ADULT PARTICIPANT RELEASE, ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT

IMPORTANT LEGAL NOTICE — PLEASE READ CAREFULLY BEFORE SIGNING.

THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING, YOU VOLUNTARILY ASSUME THE RISKS OF PARTICIPATION AND RELEASE CERTAIN CLAIMS, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. YOU MAY BE GIVING UP YOUR RIGHT TO SUE FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.

1. LEAGUE TOURNAMENT EVENTS & COVERAGE PERIOD

This Agreement applies to participation in or attendance at flag football activities organized, administered, conducted, or authorized by CCFL Boston / 5X5 Football, including Cleveland Circle Football League, Champions Cup Football League, and associated competitions.

The League Tournament format combines elements of organized league play and tournament competition and may include regular-season games, qualifying games, round-robin competition, group play, playoffs, knockout rounds, and championship games.

Covered activities include:

  • CCFL Boston Spring and Fall League Tournaments
  • 5X5 Football Qualifiers and Tournament Circuit
  • 5X5 Football Super Sixteen Championship
  • Legends, Holiday, Pioneer, and other qualifying events
  • Gold, Silver, and Bronze Championship competitions
  • Boston Fives, Heroes Football Tournament, and other officially designated events
  • All associated games, playoffs, qualifying rounds, rescheduled games, make-up games, and organized football activities

All such activities are collectively referred to as "League Tournament Events" or "Events."

COVERAGE PERIOD: JANUARY 1, 2026, THROUGH APRIL 30, 2027, INCLUSIVE.

Events may take place at Daly Field, Cleveland Circle, Charlestown, Boston-area parks, Massachusetts Department of Conservation and Recreation facilities, YMCA facilities, and other officially designated locations.

Dates, schedules, locations, and competition formats are subject to change.

2. ADULT PARTICIPATION REQUIREMENT

ALL PARTICIPANTS MUST BE AT LEAST EIGHTEEN (18) YEARS OLD.

By signing this Agreement, I certify that I am at least eighteen (18) years of age, legally competent to enter into this Agreement, and voluntarily signing on my own behalf.

Every participant must individually sign this Agreement before participating in any covered Event. A team captain's registration or signature does not substitute for an individual player's signed waiver.

3. ACKNOWLEDGMENT & ASSUMPTION OF RISK

I voluntarily elect to participate in or attend the Events and understand that flag football is a physically demanding activity involving inherent and foreseeable risks.

These risks include, but are not limited to:

  • Player collisions, physical contact, falls, and accidental impacts
  • Sprains, fractures, concussions, and head, neck, or spinal injuries
  • Heat-related illness, dehydration, fatigue, and overexertion
  • Uneven or slippery playing surfaces, weather, and equipment conditions
  • Injuries resulting from the actions or omissions of other participants
  • Permanent disability, serious bodily injury, or death

I understand that League Tournament Events may involve multiple games, doubleheaders, consecutive games, and championship rounds within limited periods, increasing fatigue and physical risk.

I KNOWINGLY AND VOLUNTARILY ASSUME THE INHERENT RISKS ASSOCIATED WITH PARTICIPATION, WHETHER KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEABLE.

I understand that referees, organizers, and other participants cannot eliminate all risks associated with competitive football.

4. EXPRESS RELEASE OF LIABILITY — INCLUDING ORDINARY NEGLIGENCE

In consideration of being permitted to participate in or attend the Events, I, on behalf of myself and, to the extent permitted by law, my heirs, estate, legal representatives, and assigns, hereby release and discharge:

Andrew Tamayo, individually and in his capacities as Commissioner, organizer, administrator, and referee; CCFL Boston; 5X5 Football; Cleveland Circle Football League; Champions Cup Football League; their applicable legal operating entities; and their respective owners, officers, directors, employees, agents, volunteers, referees, officials, and authorized representatives (collectively, the "Released Parties").

To the fullest extent permitted by Massachusetts law, I release the Released Parties from claims for personal injury, death, property damage, and related losses arising from participation in or attendance at the Events, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

This release expressly includes ordinary negligence involving:

  • Event organization, scheduling, and supervision
  • Referee decisions and officiating
  • Field inspection and maintenance responsibilities
  • Equipment selection, inspection, and use
  • Enforcement of competition and safety rules
  • Administration of League Tournament Events

I UNDERSTAND THAT I AM RELEASING CERTAIN CLAIMS EVEN WHEN AN INJURY IS ALLEGED TO HAVE RESULTED FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

Nothing in this Agreement releases gross negligence, reckless or intentional misconduct, or any liability that cannot lawfully be waived.

