Please read and agree to the following Waivers and Terms & Conditions before you complete your course registration.


1. Medically Fit Statement & Medical Fitness Declaration

By signing this document, I confirm that:

  • I have read and understood the physical demands and inherent risks associated with training at Optimum Academy. 
  • I am medically and physically fit to participate in all training activities, including working and rescue at height.
  • I confirm that no medical or physical conditions will prevent or affect my ability to complete the training safely. 
  • I will follow all instructions given by my instructor(s) throughout the course. 
  • I understand that if there is any doubt about my fitness, the training provider may pause my participation and request clearance from a licensed medical professional. 
  • I acknowledge that my employer may require a physician’s release for participation if a medical condition poses a risk to myself or others. 
  • I agree to immediately inform Optimum Academy of any change in my medical or physical condition prior to or during training. 
  • If requested by Optimum Academy, I will provide a physician’s clearance prior to participation. Failure to provide such clearance when requested will result in disqualification without refund.

Medical Fitness Requirements

  • Activities at height are physically demanding. By participating, I confirm I am in good physical health. 
  • I understand that weight requirements are strictly enforced: 
  • Minimum: 130 lbs. 
  • Maximum: 310 lbs. – including all personal protective equipment (PPE) such as harnesses, lanyards, helmets, and related fall protection gear.

Medical Conditions That May Contraindicate Participation

I understand that certain conditions present increased risk and may render participation inadvisable. These include, but are not limited to: 

  • Drug or alcohol dependence 
  • Allergies (e.g., insect stings) 
  • Angina or heart issues 
  • Respiratory conditions such as asthma 
  • High/low blood pressure 
  • Epilepsy, seizures, blackouts 
  • Diabetes 
  • Vertigo or balance disorders 
  • Musculoskeletal issues (e.g., arthritis, recent surgery) 
  • Psychological issues (e.g., fear of heights, claustrophobia) 

If I have any of the above, I agree to disclose them confidentially to an Optimum instructor prior to beginning training. I understand that failure to do so may result in suspension or cancellation of training.

Indemnification Clause
I agree to indemnify, defend, and hold harmless Optimum Academy, its employees, agents, and affiliates from any claims, damages, or losses arising from my failure to disclose medical or physical conditions or from my participation in training activities.


2. Assumption of Risk, Waiver & Release of Liability

I acknowledge that:

  • Training at Optimum Academy involves high-risk activities, including practical exercises at height, which carry the risk of serious injury, death, and property damage. 
  • I understand and voluntarily accept these risks and agree to participate entirely at my own risk. 
  • I waive and release Optimum Rope Access Solutions, Inc. (Optimum Academy, Optimum RAS, "Optimum") and all its employees, agents, and affiliates from any liability related to injury, illness, or death incurred during or after training. 
  • I agree to act responsibly and respectfully toward others throughout the course. Disruptive or unsafe behavior may result in immediate removal from the course with no refund. 
  • I will notify an Optimum instructor immediately if I perceive any hazardous situation affecting myself or others.

Severability Clause

  • If any provision of this waiver is found to be unenforceable, the remainder shall remain in full force and effect.

Jurisdiction and Venue Clause

  • Any disputes arising from this agreement shall be governed by the laws of the State of Texas and brought exclusively in the courts of Randall County, Texas.


3.  Training Participation Requirements

I confirm that:

  • I am within the required weight range (130–310 lbs. with all gear) and can safely complete all course objectives. 
  • I understand that any concealment of medical issues or use of non-compliant equipment may result in disqualification from training. 
  • I understand that all personal protective equipment I bring must include an inspection and certification history. 
  • I understand that Optimum Academy is not responsible for any injury or damage resulting from my use of personal equipment, and I assume all risk associated with its use. 
  • I understand that failure to meet any participation requirement may result in immediate removal from training without refund.


4.  Terms & Conditions

Booking & Payment

  • Training is confirmed only upon receipt of full payment. 
  • Payments are accepted via credit card, check, or wire transfer. 
  • Bulk pricing discounts apply only to invoices paid within 15 days. Discounts are forfeited after 30 days. If payment is not received within 30 days, the company agrees to pay the additional amount required to bring the total invoice to the full, non-discounted price. 
  • Late payments may be subject to interest or additional fees at Optimum Academy’s discretion.

Cancellations & Changes

Cancellation Fees 

  • Within 5 working days: 100% charge 
  • 6–10 working days: 50% charge 
  • 11–20 working days: 25% charge 
  • A $150 fee applies for cancellations after payment is processed. 
  • Roster changes within 5 days of the course will incur a $175 fee per student. 
  • Optimum reserves the right to reject or reschedule any training at its sole discretion. 
  • All cancellation fees are due immediately upon cancellation. Failure to pay cancellation fees may result in legal action to recover the amount owed.

Force Majeure 

  • Optimum Academy reserves the right to cancel or reschedule training for reasons beyond its control, including but not limited to acts of God, natural disasters, or government action. In such cases, participants will be offered a rescheduled date or credit, but no refund will be issued.

Attendance Policy

  • Late arrivals (more than 30 minutes) will not be admitted. 
  • Students must return promptly from all breaks. 
  • 60 minutes of cumulative missed time disqualifies a participant from continuing the course. 
  • Optimum reserves the right to enforce these policies to uphold training standards and safety.

Certification

  • Certificates will be issued within 5 business days of course completion for students who meet performance standards. 
  • GWO certificates will be sent digitally to the email linked to the participant’s WINDA ID. 
  • Optimum certificates will be sent to the designated company contact for distribution.

Additional Requirements and Policies

  • Students are responsible for bringing suitable workwear and footwear (e.g., pants and heeled boots). 
  • Equipment required for specific courses can be provided upon request. 
  • If using personal PPE, students must provide proof of inspection and certification. 
  • As required by the Global Wind Organization (GWO), participants must confirm medical fitness: 
    - At registration via the employer’s declaration or medical certificate.
    - At course start via self-declaration on the registration form.

Electronic Signature Clause

  • By electronically signing this agreement, I agree to be legally bound by its terms and conditions.
