Divers Supply Trip Deposit & Cancellation Policy

A deposit is required to secure your reservation on selected trip. See individual trip flyers for deposit amount and due dates.  Full payment is required 30 days in advance of the trip departure date. All cancellations within 30 days of the trip departure are subject to administration fees and cancellation penalties levied by scheduled services. Please note that in rare cases the trip prices and dates may change.

General Liability Release and Express Assumption of Risk 

For Guided Scuba Tours for Certified Divers

I

hereby affirm that I have been advised and thoroughly informed of the inherent hazards of scuba diving activities and participation in a guided tour as a diver. 

Further, I understand that diving with compressed air, oxygen enriched air (Nitrox), and trimix supplied by standard open circuit scuba or with semi-closed circuit or closed circuit rebreathers involves certain inherent risks including decompression sickness, embolism, oxygen toxicity, inert gas narcosis, hypoxia, hypercapnia, marine life injuries or other barotrauma or hyperbaric injuries. Such injuries can occur that require treatment in a recompression chamber or medical facility. I further understand that dive activities can be at remote sites, and isolated by time and distance, from such a recompression chamber or medical facility. I still choose to proceed with such dives in spite of the absence of a recompression chamber in proximity to the dive site.


I understand and agree that neither the instructor/guide Reference Divers Supply Instructors Addendum, nor any of the respective employees, officers, agents or assigns of Outdoor Adventures Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply (hereinafter referred to as "Released Parties") may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs, or assigns that may occur as a result of my participation in this diving activity or as a result of the negligence of any party, including the Released Parties, whether passive or active.


In consideration of being allowed to participate in this activity I hereby personally assume all risks in connection with said trip, for any harm, injury, or damage that may befall me while I am a diving participant including all risks connected therewith, whether foreseen or unforeseen.


I further agree to save, defend, indemnify, and hold harmless said Released Parties from any claim or lawsuit by me, anyone purporting to act on my behalf, my family, estate, heirs or assigns, arising directly or indirectly out of my participation and diving activities including claims arising during this activity even if such claims may be groundless, false or fraudulent.


I also understand that diving activities are physically strenuous and that I will be exerting myself during this diving trip and that if I am injured as a result of heart attack, panic, hyperventilation, oxygen toxicity, inert gas narcosis, drowning, etc. that I expressly assume the risk of said injuries and that I will not hold the above listed individuals or companies responsible for the same, and I agree to defend, indemnify, and hold harmless said Released Parties for any such injuries incurred by me.


I understand that these activities may place me deeper than I am able to safely execute a free ascent (without breathing gas)from. 


I understand that I may be required to furnish some of my own equipment and that I am responsible for its operating condition and maintenance.


I understand that I may be supplied with certain items of scuba equipment and that I am responsible for reviewing its proper function and operating condition prior to using it.


I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian.


I further state that I am already a qualified and certified scuba diver from the following training agencies:______________________, and that I hold training to the level of ________________________. I am aware of the required certification level and/or experience necessary and recommended to enroll in this diving activity and I stipulate that I meet requirements for prior certification or equivalent experience. I have been a certified diver since ______ and have been diving for _____ years for a total of ______ dives to a maximum depth of ____ ft.


I understand that the terms herein are contractual and not a mere recital and that I have signed this document of my own free act. Further that I understand and agree that, in the event that one or more of the provisions of this agreement, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this agreement shall be construed as if such invalid, illegal or unenforceable provision or provisions had never been contained herein.


IT IS THE INTENTION OF

 BY THIS INSTRUMENT TO EXEMPT AND RELEASE

MY INSTRUCTORS DIVEMASTER/GUIDE, Reference Divers Supply Instructors Addendum, THE BUSINESS, Outdoor Adventures Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply), AND ALL OTHER RELATED ENTITIES AND RELEASED PARTIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, OR ARISING OUT OF, DIRECTLY OR INDIRECTLY, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK BY READING IT BEFORE SIGNING IT ON BEHALF OF MYSELF AND MY HEIRS.

