EQUIPMENT RENTAL AGREEMENT





 RENTAL REQUIREMENTS

*Valid state issued Driver’s License or ID Card

*Valid credit card on file to secure rental and any potential damages

*Each adult age 18 or over must sign Participation, Wavier and Release Form. 

*A parent or guardian of any minor must sign a Participation, Wavier and Release Form on behalf of the minor

MINOR CHILDREN POLICY:

*NO MINOR CHILD UNDER AGE 13 MAY BE ABOARD OR PADDLE A SINGLE SEAT KAYAK

*ONE MINOR CHILD 5 TO 6 YEARS OLD MAY SIT IN FRONT OF ONE ADULT IN SINGLE SEAT PREMIUM KAYAK WITHOUT EXCEEDING SAFE WEIGHT LIMIT

*ONE MINOR CHILD 5 TO 7 YEARS OLD MAY SIT BETWEEN TWO ADULTS IN A TANDEM SEAT KAYAK WITHOUT EXCEEDING SAFE WEIGHT LIMIT

*ONE MINOR CHILD 8 YEARS OR OLDER MAY SIT OR PADDLE IN THE FRONT COCKPIT WITH ONE ADULT IN A TANDEM SEAT KAYAK

*NO glass containers allowed on kayaks or at launch area

*Renter will not drag the kayak over gravel, concrete, asphalt or other abrasive surfaces and is responsible for damage caused by dragging

*Renter is aware of and agrees to abide by ALL Federal and State Regulations concerning boating, paddling and fishing

*Renter will NOT operate the kayak under the influence of alcohol or drugs

*Renter is in good physical health and capable of paddling a kayak

*Renter will notify Toledo Bend Kayak Rental, LLC immediately of any accident, damage or theft involving the kayak

*Renter will keep the kayak at least 50 feet away from moving watercraft, motorboat launch areas, gasoline docks and shall avoid the marked boat lanes at all times

*Renter will not trespass on private property or docks

*Toledo Bend Kayak Rental LLC reserves the right to refuse rental services for any reason.

DAMAGES TO EQUIPMENT/FAILURE TO RETURN EQUIPMENT

I authorize Toledo Bend Kayak Rental, LLC to charge my Credit Card On File for late turn in, lost, stolen, or damaged equipment, and/or abandoned kayak recovery in addition to rental and delivery fees in accordance with the following schedule:

Late Return (30 minutes or more) - $25 per kayak

Lost or Broken Paddle - $65 per paddle

Lost or Damaged Life Vest - $40 per life vest

Lost or Damaged Phone Pouch - $10

Lost or Stolen Kayak - $500 per Standard Kayak; $900 per Premium Kayak; $1200 per Tandem Kayak

Lost or Damaged Kayak Seat - $130

Lost or Damaged Safety Flag - $60

Lost or Damaged Tandem Kayak Dolly - $220

Damaged Kayak: $100 Minimum (damages will be billed in accordance with repair cost as determined by Toledo Bend Kayak Rental, LLC)

Abandoned Kayak Recovery (failure to return to designated location): $125 per kayak.plus any damages

RENTER AGREES AS FOLLOWS:

RENTER WILL NOT EXCEED THE WEIGHT LIMIT OF THE KAYAK, WHICH IS LISTED ON THE VESSEL BEHIND THE SEAT.

RENTER WILL NOT OPERATE THE KAYAK DURING INCLEMENT WEATHER INCLUDING HIGH WINDS, THUNDERSTORMS, ETC.

OVERNIGHT RENTERS WILL NOT OPERATE THE KAYAK(S) BETWEEN DUSK AND DAWN HOURS AND WILL SECURE THE KAYAKS DURING OVERNIGHT HOURS TO PREVENT THEFT.

LIFE VESTS: RENTER AGREES TO WEAR THE PROVIDED US COAST GUARD APPROVED TYPE III LIFE VEST (PFD) AT ALL TIMES WHILE ABOARD THE KAYAK. TEXAS STATE LAW REQUIRES CHILDREN UNDER 13 YEARS OLD TO WEAR A PFD AT ALL TIMES WHEN ABOARD THE KAYAK.

IN CASE OF EMERGENCE PLEASE CALL 911. We cannot come get you!

PICK-UP RENTALS: Renter will safely secure kayak(s) to vehicle or trailer with provided ratchet straps.

We do not rent during inclement weather or when weather alerts are predicted.

Toledo Bend Kayak Rental LLC provides a water-resistant cell phone pouch with lanyard with each kayak that fits most cell phones, however we do not guarantee water-resistant bags or other equipment will keep your items dry. Please use care with cell phones, etc.
