的規則和規例的情況下，行使單獨和絕對酌情權在任何時候暫停或終止本人JUSTCLIMBER 計劃。倘JUST CLIMB根據本條款暫停或終止JUSTCLIMBER 計劃，將不會再有責任遵守此協議的條款。 I, the undersigned, hereby understand that I have the right to terminate my membership upon a termination fee of HKD1,500 dollars any time during my contract. The termination can be effective immediately in JUST CLIMB’s its sole and absolute discretion. I will not have to pay for the monthly fee onwards and JUST CLIMB assumes no further liability to adhere to the terms of this Agreement. 本人，下述簽署人，現清楚了解本人可再繳交港幣$1,500的終止合約費用後，於合約期間任何時間終止合約。終止合約在JUST CLIMB保留單獨和絕對酌情權的情況下，可即時生效。而本人亦不需要繳付之後月費的費用， JUST CLIMB之後將不會再有責任遵守此協議的條款。 ACCEPTANCE OF TERMS 同意條款 I, the undersigned, hereby confirm that as a member of JUST CLIMB, I understand that I am entitled to use the Facility within the scope of the membership that I have selected and that I am obligated to pay my dues and fees regardless of whether or not I am using the Facility. I agree to promptly update JUST CLIMB of any change in my contact information (including address, telephone number or email address) or change in credit information. 本人，下述簽署人，現確參與JUST CLIMB的JUSTCLIMBER計劃，在本人明白有權使用所選擇JUSTCLIMBER 計劃範圍內的設施，並有責任繳付所需費用和款項，無論本人是否有使用設施，本人同意會在本人個人資料（包括地址、電話或電郵地址）或本人信用資料發生任何變更時立即通知JUST CLIMB以作出相應的更新。 OTHER TERMS AND CONDITIONS 其他條款和條件 1. The Member acknowledges that JUST CLIMB operates under rules and regulations established for the safety and protection of its member, and agrees to be bound by such rules and regulations, as well as the rules and regulations subsequently approved and posted or otherwise published by JUST CLIMB. Such rules and regulations in effect from time to time are incorporated into this Agreement by reference. Facilities, equipment, hours, service, regulations and policies are subject to change from time to time , without prior notice, in the sole and absolute discretion of JUST CLIMB . Member agrees to accept such reasonable change(s) as a condition of membership. 會員確認為保障其會員的安全和權益，JUST CLIMB將按照其訂立規則和規例營運，並同意遵守這些規則和規例，以及JUST CLIMB其後不時制定和公佈的規則和規例。這些規則和規例將不時以引用方式加入此協議。JUST CLIMB保留單獨及絕對酌情權在不需提前通知的情况下不時調整設施，設備，營業時間，服務，規例和政策。會員需同意接受此類合理更改，以作為使用JUSTCLIMBER 計劃的其中一項規例。 2. The Member recognizes that：- 會員知悉： a) Under no circumstances shall Member move exercise equipment or use the equipment in any manner not authorized by JUST CLIMB; 在任何情況下會員均不可移動健身器材或以JUST CLIMB未許可的方式使用器材; b) All equipment shall be wiped down by Member after each use, with the supplies provided by JUST CLIMB; 會員需要在每次使用器材後，以JUST CLIMB提供的工具擦拭所有使用過的器材; c) This membership is for the Member only and the Membership shall not give access to another individual. Should there be any violation of this rule by Member, JUST CLIMB reserve the right and discretion to immediately terminate the Membership and demand for monetary penalty in the sum of $500 or equivalent to membership fee for 1-month membership in accordance with the Price List in effect at the time being, whichever is higher, against the Member; 此JUSTCLIMBER 計劃只限會員使用，而不能供其他人仕進人，如發現會員違反此規定，JUST CLIMB有權即時终止JUSTCLIMBER 計劃並向會員收取$500或享同適用的收費表上一個月JUSTCLIMBER 計劃的月費 (以較高者為準)，作為罰金; d) The Member shall not misuse the equipment and only use the equipment in accordance with the guidelines posted in the Facility; 會員不可誤用器材，應只根據設施裡展示的守則使用器材。 e) The Member shall be at least eighteen (18) years of age ; If a member is under the age of 18, for safety reasons, only the following two situations are allowed to join the JUST CLIMBER program. 