5. COVENANT NOT TO SUE

To the fullest extent permitted by law, I agree not to bring or maintain legal proceedings against the Released Parties for claims covered by this Agreement.

I understand that I am giving up certain rights to seek monetary damages for injuries or losses arising from participation in or attendance at the Events.

This provision does not apply to claims that cannot lawfully be waived.

6. PARTICIPANT RESPONSIBILITIES & CONCUSSION SAFETY

I agree to follow applicable League Tournament and facility rules and reasonable instructions from referees and event officials.

I will refrain from fighting, intentional dangerous contact, threats, abusive behavior, and other prohibited conduct.

I understand that concussions and serious head injuries may occur. I agree to report suspected concussions and discontinue participation if I experience symptoms of a concussion or other serious injury.

A PARTICIPANT SUSPECTED OF SUSTAINING A CONCUSSION SHALL NOT RETURN TO PLAY THAT DAY AND MUST OBTAIN APPROPRIATE MEDICAL CLEARANCE BEFORE RETURNING TO PARTICIPATION.

I acknowledge my responsibility to assess my physical condition, obtain medical advice when appropriate, and refrain from playing when medically unfit.

7. PLAYER CONDUCT, DISCIPLINE & DISQUALIFICATION

Referees and authorized event officials may impose penalties, temporarily remove participants, or eject players for dangerous play, unsportsmanlike conduct, fighting, threats, or serious rule violations.

The Commissioner or authorized organizers may impose additional disciplinary measures, including suspension, disqualification, or removal from future Events, subject to applicable law.

Participants agree to comply with applicable published competition and disciplinary rules.

8. LEAGUE TOURNAMENT RULES, ELIGIBILITY & PRIZES

Participation in League Tournament Events is subject to applicable published rules governing team and player eligibility, rosters, qualifying games, rankings, seeding, advancement, and championship competition.

Registration or participation does not guarantee advancement, championship qualification, or receipt of prizes.

Cash awards, championship prizes, and other distributions are governed by the applicable published competition rules.

9. MEDICAL EXPENSES & INSURANCE

I understand that participation may result in injuries requiring emergency or continuing medical treatment.

Unless expressly confirmed in writing, organizers do not provide individual participants with personal health, disability, or life insurance coverage.

Certain participant medical benefits may be available under an applicable event insurance policy, subject to that policy's eligibility requirements, limits, exclusions, and conditions. No particular benefit or payment is guaranteed by this Agreement.

I remain responsible for medical expenses not covered by applicable insurance, subject to law.

I authorize event personnel to contact emergency medical services when reasonably necessary.

10. INDEMNIFICATION

To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties against third-party claims, losses, damages, and reasonable legal expenses to the extent caused by my own negligent, reckless, intentional, or wrongful conduct in connection with the Events.

This provision does not require me to indemnify any Released Party for that party's own negligence or liability that cannot lawfully be transferred.

11. EVENT CHANGES & SAFETY

Organizers may postpone, relocate, reschedule, modify, or cancel Events because of weather, field conditions, facility availability, safety concerns, or circumstances beyond their reasonable control.

Participants must comply with applicable facility regulations and safety instructions.

Nothing in this Agreement eliminates legal duties that cannot lawfully be waived.

12. GOVERNING LAW & SEVERABILITY

This Agreement is governed by the laws of the Commonwealth of Massachusetts.

If any provision is held invalid or unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law.

This Agreement applies to the identified Events during the stated coverage period.

13. ELECTRONIC SIGNATURE & CONSENT

I consent to signing this Agreement electronically and intend my electronic signature to have the same legal effect as a handwritten signature, to the extent permitted by law.

I acknowledge that I have had an opportunity to review this Agreement and retain or obtain a copy for my records.

I certify that I am personally completing and signing this Agreement.

14. FINAL PARTICIPANT ACKNOWLEDGMENT

BY SIGNING, I ACKNOWLEDGE THAT:

  1. I am at least eighteen (18) years old.
  2. I have read and understand this Agreement.
  3. I understand the risks of serious injury, permanent disability, and death associated with flag football.
  4. I voluntarily assume the inherent risks of participating in League Tournament Events.
  5. I understand that this Agreement releases certain claims, including claims arising from ordinary negligence.
  6. I understand that I am giving up certain legal rights, including the right to sue for money damages on claims covered by this Agreement.
  7. I have had the opportunity to ask questions and seek independent legal advice.
  8. I voluntarily agree to these terms.

I HAVE CAREFULLY READ THIS RELEASE, ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, AND VOLUNTARILY AGREE TO BE BOUND BY ITS ENFORCEABLE TERMS.
