WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Welcome to Perfect Party L.A.! Before you enjoy our fun indoor and outdoor play areas — including inflatables, slides, and bounce houses — please read this agreement carefully. By signing, you understand and agree to all the following terms.

WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Location: 5757 W. Pico Blvd, Los Angeles, CA 90019

I. GENERAL ACKNOWLEDGMENT

In consideration for being permitted to enter, use, and participate in the indoor and/or outdoor recreational areas, inflatables, slides, bounce houses, play structures, equipment, and any related activities, events, or services (collectively, the “Activities”) provided by Perfect Party L.A. LLC, its owners, officers, directors, employees, agents, contractors, insurers, affiliates, successors, and assigns (collectively, “Perfect Party L.A.”), the undersigned participant (“Participant”) hereby voluntarily agrees to all terms of this Waiver and Release of Liability, Assumption of Risk, and Indemnification Agreement (“Agreement”).

This Agreement applies to all Activities conducted on the premises of Perfect Party L.A., both indoor and outdoor, as well as any off-site events or activities organized, sponsored, or operated by Perfect Party L.A.

II. ASSUMPTION OF RISK

The Participant understands and acknowledges that participation in the Activities involves inherent and obvious risks, including, but not limited to:

  • Slipping, tripping, or falling;
  • Collisions with other participants or fixed/moving objects;
  • Equipment malfunction or failure;
  • Overexertion, physical strain, or loss of balance;
  • Exposure to environmental elements such as heat, sun, or uneven surfaces; and
  • Serious personal injury, permanent disability, paralysis, property damage, or even death.

The Participant acknowledges that these risks cannot be eliminated without compromising the essential nature of the Activities. The Participant freely and voluntarily assumes all known and unknown risks, including those arising from the negligence of Perfect Party L.A. or its representatives, except for those resulting from gross negligence, willful misconduct, or intentional acts.

III. RELEASE AND WAIVER OF LIABILITY

The Participant, on behalf of themselves, their heirs, executors, administrators, personal representatives, and assigns, hereby fully and forever waives, releases, discharges, and covenants not to sue Perfect Party L.A., its owners, officers, managers, employees, agents, affiliates, contractors, insurers, successors, and assigns from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses, whether known or unknown, arising out of or in any way related to participation in the Activities, including but not limited to those caused by the ordinary negligence of Perfect Party L.A.

This release includes, without limitation, claims for personal injury, property damage, emotional distress, loss of consortium, wrongful death, and any other type of injury or loss sustained while participating in or being present during the Activities.

IV. INDEMNIFICATION

The Participant agrees to indemnify, defend, and hold harmless Perfect Party L.A. from and against any and all claims, liabilities, damages, costs, expenses, and attorney’s fees incurred as a result of:

  1. Any act or omission of the Participant (or any minor Participant under their supervision); or
  2. Any claim brought by or on behalf of the Participant, or by any third party, arising out of the Participant’s participation in the Activities.

This duty to indemnify includes all costs of defense, settlement, and judgment.

V. MEDICAL AUTHORIZATION AND RESPONSIBILITY

The Participant certifies that they are physically and mentally capable of safely participating in the Activities and have no known medical conditions that would prevent or limit participation. In the event of injury or medical emergency, the Participant authorizes Perfect Party L.A. to obtain or provide emergency medical treatment as deemed necessary, and agrees to be solely responsible for any and all related medical expenses.

VI. GOVERNING LAW AND SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

 If any portion of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

VII. TERM OF AGREEMENT

This Agreement shall remain valid and in full effect for all current and future visits and participation in Activities at Perfect Party L.A., unless and until revoked in writing by the Participant and acknowledged by Perfect Party L.A.

VIII. ACKNOWLEDGMENT OF UNDERSTANDING

By signing below, the Participant acknowledges that they have carefully read this Agreement, fully understand its terms, and are aware that they are giving up substantial legal rights, including the right to sue. The Participant signs this Agreement freely and voluntarily, without any inducement, promise, or guarantee.

 IX. MINOR PARTICIPATION AND PARENTAL/GUARDIAN CONSENT

If the Participant is under 18 years of age, this section must be completed by the parent or legal guardian.

I, the undersigned, am the parent or legal guardian of the minor(s) listed below (“Minor Participant(s)”). I have read and understood the foregoing Waiver and Release of Liability, Assumption of Risk, and Indemnification Agreement, and I agree, on behalf of myself and each Minor Participant, to be bound by its terms.

I acknowledge and agree that my Minor Participant(s) are voluntarily participating in the Activities and that I fully assume all risks of their participation. I further agree to release, waive, and indemnify Perfect Party L.A. to the fullest extent permitted by law, for any claims arising out of such participation.

I certify that I am the parent or legal guardian of the listed Minor Participant(s) and have full authority to execute this Agreement on their behalf.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
