The following waiver of all claims, release of liability, assumption of all risks, agreement, not to hold liable or pursue legal action against the Victoria Therapeutic Riding Association (VTRA) and Ponies & Paint Nights.

In signing any & all parts of this waiver I agree to indemnify, defend, and hold harmless VTRA (Victoria Therapeutic Riding Association), Ponies & Paint Nights, as well as the land owners of these sites from any and all losses, damages, claims, liabilities, and expenses (including legal fees on a solicitor-client basis) arising out of the named participant(s) involvement in the activities or events held. Additionally, this is to hold true for the benefit of, its directors officers, employees, contractors, volunteers, business operators, agents, site, property owners, farm rental sites, and partnerships, of both the VTRA (Victoria Therapeutic Riding Association) and Ponies & Paint plus any/ all of their affiliates. 

This agreement is entered into by me or on behalf of the participant named below.
All are referred to from this point forward as “Host(s)" without limiting the generality of the foregoing, “Activities” include but are not limited to “Equine Activities” provided by the “Host(s)” to the child or adult participant on or off property/ properties. This applies any and all the following locations, the property owners, facilitators, volunteers, employees, at 6545 Gliddon Rd. , 6917 Veyaness rd. (Victoria Therapeutic Riding Association) or to us coming to your location at your request. In signing any & all parts of this waiver I agree to indemnify, defend, and hold harmless VTRA (Victoria Therapeutic Riding Association), Ponies & Paint Nights, as well as the land owners of these sites from any and all losses, damages, claims, liabilities, and expenses (including legal fees on a solicitor-client basis) arising out of the named participant(s) involvement in the activities or events held.

IMPORTANT: If the individual participating in the event or activity is a minor (under 18 years in the province of British-Columbia), this document must be signed by a parent or legal guardian and that acknowledgement of risk and consent to participate is understood and signed. For the remainder of the document the adult or minor will be referred to as "Participant".

1. I am a participant or the parent/guardian of the youth participant, and I am executing this waiver, it is my capacity as the parent/guardian or participant And with the intent that this waiver be binding on myself or the child participant for all legal purposes.

2. I am aware that there are inherent dangers, hazards, and risks (“Risks”), associated with the “Equine Activities” and injuries resulting from these “Risks” are a common occurrence. I am aware that the “Risks” of “Equine Activities” mean those dangerous conditions which are integral part of the “Equine Activities”, including, but not limited to:;

(a.) The propensity of any equine to behave in ways that may result in injury, harm, or death to the person on or around them, and potentially collide with, bite, or kick other animals, people or objects;

(b.) The unpredictability of an equine’s reaction to such things such as sounds, sudden movement, tremors, vibrations, unfamiliar, objects, persons, or other animals and hazards such as subsurface objects.

(c.) The potential for participants to behave in a negligent manner that may contribute to injury to themselves or others, including failing to act within their abilities to maintain their control over an equine. 

3. I really accept and fully assume all responsibility for all “Risks“ and possibilities of any and all personal injury, death, property damage or loss, resulting from the participants participation in “Equine Activities“.

4.I agree that although the “Host“ has taken steps to reduce the “Risks“ and increase the safety of the “equine activities” it is not possible for the “Host“ to make the equine activities completely safe. I accept these “Risks“ and agreed to the terms of this waiver on behalf of the participant, even if the “Host“ is found to be negligent or in breach of any duty of care in any obligation to myself or the participant in the personal or youth participation in “Equine Activities”. 

5. I am aware that there are inherent dangers, hazards, and risks (“Risks”), associated with non- equestrian based activities, that can include but not be limited to: crafts, art, reading, writing, and other learning activities.

I am aware that the “Risks” can be some but not limited to the following: paper cuts, injuries from use of scissors, glue, or other craft materials on skin or clothing, injuries from the use of a glue gun, or use of materials and/or crafting materials, intraocular foreign bodies (IOFB), inhalation of fumes from any product, glue, craft materials, or chemicals.

I acknowledge that I am responsible for myself (and my children or persons under my care) at all times. The potential for participants to behave in a negligent manner may contribute to injury to themselves or others, including failing to act within their abilities to maintain their control around art materials, any chemicals, tools, et. al.

 I further acknowledge that I, nor anyone in my care, are to ingest any materials. Injuries resulting from these “Risks” can occur and I accept these risks.

Additionally, I understand there is risk to my clothing, equipment, gear, etc. around both horses and craft + art supplies and I accept any and all risk associated with these activities. 

