ANNUAL WAIVER, RELEASE, AND INDEMNITY AGREEMENT

FOR NON-SCUBA DIVERS

Everyone who enters The Scuba Ranch must update this waiver annually.

 

 

For the purposes of this document, "SCUBA RANCH AND RECREATION PARKS, LLC", "THE SCUBA RANCH", "PARK", and "PROPERTY", and "PREMISES" ALL REFER TO THE SAME FACILITY KNOWN AS "THE SCUBA RANCH" LOCATED AT 8131 CR 346, TERRELL, TEXAS 75161. For the purposes of this document, "Management Company" refers to CD Park Management, LLC providing management services to Scuba Ranch and Recreation Parks, LLC. The term "Employees" refers to any staff member or volunteer of either of the above mentioned companies. "Released Parties" refers to all of the above persons and entities. 

In consideration of permitting me access to and use of SCUBA RANCH AND RECREATION PARKS, LLC, property, lake, floating docks, underwater platforms, open water training facility, underwater attractions, equipment, training pool, rental gear, air-fill, campsites, cabins, RV hook-ups, website, or online booking, and allowing me to participate in scuba/skin/free diving classes, and/or renting gear, and/or individual scuba/skin/free diving, and/or air-fills, or swimming, floating, camping and/or any other water activities, and/or any other land activity or special event, or online resources from or on the property located in Terrell, Kaufman County, Texas, I hereby voluntarily release, discharge, waive, and relinquish any and all actions or causes of action for personal injury, illness, death, property damage, vandalism, or theft occurring to me as a result of engaging in any activities incidental thereto wherever or however they may occur and for whatever period said activities or instructions may continue.

I recognize that scuba diving, skin diving, free diving, and other water activities have inherent dangers that could result in injury, illness, or death. 

EVEN IF I AM NOT SCUBA/SKIN/FREE DIVING, I RECOGNIZE THE SAME DANGERS IF I CHOOSE TO PARTICIPATE IN OTHER FORMS OF RECREATION AND/OR ACTIVITIES IN THE PARK, INCLUDING BUT NOT LIMITED TO SWIMMING, SNORKELING, CAMPING, RENTING GEAR, FILLING OF AIR TANKS, TUBE FLOATING, AND/OR ANY OTHER WATER/LAND ACTIVITIES I MAY PARTICIPATE IN. I RECOGNIZE THE INHERENT DANGERS THAT MAY OCCUR ON THE NATURAL LAND, WATER, STRUCTURES, AND PROXIMITY TO WATER ON THE PROPERTY OF THE SCUBA RANCH. 

I UNDERSTAND THAT THERE IS NEVER A LIFEGUARD ON DUTY AT SCUBA RANCH AND RECREATION PARKS, LLC.  

I recognize that SCUBA RANCH AND RECREATION PARKS, LLC also carries inherent risks or dangers of an outdoor environment including but not limited to wild animal/insect presence, weather/storm events, ground hazards, other environmental hazards, or other inherent risks that occur in a natural environment and SCUBA RANCH AND RECREATIONS PARKS, LLC and it's Management Company are not able to control the natural environment. 

If applicable, I recognize that I AM RESPONSIBLE FOR ATTENDING TO MY CHILDREN AT ALL TIMES, and I am FULLY responsible for their well-being while on the grounds of SCUBA RANCH AND RECREATION PARKS, LLC. 

I acknowledge and agree that this Release and Waiver of Liability is intended to be, and is, a complete release of any responsibility of the Released Parties for any and all personal injuries, disfigurement, temporary or permanent disability, psychological impairment, death, and/or property damage sustained by me while on or using the property, premises, attractions, and/or rental gear.  

I understand that SCUBA RANCH AND RECREATIONS PARKS, LLC does NOT directly provide instruction of any kind, nor do I have any expectation thereof. I understand that any instruction I may receive is by an instructor that is independent of  SCUBA RANCH AND RECREATIONS PARKS, LLC.  I understand the vetting of any instructor of any kind that I may utilize while on the Park property is my own responsibility. SCUBA RANCH AND RECREATION PARKS, LLC does not endorse, provide, or assign any specific Instructors.

I understand that SCUBA RANCH AND RECREATION PARKS, LLC, requires a minimum of Open Water Scuba Certification to scuba dive without the supervision of an instructor. I certify that if I choose to scuba dive while on the Property, that I am properly certified by an accredited scuba diving agency. I understand that if I do not have such certification I may ONLY scuba dive under the supervision of a credentialed Dive Professional.  I also hereby affirm that the scuba certification number I am providing, if applicable, is valid to the best of my knowledge, and that it is the number that was given to me upon my agency certification. I understand that I may not scuba dive under someone else's certification number, and I affirm that I am the one represented on this certification. 

I understand that it is my responsibility to dive within my level of training, and to dive responsibly. This includes NOT diving while I am under the influence of alcohol or mind altering drugs of any kind. This also includes, but is not limited to diving within the scope of my certification, and being cognizant of any health related changes to which scuba diving would be contraindicated. 