會員須最少年滿18歲，如是18歲以下，基於安全理由，只有以下兩個情況許可參與JUST CLIMBER計劃。 1/ Students who are already a regular course or private class student at JUST CLIMB Academy and wish to continue & practice after class are allowed to join the JUST CLIMBER program. 如是JUST CLIMB Academy恆常課程或私人班的學生，有意在課後時間繼續或練習，該學生可參加JUST CLIMBER計劃。 2/ Students who are not in a regular course or private class at JUST CLIMB Academy, one of the parents must join the JUST CLIMBER program and promise to accompany the child to the JUST CLIMB rock climbing gym. One parent is only allowed to take a maximum of two children who have been allowed to join the JUST CLIMBER program to our climbing gym for free climbing. 如不是JUST CLIMB Academy恆常課程或私人班的學生，父母其中一方則必須參加JUST CLIMBER計劃，並承諾會陪同子女到JUST CLIMB攀石場。一名父母只限帶最多兩名已參加JUST CLIMBER計劃的小孩到攀石場自由攀爬。 f) The Member shall conduct themselves in a quiet, well-mannered fashion so as not to cause any disturbance which may interfere with the use and enjoyment of the Facility by any other member. Profanity or indecent language and/or behavior will not be tolerated. Any conduct deemed by JUST CLIMB , in its sole discretion, to be offensive, potentially harmful, dangerous or abusive will not be tolerated, and shall be grounds for termination of Member's membership by JUST CLIMB; 會員應以寧靜，良好品格的方式進行活動，盡避免逕生影響其他會員使用設施的滋擾。任何褻瀆，猥瑣的用語和/或行為都不會被容忍。如JUST CLIMB在其單獨酌情權下認為任何行為是冒犯，有機會損害，危害或虐待使人，將不會容忍以及會成為JUST CLIMB終止會員JUSTCLIMBER 計劃的原因; g) JUST CLIMB shall not be responsible for any lost or stolen items：JUST CLIMB不會負責任何遺失或失竊的物品： h) The Member should not occupy any equipment for an extended period of time and should allow others waiting to use such equipment lo work into their rotation：and 會員不應長時間佔用任何器材並應容許其他等候使用器材的人住輪流使用器材;及 i) The climate of the Facility is controlled by JUST CLIMB and is set to provide the optimum exercise environment for the majority of its members. The Member agrees not to use the Facility or engage in any activity at JUST CLIMB while under the influence of drugs, alcohol, or medication that may impair Member's ability to operate the equipment. No weapons of any kind are allowed. No photography, videotaping, filming or audio recording is permitted within the Facility without the express written consent of JUST CLIMB's management. JUST CLIMB reserves the right, in its sole discretion, to limit the consumption of food or beverages, or to the use of outside equipment within the Facility. Gambling or gaming is prohibited within the Facility or on the premises.設施内嚴禁飲酒，吸毒(包括類固醇)和吸煙。會員同意不會在毒品，酒精或藥物以致影響會員操作器材的情況下使用設施或進行任何JUST CLIMB的活動。嚴禁使用任何類型的武器。嚴禁在設施範圍內拍照，攝錄，拍攝影片或錄音，除非已事先獲得JUST CLIMB管理層的許可。JUST CLIMB保留權利在其單獨酌情權下規管在設施範圍內食用食物或飲品，或使用外來的器材。嚴禁在設施範圍內中心内進行賭博或遊戲。 k) JUST CLIMB requires that Members wear appropriate clothing and footwear while in the Facility. Appropriate clothing includes gym shorts, T-shirts, jogging suits, aerobic wear and sweat outfits. Street clothing and jeans are not considered appropriate clothing. Street shoes and black-soled shoes are prohibited within the Facility. The Member agrees to have a cloth towel during workouts to protect and clean the equipment after Member's use. JUST CLIMB要求會員在設施內須穿著適當衣物和鞋履。適當衣物包括健身短褲，T-Shins，跑步裝束，拉筋裝束和運動裝束。街頭服裝和牛仔不視為適當衣服。設施内嚴禁穿著街頭服裝和黑皮鞋。會員同意在運動時自備毛巾以在使用器材後進行保護和清潔。 