 VISITOR SAFETY RULES & PHOTO RELEASE



To help ensure your safety while in our facility/ies identified below ("Facility"). Bioenergy Devco, LLC or its subsidiaries (the “Owner”) asks that you review and comply with the following rules:

 

SAFETY 

  • Proper Personal Protective Equipment (PPE) are to be worn as directed by your guide. High visibility clothing and hard hats can be provided by your guide. 
  • Proper footwear is required; open-toed shoes are strictly prohibited. 
  • Do not touch any machinery, chemicals, or controls. 

 

EMERGENCIES, INCLUDING MEDICAL 

  • If you observe an emergency, please tell your guide immediately. 
  • If you hear a plant alarm or siren, follow directions from your guide. 

 

GUIDELINES 

  • Owner reserves the right to eject any person for violating these rules. 
  • These rules are subject to change at any time, at Owner’s discretion. 

 

SECURITY 

  • Register in/out at the front desk upon each visit.  
  • Visits are only permitted during normal business hours.  
  • Visitors must be accompanied by a facility representative at all times. 

 

SMOKING / ALCOHOL / DRUGS / FIREARMS 

  • Entering the facility while under the influence of alcohol and/or drugs is prohibited. 
  • Firearms, drugs, and alcohol are not permitted. 
  • Smoking, food, and beverages are permitted in designated areas only. 

 

FACILITY TOURS 

  • Visitors must stay with their tour and follow the tour route. Access is not permitted to areas indicating a hazard or restricted access or areas that are cordoned off. 
  • Observe all posted signs. 
  • No hunting or fishing; do not approach pond or drainage ditch areas where applicable. 
  • No pets, children, or horseplay allowed onsite. 
  • Photography or video/audio recording of any type is prohibited onsite without prior permission. 
  • No personal vehicles are allowed beyond the front entrance parking lot. 
  • All vehicle drivers must obey traffic signs and marked patterns including railroad and pedestrian crossings.  
  • Owner is not responsible for any personal items left unattended or lost during a tour

PHOTO RELEASE 

I hereby grant the Owner, the irrevocable right and permission to photograph and/or record me in connection with a facility tour, and to use any photographs and/or recordings for promotional purposes. I waive any right to inspect or approve the use of any photographs and/or recordings and acknowledge and agree that the rights granted to this release are without compensation of any kind. 

 

I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS OWNER AND EACH OF ITS CURRENT AND FORMER AFFILIATES , ALONG WITH SUCH PARTIES' RESPECTIVE OFFICERS, DIRECTORS, PARTNERS, SHAREHOLDERS, MANAGERS, MEMBERS, INVESTORS, AGENTS, EMPLOYEES, SUCCESSORS AND ASSIGNS, (COLLECTIVELY, THE “RELEASEES”), FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES I INCURR WHICH ARE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS, AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I OR ANYONE ON MY BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I shall INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.