I also understand that if I am using rental gear from SCUBA RANCH AND RECREATION PARKS, LLC I am ultimately responsible for making sure it is in good working order prior to diving. If there are any problems with the rental gear, it is my responsibility to bring it to the attention of SCUBA RANCH AND RECREATION PARKS, LLC and trade it out as soon as possible. If I dive using rental gear from SCUBA RANCH AND RECREATION PARKS, LLC I am responsible for it's safe use, and agree to hold harmless SCUBA RANCH AND RECREATION PARKS, LLC and it's employees, management, and subsidiaries for decisions I make while using the rental gear, including my decision to use it even if it is faulty. 

I have been informed that SCUBA RANCH AND RECREATION PARKS, LLC, is remote both by time and distance from a decompression chamber. I hereby agree that I will not perform any dives at SCUBA RANCH AND RECREATION PARKS, LLC, that require decompression (No Decompression Dives Only). I understand the dangers of breath-holding while scuba diving and agree never to hold my breath while ascending. I also acknowledge and understand there are underwater overhead environments that require advanced diving skills and I agree not to exceed my personal diving limitations and/or training. I will not attempt ANY dive that I do not feel completely comfortable and safe with, nor will I complete any dive I am not trained for.

I have been informed that there are tools for first-aid, trauma, oxygen, and AED next to the air-fill station. These are a courtesy to guests, and may be used as needed. I also acknowledge that while SCUBA RANCH AND RECREATION PARKS, LLC annually checks this equipment for inventory or its effectiveness, it does not hold the responsibility of a guarantee that it is always complete or in working order. I also understand that if emergency services are required, it is my responsibility to call 911 prior to notifying SCUBA RANCH AND RECREATIONS PARKS, LLC of the emergency.  

I, for myself, my heirs, executors, administrators, and assigns hereby release, discharge, waive and relinquish any and all actions or causes of action, aforesaid, which may hereafter arise for me and my estate, and agree that under no circumstances will I or my heirs, executors, administrators, and assigns prosecute, present any claim for personal injury, illness, property damage, theft, or wrongful death against its officers, instructors, agents, or employees for any of said causes of action, whether the same shall arise by negligence of any said persons, or otherwise. It is my intention, by this instrument, to exempt, relieve, indemnify, and save/hold harmless SCUBA RANCH AND RECREATION PARKS, LLC, their facilities, or any of its officers, agents, volunteers, managers, or employees from liability for personal injury/illness, property damage, or wrongful or natural death arising from the use of the aforementioned facilities, both on land and in the water.

This Release Agreement is legally binding between the parties, their heirs, administrators, Management Company, and any additional assigns or assignees of the fact hereof. The Releasor has the power to free any claim and has not assigned and may not assign, any claim to a third party. If one provision herein is held invalid, it does not invalidate the remaining provisions of the contract. This Release is the final result of discussion by both parties and supersedes all agreements previously obtained. This document may not be modified in any way except by authorization of both parties on it. The terms of this release are regulated under the laws of the jurisdiction of the State of Texas. Any claims against it shall be subject to State of Texas law.  

I understand this Release and Waiver of Liability is valid for one year from the date of signing and must be updated annually while using the property, premises, services, air-fill and/or rental gear at SCUBA RANCH AND RECREATION PARKS, LLC

I understand that there are no refunds available for my admission after entry.

I acknowledge that I have read and fully understand the foregoing paragraphs and have been fully and completely advised of the potential dangers incidental to engaging in the activity and instructions of scuba/skin/free diving, and/or the use of SCUBA RANCH AND RECREATION PARKS, LLC, facilities, water, grounds, training pool, RV spaces, cabins, campsites, rental gear, filling of air tanks, campsites, etc., and I am fully aware of the legal consequences of signing this instrument.  

SCUBA RANCH AND RECREATION PARKS, LLC does NOT permit solo diving, and by signing this I recognize that if I choose to solo dive anyway, I am taking on an added level of risk not endorsed by THE SCUBA RANCH AND RECREATION PARKS, LLC. Also, solo diving may be grounds for removal from the park. I acknowledge that I have read and fully understand the added dangers of this practice and release SCUBA RANCH AND RECREATION PARKS, LLC, their facilities, or any of its officers, instructors, agents, management company or employees from liability for personal injury/illness, property damage, or death arising from my choice to do so.

 I acknowledge that I must have at least my Open Water scuba certification to scuba dive at SCUBA RANCH AND RECREATION PARKS, LLC, unless I am being supervised by a properly credentialed Dive Professional. I also hereby affirm that if I have provided a scuba certification number, I attest that it is valid and in good standing to the best of my knowledge, and that it is the number that was given to me upon my certification. I understand that I may not scuba dive under someone else's certification number, and I affirm that I am the one represented on this certification.

 I understand that only certified Dive Instructors or Dive Masters/Assistant Instructors under supervision of a Dive Instructor are authorized to teach scuba lessons. Under no circumstances will I attempt to teach scuba/free/skin diving to anyone on the Property unless I am a certified and credentialed Dive Professional, and have provided my certification credentials to Scuba Ranch and Recreation Parks, LLC.  If I am a dive professional, I attest that the instructor/dive master certification card/number I have provided is valid and in good standing with the certifying agency.

I understand that if I need to rent any scuba/snorkel gear from The Scuba Ranch, it is subject to a $25 deposit, which will be refunded AFTER gear is returned ON TIME AND IN GOOD ORDER. Rental gear is due back at 5pm on the day the rental ends.

I understand that after I have received my certification card, I will need to present it to The Scuba Ranch to dive in the future.