l) JUST CLIMB may update their policies and practices in relation to the use of the Facility from time to time. They will notify the Members about the significant changes as made to its policies or practices by placing a notice in respect of such change- on its website or in its Facility. JUST CLIMB可能不時對其設施的使用政策和守則通行更新，如有任何前述的更新，將於其網站展示通知以知會各會員相關使用政策和守則的重大更改。 m) The Member agrees and acknowledges that his use and enjoyment of the Facility and/or services provided by JUST CLIMB under this Agreement may be limited by problem, difficulties and/or incapability of himself/herself and that the Member is still obliged to make full payment of the Membership Fees and other charges under this Agreement and JUST CLIMB shall not in any event refund in whole or in part any of the fees payable by the Member under this Agreement. 會員同意和知悉其自身存在的問題，困難和/或喪失能力的情況有可能妨礙會員全面使用及/或享受根據此協議由JUST CLIMB提供的設施和/或服務，而會員仍有責任根據此協議全數支付JUSTCLIMBER 計劃和其他相關費用，JUST CLIMB在任何情况下均不會向會員退還根據此協議已由會員支付的任何費用。 n)The Member shall not engage in any paid or paid personal training or instructions to other Members without prior approval of JUST CLIMB.未得到JUST CLIMB的事先同意下，會員不能在場地内對其他會員進行受薪或非受薪的個人教練/私人技術指導。 OTHER TERMS AND CONDITIONS 其他條款和條件 o) This Agreement shall be binding upon, inure to the benefit of, and be enforceable by the parties hereto and their respective successors and assigns. 此協議將對協議各方和其各自的繼受人和受讓人具有約束力，為其利益而訂立，以及可強制執行。 p) This Agreement, including the schedule, lists and other documents referred to in this Agreement which forma part of this Agreement, embody the entire agreement and understanding of the parties with respect to the subject matter contained in this Agreement. There are no restrictions, promises, warranties, covenants or undertakings, other than those set forth or referred to in this Agreement. This Agreement supersedes all prior agreements and understandings between the parties with respect to the subject matter. 此協議，包括附表，清單和其他此協議引用並作為此協議一部分的文件，構成各方之間的完整協議及對此協議相關事項的理解。除非此協議明確指出或引用，否則沒有任何其他限制，承諾，保證，契約或擔保。此協議明確取代各方此前就相關事項達成的協議和共識。 q) The headings in this Agreement are inserted for convenience only and shall not constitute a part of this Agreement. 此協議的標題只為方便查閱而設，不應作為此協議的一部分。 r) This Agreement shall be governed by the laws of Hong Kong and in case of any disputes arising from this Agreement, the Member and JUST CLIMB agree to subject to the non-exclusive jurisdiction of the Hong Kong courts. 本協議受制於香港法律，如就此協議產生任何爭議，會員和JUST CLIMB均同意受香港法院的非專屬司法管轄權管轄。 s)This Agreement is made in both the English and Chinese language. The Chinese version is a translation of the English version but in the event of any inconsistencies between the two versions, the English version shall prevail. 本協議以英文和中文訂立，而中文版本為英文版本的翻譯本。如兩個版本之間有任何歧義，將以英文版本為準。 t) JUST CLIMB shall keep all Members“personal data(including biometric information)confidential except that JUST CLIMB expressly reserves its right to enable itself and/or its agent and/or its affiliates to use such information for the purpose of statistics and/or direct marketing(subject to Member's consent)and/or to provide communications of their services, such as service announcements, administrative messages, newsletters and/or the like. The Members who have given consent to the aforesaid shall be entitled to request JUST CLIMB to cease the use of personal information for the purpose of statistics and/or direct marketing and/or to provide communications of their services by notifying JUST CLIMB in writing. 除了JUST CLIMB明確保留其和/或其代理和/或其關聯人仕使用會員個人資料的權利以作統計和/或直銷用途(如會員同意)和/或以不同方式發送與其服務有關的資訊，例如服務通告，行政訊息，通訊和/或相類似形式，JUST CLIMB將會對會員個人資料(包括生物資料)進行保密。如會員對前述個人資料的使用已表示同意，將有權以書面形式要求JUST CLIMB停止繼續使用個人資料作統計和/或直銷用途和成發送與其服務有關的資訊。 I, the undersigned, hereby consent to the use of my personal data for statistics and direct marketing purposes. 本人，下述簽署人，現同意使用本人個人資料以作統計和直銷用途。 本人，下述簽署人，現確認本人已有足夠時間去審閱此協議，在簽署此協議的情況下，本人表示明台上述的每一個條款和條件，並同意嚴格遵守和履行上述的每一項。
