WAIVER AND RELEASE OF LIABILITY

ASSUMPTION OF ALL RISKS AND CONSENT TO USE OF LIKENESS

By signing below, I agree that:

I have voluntarily decided to participate in activities and events at, and use the facilities of, Highland Outdoor Ministries, which is a 501(c)3 Non-Profit Organization and all sponsors and affiliates related to Highland Outdoor Ministries. I understand that I may be required to sign additional waivers for off-site activities and events conducted by Highland Outdoor Ministries.

I am voluntarily participating with the knowledge of the numerous risks and dangers involved, including but not limited to: physical exertion for which I may not be prepared; breakdown of equipment, whether rented or owned; accident or illness; the risk of negligence by myself or others, including Highland Outdoor Ministries; and the potential for serious injury, including permanent paralysis or death.

I will follow all written and verbal rules of safety presented to me by Highland Outdoor Ministries.

The enjoyment and excitement of participating at a skate park; on-site and off-site activities as well as events conducted by Highland Outdoor Ministries is derived in part from the inherent risks associated with an activity that is beyond the generally accepted margins of safety, and that these inherent risks contribute to such enjoyment and excitement and are one of the significant reasons for my participation.

I am responsible for my own welfare and accept any and all risks of unanticipated or anticipated events, illness, injury, emotional or physical trauma or death.

One of the conditions to participating at Highland Outdoor Ministries is my execution of this Waiver; therefore, as lawful consideration for being permitted to participate in on-site and off-site activities as well as events conducted by Highland Outdoor Ministries , I hereby RELEASE AND DISCHARGE Highland Outdoor Ministries, Inc. a 501(c)3 Non-Profit Organization; ITS DIRECTORS, OFFICERS, EMPLOYEES, SPONSORS, ADVERTISERS, AND THE OWNERS AND LESSORS OF PREMISES USED TO CONDUCT ANY RELATED EVENT(S) (“RELEASEES”), FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY PARTICIPATION IN ACTIVITIES OR EVENT(S) AT HIGHLAND OUTDOOR MINISTRIES, INC. A 501(c)3 NON-PROFIT ORGANIZATION.

This release shall be legally binding upon me personally, all members of my family and all minors accompanying me, my heirs, successors, assigns and legal representatives, it being my intention to fully assume all of the risks associated with my use of Highland Outdoor Ministries and to release from any and all liabilities associated with my use of Highland Outdoor Ministries facilities to the maximum extent permitted by law.

Highland Outdoor Ministries, its successors and/or assigns, reserve the right to take photographic, film, audio or digital records of me using Highland Outdoor Ministries facilities or participating in events or activities of Highland Outdoor Ministries, and I further agree that Highland Outdoor Ministries may use any such Media for promotional and/or commercial purposes, as well as approve such use by third parties with whom Highland Outdoor Ministries may engage in joint marketing, without any remuneration to me. I hereby assign Highland Outdoor Ministries all right, title and interest I may have and grant Highland Outdoor Ministries a royalty-free, exclusive, perpetual and irrevocable license to the Highland Outdoor Ministries Media.

I agree that any dispute or claim concerning this Agreement, shall be resolved exclusively by binding arbitration according to the existing rules per the State of Georgia and the Georgia Recreational Use Statute.

Highland Outdoor Ministries facilities includes but is not limited to: the natural terrain of steps, ledges, rails and pathways and ANY imported objects for use of ANY on-site activities or event(s).

In consideration of participating at Highland Outdoor Ministries I HEREBY RELEASE AND FULLY DISCHARGE Highland Outdoor Ministries Inc, their affiliates, subsidiary corporations and limited liability companies, and all of their respective owners, partners, shareholders, members, officers, directors, managers, employees, and from any liability resulting from any personal injury to myself, including death, which is caused by the NEGLIGENT ACT OR OMISSION of ANY Highland Outdoor Ministries, Inc. with respect to:

The condition of the park and surface - including screws or holes or cracks, changes in the park and surface caused by natural elements including sun or rain or snow, variances caused by resurfacing, and the fact that a skatepark is inherently dangerous;

The condition of the skatepark and its facilities, and the walking areas surrounding the skatepark and its facilities, including the fact that these areas may be slippery, uneven and weathered.

The size, fit, and fastening of safety equipment;

The presence of other skaters of varying levels of ability;

Instructions or warnings, whether given or not given;

Falls, both in the skatepark and in the walking areas surrounding the facility;

Collisions with other people;

Collisions with portable and fixed obstacles, benches, ledges, etc.;

Debris from leaves, food, food containers or wrappers, beverages, beverage containers, or dropped items of clothing or other personal effects.

Accessibility to all areas of the skate park and areas surround the facility regardless of skill level.

I Testify by signing below that I AM the Parent and/or Legal Guardian for the above-named participant.

In the event I am signing as a parent or guardian, This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided herein, for myself, my heirs, assigns, and next of kin and any other parent and/or guardian who has placed custody of the above-named minor participant in my care. I further release and agree to indemnify and hold harmless the RELEASEES from any and all liabilities incident to the minor participant’s use of the Highland Outdoor Ministries facilities and/or participation in event(s) or activities on-site or off-site of Highland Outdoor Ministries, to the fullest extent permitted by law.

**Students age 10 and under:

Parent/Guardian MUST sign this waiver and remain on property during the use of any and all facilities.
Helmets REQUIRED while in the skatepark.

**Students age 11 - 17:

Parent/Guardian MUST sign this waiver, with the full and complete understanding that I release any all liability to Highland Outdoor Ministries, Inc. in the event my minor does NOT wear a helmet.

· **WE STRONGLY SUGGEST THAT ALL PARTICIPANTS WEAR ANY AND ALL APPROPRIATE SAFTEY GEAR TO AVOID SERIOUS INJURY**

Anyone over the age of 18 MUST sign ad Adult Waiver

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD AND AGREE TO THE WAIVER, RULES AND OTHER PROVISIONS SET OUT ABOVE.
