Release of Liability and Waiver of Claims

 

In consideration of being allowed to use the facilities and services provided by NYC Swan Marina, LLC, located at 163-45 Cross Bay Blvd, Howard Beach, NY 11414, I hereby acknowledge and agree to the following:

1. Assumption of Risk: I understand and acknowledge that participating in activities at the marina, including but not limited to boating, swimming, fishing, and use of marina equipment, involves inherent risks. These risks include, but are not limited to, injury, illness, property damage, drowning, and death.

2. Release of Liability: I hereby release, waive, and discharge NYC Swan Marina, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my use of the marina facilities or participation in marina activities, including any negligence on the part of the marina or its employees.

3. Indemnification: I agree to indemnify and hold harmless NYC Swan Marina, its owners, employees, agents, and representatives from any and all liabilities or claims made by third parties arising out of my use of the marina facilities or participation in marina activities.

4. Medical Treatment: In the event of an injury or medical emergency, I authorize the marina staff to seek and consent to medical treatment on my behalf, including transportation to a medical facility, if deemed necessary.

5. Personal Property: I understand and acknowledge that I am solely responsible for my personal property while on the marina premises and that the marina is not responsible for any loss, theft, or damage to my personal belongings.

6. Voluntary Participation: I acknowledge that my participation in marina activities is voluntary, and I assume full responsibility for any risks or injuries that may occur as a result of my participation.

7. Validity: I acknowledge that this waiver is valid and binding upon my heirs, next of kin, executors, administrators, and assigns, and that it shall be governed by the laws of New York.


I have read this waiver and fully understand its contents. I am aware that by signing this waiver, I am waiving certain legal rights, including the right to sue.