24小時使用場地條款及細則：
1.JUST CLIMB會藉只適用於持有人，會藉不可轉讓
2.每位JUST CLIMBER確認並認同已細閱「24/7安全注意影片」，並完全理解，同意；
3.每位JUST CLIMBER都有權使用和到訪JUST CLIMB場地和/或使用JUST CLIMB設施。 任何JUST CLIMBER均不得允許任何其他非JUST CLIMBER隨行，或與一起以其他方式到訪或使用任何JUST CLIMB場地和/或設施。
4. JUST CLIMBER承諾最少會與兩位CLIMBER同行攀爬，在攀爬期間會有人在旁，如有任何意外或身體不適，會有人可緊急聯絡救護服務。
5.由於JUST CLIMB石門店與太古店在沒有當值教練時以自助服務的方式運營，並且在沒有任何現場人員的情況下開放，因此JUST CLIMBER需有攀登經驗，應始終對自身的安全和健康負全責。
6.JUST CLIMB太古店和石門店開放時間為二十四（24）小時，包括公共假期和惡劣天氣警告，但JUST CLIMB保留無需任何事先通知或補償下關閉任何中心、拒絕所有或任何會員到訪或使用任何JUST CLIMB場地或設施的權利（包括但不限於維修、緊急情況，合規性和預防犯罪或事故）。
7. JUST CLIMBER應保持場地和設施的整潔，以方便其他用戶使用。
8.每位JUST CLIMBER都承認並接受CCTV閉路電視的使用，並覆蓋JUST CLIMB的所有或任何區域（廁所及浴室內除外）以及每天24小時或任何時間運作。 從閉路電視獲得的所有資訊將僅用於安全、預防犯罪和相關目的。
9.每位JUST CLIMBER同意在任何時候為JUST CLIMB保持無害。任何第三方引起或遭受的損失、損害或費用，或由於會員的行為疏忽、魯莽、違約和/或違反這些條款和細則而造成的人身傷害（包括死亡）或財產損失，JUST CLIMBER同意和使JUST CLIMB保持無害。
10.JUST CLIMB不會負責任何違失或失竊的物品;
11.如有任何爭議，將以JUST CLIMB之最終決定為準。
24 Hours Gym Usage Terms & Conditions
1. JUST CLIMB membership is only applicable to the holder, and not transferable
2. Each JUST CLIMBER confirms and agrees that the member has carefully read the "24/7 Safety Video", and fully understands;
3. Every JUST CLIMBER has the right to use and visit JUST CLIMB venues and/or use JUST CLIMB facilities. No JUST CLIMBER shall allow any other non-climber to accompany or otherwise visit or use any JUST CLIMB venue and/or facility with a member.
4. JUST CLIMBERS promise to climb with at least two members. There will be another member by the side during climbing. If there is any accident or physical discomfort, someone will call the ambulance service urgently.
5. Since JUST CLIMB Shek Mun and Tai Koo operate in a self-service when there is no coach on duty, and are open without any on-site staff, JUST CLIMBER need to have climbing experience and should always be concerned about their own safety. Take full responsibility for their own health.
6. JUST CLIMB is generally open for twenty-four (24) hours, including public holidays and severe weather warnings, but JUST CLIMB reserves the right to close any gym without any prior notice or compensation , reject all or any members to access or use any JUST CLIMB venue or facility (including but not limited to maintenance, emergency, compliance and crime or accident prevention).
7. JUST CLIMB members shall keep the venue and facilities clean and tidy for the convenience of other members.
8. Every JUST CLIMBER acknowledges and accepts the use of CCTV and covers all or any area of JUST CLIMB (except in toilets and bathrooms) and operates 24 hours a day or any time. All information obtained from CCTV will be used for safety, crime prevention and related purposes only.
9. Each JUST CLIMBER agrees to defend and keep JUST CLIMB harmless at all times for any loss, damage or expense caused. A result of the member's conduct in negligence, recklessness, breach of contract and/or for personal injury (including death) or property damage caused by breach of these terms and conditions, members agree to keep JUST CLIMB harmless.
10. JUST CLIMB will not be responsible for any lost or stolen items;
11. In case of any disputes, the final decision of JUST CLIMB shall prevail.