6. Assumption of Risk – Outdoor and Farm Environments

I acknowledge and accept that participation in programs conducted outdoors and/or on active farmland involves inherent risks that cannot be eliminated, even with reasonable care and supervision. These risks include, but are not limited to, the following:

(a) Weather and Environmental Conditions

I acknowledge that weather conditions may change rapidly and may alter terrain and environmental conditions, including but not limited to rain, wind, heat, cold, or humidity. Such conditions may result in slippery surfaces, reduced visibility, falling branches, or other hazards. I voluntarily assume all risks associated with participation under these conditions.

Programs may be cancelled in the event of snowfall that impacts road access or in cases of severe weather, in which case rescheduling will be offered.

(b) Terrain and Physical Conditions

I understand that activities take place on farmland and/or in outdoor environments that may include uneven ground, rough or rocky terrain, holes, mud, slopes, roots, and other natural or man-made obstacles. I confirm that I am physically capable of safely navigating such terrain and voluntarily assume all risks associated with these conditions.

(c) Changing and Unpredictable Site Conditions

I acknowledge that outdoor and farm environments are dynamic and may change due to weather events, farming activities, or natural causes (such as windstorms or erosion). Hazards may include fallen branches, debris, altered pathways, or unstable ground. I agree to use caution, avoid clearly unsafe areas, and follow staff guidance at all times.

(d) Farm Infrastructure and Equipment

I understand that farmland may contain fencing, gates, posts, tools, equipment, and other agricultural infrastructure, some of which may be weathered, sharp, or otherwise hazardous due to environmental exposure. While reasonable efforts are made to inspect and maintain these areas, conditions may change between inspections and guest arrival. I voluntarily accept the risks associated with proximity to such features. I further understand that this is a working farm and that certain areas may be under active use, repair, or construction. I agree to avoid all restricted or clearly marked work areas, particularly those involving heavy equipment.

(e) Duty to Report Unsafe Conditions

I agree to promptly notify program staff of any unsafe, damaged, or concerning conditions that I observe, including but not limited to sharp fencing, fallen branches, unstable ground, or other hazards that haven’t been addressed by staff.

(f) Additional Outdoor Risks

I acknowledge that additional risks may include exposure to insects or wildlife, allergic reactions (including to plants or insects), sun exposure, and physical strain or injury resulting from outdoor movement or activity.

In addition to the consideration given to the “Host“ for the participants participation in “Equine Activities”, learning activities, art activities, leisure activities, mindfulness activities, or any other offerings, that I and my heirs, next of kin, executors, administrators and assigns, as well as the participant and his/her/their next of kin, executors, administrators and assignments collectively are “Legal Representatives“) agree:

(a) to waive all claims that the participant has or may have in the future against the “Host“;

(b) to be liable for and to hold harmless and indemnify the “host from all actions, proceedings, claims, damages, costs, demand, including court costs and costs on a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with the participation in “Equine Activities “.

I agree that this waiver and all terms contained here in our governed exclusively and in all respect by the law of the province or territory of Canada in which the “Equine Activities“ are provided by the “Host” I hear by irrevocably submit to the exclusive jurisdiction of the courts of the province or territory of Canada and I agree that no other court can exercise jurisdiction over the terms and claims referred to herein. Any litigation to enforce this waiver, will be instituted in the province or territory of Canada in which the equine activities are provided by the “Host“.

I confirm that I have had sufficient time to read and understand this waiver in its entirety, I understand that this agreement represents the entire agreement between the “Host” , myself as the parent/guardian or for myself as the participant, and it is binding on myself, the participant and our “Legal Representatives“.

I understand that no payment or compensation will be provided. My name will not be used without separate prior consent and specific cases. I acknowledge that there are risks associated with coming to facilities and participating in activities.

Quick Rules: 

  • All waivers must be signed by the participant, parent, or legal guardians. Failure to sign a waiver will mean a denial of entry and no refund.
  • All participants and guardians must follow the rules of the facility, staff, programmers, contractors, and volunteers.
  • Participants wait for the staff to give permission before entering any area with animals.
  • All guests must use a walking pace around the animals and can use calm voices while at the facility.
  • No smoking or vaping will be allowed on property at any time. 
  • No guest to property or facility is to be under the influence of any alcohol or drug at any time.
  • Weather appropriate attire must be worn in order to participate. We suggest that you bring layers.
  • Close toed boots/shoes are always a must with any activity. Long pants are also highly suggested.
  • All guests must treat the humans and animals with respect and kindness. 
  • There are often other animals and horses using the same facility as our programs and we expect our guests and participants to be respectful of them, any boundaries & rules in place and to not intrude on their spaces, stalls, etc.

This agreement and the acknowledgement of risk waiver in any rights, duties, and obligations between the parties to this agreement. This agreement shall be governed by and interpreted solely in accordance with the law of the province of British Columbia and no other jurisdiction. Any litigation involving the parties agreement within the province of British Columbia and shall be made within the exclusive jurisdiction of the court of the province of BC.
