This agreement is between the signer and Walsh Makerspace, Inc. ("Walsh") regarding the Walsh Village Complex makerspace facility ("Makerspace"). Any eligible participant who wishes to use tools or equipment owned by the Makerspace agree to the following:
1.) My voluntary use of any and all equipment including, but not limited to, power tools, saws, drills, lathes, sanders, robotics, lasers, 3d printers, computers, sewing machines, and vinyl cutters, implies that I have a general working knowledge of the machine or tool's operating instructions. I take full responsibility for my actions while using any tool or piece of equipment in the Makerspace, regardless of whether or not I'm being supervised by a Makerspace staff member. 2.) I acknowledge that I MAY BE HELD FINANCIALLY RESPONSIBLE for the replacement cost of any tool I break due to misuse or operator error. This includes, but is not limited to, blades, bits, extruders, laser tubes, print heads, brake cartridges, safety devices, hand tools, chisels, PPE, extension cords, dust collection units, clamps, and all other tools, computers and hardware. 3.) While every attempt has been made to keep the tools in safe operating condition, I acknowledge that any given tool may fail at any time for a variety of different reasons. I HEREBY RELEASE AND FOREVER DISCHARGE FOR MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNEES, WALSH AND ITS AFFILIATES, EMPLOYEES, OWNERS, OFFICERS, DIRECTORS, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION, WHICH MAY RESULT FROM TOOL FAILURE AT THE MAKERSPACE. I HEREBY RELEASE WALSH AND ANY OTHER ORGANIZATIONS ASSOCIATED WITH THE MAKERSPACE FROM ANY LIABILITY ARISING FROM OR IN ANY WAY CONNECTED WITH THE MAKERSPACE. 4.) I understand that all tools, equipment, furniture, fixtures, electronic components and consumable materials are privately owned property and may not be removed from the building at any time for any reason without the express written permission of the Makerspace staff. The unauthorized removal of a tool may be considered theft and will be treated accordingly. 5.) It is my responsibility to clean up my workstation(s) after I complete my work. This includes the proper collection and disposal of any and all sawdust, scrap material, unused material, ash, plastic, filament, laser "crumbs," paint, foam, brushes, pencils, measuring devices, clamps, blades, bits or batteries. I agree to place all items in their proper place. If I'm unsure of where something goes, I agree to ask a Makerspace staff member. 6.) If using the woodshop, I agree to check-out with a Makerspace staff member prior to leaving. 7.) I understand that failure to follow these rules may result in temporary suspension or permanent revocation of my access to the Makerspace, its tools and equipment. 8.) I understand that minors under the age of 18 are not permitted in the woodshop at any time, even if they are accompanied by a parent or legal guardian.
