WONDER KIDS PLAYLAND Operated by Medina Playground, LLC WAIVER, RELEASE OF LIABILITY, AND HOLD HARMLESS AGREEMENT PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT
By entering the premises of Wonder Kids Playland, operated by Medina Playground, LLC, a Kentucky limited liability company (the “Company” or “Facility”), and participating in any of its events, programs, open play sessions, birthday parties, or utilizing any toys, equipment, or play structures (collectively, the “Activities”), the undersigned, on behalf of themselves and any minor children listed below (the “Participant(s)”), voluntarily agrees to the terms and conditions outlined below. 1. Assumption of Risk I understand that participation in the Activities at Wonder Kids Playland involves inherent risks including, but not limited to: - Trips, falls, collisions, or contact with equipment or other Participants
- Minor injuries (bruises, sprains), major injuries (broken bones, head injuries), or catastrophic injuries (paralysis, death)
- Allergic reactions, exposure to contagious illnesses, and/or use of shared equipment
I voluntarily assume all risks, whether known or unknown, and agree to accept full responsibility for any injury, damage, or loss incurred as a result of participation. 2. Waiver and Release of Liability To the fullest extent permitted by law, I, for myself, the Participant(s), and our respective heirs and representatives, hereby RELEASE, WAIVE, and FOREVER DISCHARGE Wonder Kids Playland, Medina Playground, LLC, its owners, officers, employees, contractors, volunteers, affiliates, landlords, and insurers (collectively, the “Released Parties”) from any and all claims, liabilities, demands, losses, or damages of any kind arising from or related to participation in the Activities, including but not limited to those arising from the negligence or gross negligence of the Released Parties. 3. Indemnification and Hold Harmless I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from and against any and all claims, actions, causes of action, damages, liabilities, and expenses (including reasonable attorney’s fees) resulting from my or my child(ren)’s participation in the Activities or violation of Facility rules or policies. 4. Supervision I understand that: - Adult supervision is required for all children at all times.
- The Facility is not responsible for any injuries, accidents, or incidents due to a lack of supervision, including but not limited to choking, unsafe behavior, or a child leaving the premises unattended.
- I agree to monitor the Participant(s) and ensure their compliance with all safety guidelines and posted rules.
5. Rules and Policies I acknowledge that I have read and agree to follow all posted rules, policies, and verbal directions provided by staff. I understand that failure to follow such rules may result in removal from the premises without refund. 6. Emergency Medical Care In the event of injury or medical emergency, I authorize Wonder Kids Playland staff to seek emergency care, including but not limited to first aid, CPR, calling EMS, and transportation to a medical facility. I understand that I am solely responsible for any and all medical costs incurred as a result. 7. Media Release I grant permission for Wonder Kids Playland to photograph or video record myself and/or the Participant(s) for promotional use in any media, including online, without compensation. If I do not wish to be photographed or recorded, I understand I must notify the Facility in writing before participating. 8. Damage to Property I agree to be responsible for any damage caused by myself or the Participant(s) to the Facility’s equipment, toys, or property, whether intentional or due to neglect or misuse. 9. Food and Beverage Policy - No food or drink is permitted in the play area.
- Food may only be consumed in designated eating areas.
- Outside food and drink is not allowed unless approved in advance.
- No alcohol, smoking, vaping, open flames, food warmers, glitter, confetti, or smoke bombs are allowed inside the Facility.
10. Party and Reservation Terms - A 50% non-refundable deposit is due at booking.
- Parties may be rescheduled once with a $100 rescheduling fee, provided at least 30 days’ notice is given.
- Maximum occupancy limits apply. All guests (including adults) must have a signed waiver.
- Setup may begin 30 minutes prior to the reserved party time.
- Socks are required for all guests entering play areas.
- Equipment is designed for children ages 0–7 (up to age 10 permitted only for private parties).
11. Arbitration Agreement Any dispute or claim arising from this Agreement or participation in the Activities shall be resolved through binding arbitration in Jefferson County, Kentucky, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding. No party shall be entitled to recover punitive damages. 12. Security Monitoring and Notice I acknowledge and understand that Wonder Kids Playland is under continuous video surveillance for safety and security purposes. This monitoring is in place to protect participants, staff, and property. Clear signage at the entrance of the facility informs all visitors that the premises are being monitored. By entering and participating in any activity at Wonder Kids Playland, I agree to this condition and consent to the presence of security cameras in designated areas. 13. Severability and Continuity If any part of this Agreement is held invalid or unenforceable, the remaining sections shall remain in full force. This Waiver shall remain effective for all future visits unless revoked in writing. I am the parent or legal guardian of the above Participant(s). I Agree I have read and agree to the terms and conditions in this Waiver. I Agree I understand this Waiver applies to all future visits to Wonder Kids Playland. I Agree
WONDER KIDS PLAYLAND – RULES FOR PLAY 1. Equipment is designed for ages 0–7 (up to age 10 during private parties only). 2. Socks only—no bare feet or shoes in the play area. 3. No running, climbing on non-designated structures, pushing, or rough play.
4. One child at a time on the slide. Feet first only. 5. No food or drink in the play area. 6. All children must be supervised by a parent or guardian at all times. 7. Sanitize hands before entering play areas. 8. Change diapers only in designated restroom changing areas. 9. No strollers inside the play area—please park near the entrance. 10.
