1. PURPOSE OF AGREEMENT

The Fun Place (“Facility”) provides a recreational environment for children and families. The Facility is not a childcare service, daycare, or supervised play program. This Agreement outlines the responsibilities of the parent/guardian and releases the Facility from certain liabilities under Texas law.

2. ACKNOWLEDGMENT OF RISKS

I understand that participation in play activities, inflatables, climbing structures, arcade games, and general movement inside the Facility poses inherent risks, including but not limited to:

  • Slips, trips, and falls
  • Collisions with equipment or other guests
  • Minor injuries such as bruises or scrapes
  • Potential exposure to illness

I voluntarily accept these risks on behalf of the child(ren) listed above.

3. PARENT/GUARDIAN RESPONSIBILITY

I acknowledge and agree that:

  • I am solely responsible for supervising the child(ren) at all times while inside the Facility.
  • At least one parent/guardian over the age of 18 must remain inside the Facility at all times.
  • Staff members are not responsible for supervising, tending to, or monitoring my child(ren).
  • I must ensure that my child(ren) follow all posted rules and staff instructions.
  • Socks are required for all participants (available for purchase if needed).
  • No outside food or drinks are permitted, except for medical or infant needs.

4. UNATTENDED CHILD POLICY

To protect all guests and limit liability:

  1. Children may NOT be left unattended in the Facility under any circumstance.
  2. If The Fun Place becomes aware that a child is without a supervising adult, staff will:
  • Escort the child to the front desk,
  • Attempt to contact the parent/guardian, and
  • Keep the child in a safe visible area until the adult returns.
  1. If a parent/guardian cannot be located in a reasonable timeframe, local authorities (non-emergency line) may be contacted to ensure the child’s safety.
  2. Any parent/guardian who leaves the premises without their child(ren) may be denied entry in the future.

I understand that leaving my child unattended violates Facility policy and may increase risks, for which I accept full responsibility.

5. RELEASE OF LIABILITY

In consideration of access to the Facility, I hereby:

  • Waive, release, and discharge The Fun Place LLC, its owners, employees, and agents from any liability, claims, demands, or causes of action arising from injuries or damages related to my child(ren)’s participation.
  • Agree that this release applies except where prohibited by Texas law

6. MEDICAL AUTHORIZATION

In the event of an emergency when I cannot be reached, I authorize Facility staff to call emergency services on my behalf. I am responsible for any related medical expenses.

7. SOCIAL MEDIA & PHOTO/VIDEO RELEASE (MANDATORY)

I grant The Fun Place LLC permission to:

  • Photograph or record my child(ren) inside the Facility,
  • Use such images for marketing, advertising, social media, and promotional purposes,
  • Without expectation of payment or compensation of any kind.

The Fun Place will never share personal names or identifying information.

I may opt out only by notifying staff before photos are taken and ensuring my child is not in photo areas.

8. RULES OF CONDUCT

I agree to follow and ensure my child(ren) follow all rules posted at the entrance, including:

  • Adult supervision at ALL times
  • No rough play
  • No food/drinks in play areas
  • Socks required
  • Respect for staff and other guests

Violation of rules may result in removal without refund.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
