Parental Agreement and Waiver

Smart Gym CIC 

Disclaimer: The waiver below has been reviewed by legal professionals and is intended to outline certain risks and responsibilities associated with the following Smart Gym CIC (Smart Gym) services: Soft Gym (supervised); Soft Gym (unsupervised); Main Gym (child’s use thereof). It is important that you consult with a solicitor regarding any legal questions or concerns you may have before signing this waiver. By signing this agreement, you acknowledge that you have read and fully understand the terms of this waiver and release, and that you are voluntarily giving up certain legal rights to engage in these services. 


SECTION 1: Parental Agreement & Waiver - Soft Gym (SUPERVISED)

  • I consent to my child being supervised by a member of Smart Gym staff for security purposes.
  • I agree to remain on the premises at all times during my child's visit.
  • I understand that, although crèche supervisors are members of DisclosureScotland’s PVG scheme and have experience working with children, not all are registered childcare practitioners.
  • I understand and agree that food and drink is not permitted in the Soft Gym and that breaching this agreement may put other children at risk of allergic reactions, choking and other obstructions.
  • I acknowledge that children should not drift between Soft Gym and Main Gym during their visit as it encourages other children to do the same, and puts them at risk of injury.
  • I understand and agree that children under the age of 8 years cannot leave the Soft Gym/crèche unless (a) they are seated in a pram/buggy beside their parent, or (b) they are seated next to their parent's exercise station, a safe distance from other members or users.
  • I understand and agree that whilst the organisation has made every possible effort to provide the optimum safety for children using its facilities, Smart Gym cannot be held responsible for accidents that occur as a result of playing on the apparatus.
  • I understand and agree that if my child becomes distressed, it is my responsibility to ensure they are re-settled.
  • Smart mirrors: I understand and agree that, whilst the organisation’s Smart devices contain age-appropriate software only, Smart Gym is not responsible for the online content to which children are exposed. I agree to notify the crèche supervisor if/when I wish for censorship of a particular subject, programme, channel, etc.
  • Choking hazards: I understand and agree that whilst the organisation does not make purchases of small parts capable of obstructing the airways of young children, Smart Gym is not liable for toys, parts, foods or any hazard presented by other members, users or their children.
  • I take full responsibly for the comfort and safety of my child during their visit at Smart Gym. 

I have read this section carefully and understand its contents entirely. I fully release and discharge Smart Gym CIC from any liability in connection to this service.

SECTION 2: Parental Agreement & Waiver - Soft Gym (UNSUPERVISED)

  • I consent to my child playing unsupervised in the Soft Gym/creche area and take full responsibility for their comfort and safety during this time.
  • I agree to remain on the premises at all times during my child's visit.
  • I understand and agree that it is my responsible to tidy and/or clean up any mess or disorganisation created by my child after every visit.
  • I will ensure my child is capable of using creche materials and equipment safely before leaving them alone or with other children.
  • I agree to actively monitor/check on my child throughout my visit.
  • I understand and agree that children under the age of 8 years cannot leave the Soft Gym/crèche unless (a) they are seated in a pram/buggy beside their parent, or (b) they are seated next to the parents exercise station, a safe distance from other members or users.
  • I acknowledge that children should not drift between Soft Gym and Main Gym during their visit as it encourages other children to do the same and puts them at risk of injury when passing workout areas with moving equipment.
  • I understand and agree that food and drink is not permitted in the Soft Gym and that breaching this agreement increases the risk of allergies, slips, choking and other obstructions.
  • I understand and agree that whilst the organisation does not make purchases of small parts capable of obstructing the airways of young children, Smart Gym is not liable for toys, parts or other hazards presented by other members, users or their children.
  • I understand and agree that Smart Gym will not be held liable for risks presented by other members or users.
  • I agree to report any suspicious or concerning activity regarding the safety and welfare of any child to either: a member of Smart Gym management team (0333 0509459), Child Protection (0300 3431505), Police Scotland (101) or 999 if a child is at immediate risk.
  • I understand and agree that if my child becomes distressed, it is my responsibility to ensure they are re-settled.
  • Smart mirrors: I understand and agree that, whilst the organisation’s Smart devices contain age-appropriate software only, Smart Gym cannot be held responsible for the online content to which children are exposed.
  • I certify that my child is in good health and capable of engaging in the Soft Gym (unsupervised) at the time of using the service.

SECTION 3: Parental Agreement & Waiver - Main Gym (child's use thereof)

  • I understand and agree that children under the age of 8 years are not permitted to use the main gym, including cardio machines and free weights, at Smart Gym.
  • I understand and agree that children aged 8-15 must only use the main gym under the supervision of their parent or carer.
  • I certify that my child is in good health and capable of engaging in physical activity at the time of using the service.
  • I understand and agree that children under the age of 8 years cannot leave the Soft Gym/crèche unless (a) they are seated in a pram/buggy beside their parent, or (b) they are seated next to the parents exercise station, a safe distance from other members or users.
  • I acknowledge that children should not drift between Soft Gym and Main Gym during their visit as it encourages other children to do the same and puts them at risk of injury when passing workout areas with moving equipment.
  • I understand and agree that children aged 8-15 should avoid using free-weight equipment without professional instruction and supervision.
  • I understand that the equipment and exercises carried out at Smart Gym carry a certain level of risk and I assume full responsibility for my child’s safety while at the facility.
  • I agree to supervise my child at all times while in the gym and ensure that they are following all safety guidelines and procedures.
  • I acknowledge that Smart Gym and its employees are not responsible for any accidents or injuries that may occur during my child use of the gym and equipment.
  • I further agree to indemnify and hold harmless Smart Gym and its employees from any and all claims, damages, or liabilities that may arise from my child's use of the gym facility.
  • I have explained the risks and importance of safety to my child/ward and they understand the rules and regulations of the facility.
  • I understand the risk using exercise equipment and accept full responsibility for any and all risks and any outcome of those risks.
  • I understand and agree that whilst the organisation has made every possible effort to provide the optimum safety for young people using its facilities, Smart Gym cannot be held responsible for accidents that occur as a result of using on the apparatus.
  • I take full responsibly for the safety of my child during their visit at Smart Gym. 

I have read this section carefully and understand its contents entirely. I fully release and discharge Smart Gym CIC from any liability in connection to this service.

By signing below, I hereby waive all claims, losses, and damages whatsoever, in connection with my child's use of all Smart Gym equipment and services and agree to hold harmless and indemnify Smart Gym, its owners, employees, agents, contractors, and representatives from all losses, damages, claims, expenses, or causes of action that may arise from my child's use of Smart Gym services.
