Event Participant Acknowledgment and Waiver of Liability

In consideration of being permitted to participate in Chaffee County events and contests (“Activities”), held at the County Fairgrounds and sponsored by Chaffee County, Colorado (the “County”), I agree to the following:

1.       I FULLY UNDERSTAND THE DANGEROUS NATURE OF THE ACTIVITIES and am qualified to participate in the Activities. I acknowledge that I am not required to participate in the Activities and that neither the County, nor its boards, employees, agents or assigns provide insurance coverage. I am participating in the Activities entirely on my own volition. The County has made no representation, either implicit or express, that the Activities are safe and free from hazard or risk. Many of the hazards or risks associated with the Activities may not be known to me or readily foreseeable at this time. I agree and represent that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. I further agree to abide by all rules and regulations pertaining to the event.

2.       I ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE while participating in the Activities.

3.       I RELEASE, WAIVE AND DISCHARGE any and all claims, suits and causes of action against, AND I PROMISE NOT TO SUE the County, or any of its elected officials, employees, appointed boards, agents, contractors or other participants for any personal injuries, death or property damage, whether or not caused by the County’s negligence, in connection with my participation in the Activities.

4.       I SHALL INDEMNIFY AND HOLD HARMLESS the County, its elected officials, employees, agents, contractors and other participants from any and all losses (including interest and attorneys' fees and expenses), whether or not caused by the County’s negligence, due to my participation in the Activities.

This Release, Waiver, Assumption and Indemnification Agreement is intended to be as broad and inclusive as is permitted by Colorado law and if any portion of this Agreement is held invalid, the remainder shall continue in full legal force and effect. I acknowledge that no oral representations, statements or inducements apart from this written agreement have been made.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT IS A RELEASE OF ALL PRESENT AND FUTURE CLAIMS. I UNDERSTAND THE RISKS INHERENT IN ENGAGING IN FAIR EVENTS. I VOLUNTARILY HAVE SIGNED MY NAME EVIDENCING MY ACCEPTANCE OF THE ABOVE PROVISIONS.