Assumption of Risk and Liability Release 

This Liability Release is a release of your right to sue.  This release will be used against you in a court of law, if you sue any party or person listed in this release. 

Please read carefully before signing.  If you have any questions please have them answered to your satisfaction before signing this release.  Your signature indicates that you fully understand this release and it is your intention to exempt and release Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply and all of their officers, managers, staff members, PADI, IANTD, NAUI, SDI, TDI, PDIC, SSI, YMCA, all certification agencies, all dive instructors, dive masters, boats, boat crew, boat owners and all other related persons or entities from all liability or responsibility whatsoever for personal injury, property damage or wrongful death however caused, including but not limited to, the negligence or the gross negligence of the released parties, whether passive or active.

I, the participant hereby affirm that I have been advised and thoroughly informed of the inherent hazards of diving and using compressed gases underwater.  That using compressed air, NITROX, or any mixed gases, predisposes me to certain hyperbaric problems, Squeeze, Vertigo, Arterial Gas, Embolism, Mediastinal and Subcutaneous Emphysema, Pneumothorax, Nitrogen Narcosis, Oxygen Toxicity, Decompression Sickness, Compression Pains, and other hyperbaric problems.  Hypoxia, Hypothermia and Drowning are also a danger when diving.  Hyperbaric injuries require treatment in a recompression chamber.  Diving trips for fun, training and/or certification may be conducted at locations remote from a recompression chamber facility.  It could take a long time to reach a chamber facility, and I still choose to proceed with my diving activities.         

I understand and agree that neither my instructor(s) or Outdoor Adventures Unlimited Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply, PADI, IANTD, NAUI, SDI, TDI, PDIC, SSI, YMCA, all certification agencies, all dive instructors, dive masters, boats, boat crew, boat owner, and all other related persons or entities, any training facility or association or any of their respective employees, officers, owners, agents or assigns, (hereinafter referred to as “Released Parties”) may not be held liable or responsible in any way for any injury, death, or other damage to me or my family, heirs, or assigns that could occur as a result to my participation in diver training, diver activities or any activities with the Released Parties.  

For being allowed to participate in diver training and/or activities, I hereby assume all risk in connection with all aspects of diving activities whether foreseen or unforeseen to include the transportation required to get to the dive sites before, during, and after the diving event.  I further save and hold harmless said “Released Parties” from any claim by me, my family, estate heirs or assigns, arising out of my participation in training or diver activities during, before, or after such activities. 

I also understand that if I am being transported by company owned or privately owned vehicles to any dive site before, during, and after a diving event that I further save and hold harmless all said “Released Parties”. 

I further state that I am of lawful age (over 18 years of age) and legally competent to sign this release or I have acquired written consent of a legal guardian who has signed below.  These terms are contractual and not a mere recital and I have signed this document of my own free will.  It is my intention as the participant and legal guardian to exempt and release all said “Released Parties”.

DIVERS SUPPLY PUBLICITY RELEASE AGREEMENT I hereby grant full permission to Outdoor Adventures Inc., Charlie Marketing Inc., Divers Supply Inc., DBA Divers Supply, and its representatives to use, reproduce, publish, distribute and exhibit my name, picture, portrait, likeness or voice, or any or all of the in or connected to Outdoor Adventures Inc , Charlie Marketing Inc., Divers Supply Inc.. DBA Divers Supply. I acknowledge that the above-named entities own all rights to the images and recordings in any medium, including but not limited to, print media and electronic media (including website, social media, etc.). I hereby waive any right to inspect or approve the use of the image or recording. I further waive all moral rights, I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings, or material. I hereby release, waive, forever discharge, and covenant not to sue the above named entities, its governing board, officers, agents, employees, and any students acting on behalf of these entities from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or in composite form that occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. I hereby acknowledge that this consent, waiver, indemnity, release and covenant not to sue is binding on me, my heirs, executors, administrators and assigns.
