If you do not wish for yourself or your minor child to appear in promotional content, notify us in writing at the contact listed below.


4. Payment Information

Payments are processed through secure, PCI-compliant third-party payment processors.

We do not store full credit or debit card numbers.

We do not sell or rent your information.

• Emergency medical personnel

• Law enforcement, if required by law

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Moistyramp LLC d/b/a Moisty Urban Park, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "MUP"), I hereby agree to release, indemnify, and discharge MUP, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

  1. I acknowledge that my participation in skateboarding, inline skating and scooter activities on a ramp entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips and falls, including falls from the coping or deck of the ramp; loss of control due to speed or maneuvers beyond my skill level; collisions with other participants, spectators, the ramp structure, walls, fences, or other fixed or movable objects; slippery surfaces caused by moisture, wind-driven rain, leaks, sand or debris; wear, cracks or irregularities in the riding surface; exposure to heat and humidity that may result in heat exhaustion, hyperthermia (heat-related illnesses) or dehydration; serious injuries, including sprains, strains, scratches, bruises, abrasions, cuts, lacerations, broken bones, fractures, dislocations, dental and facial injuries, musculoskeletal injuries, including injuries to the head, neck, and back, concussions, and injuries to internal organs; equipment failure (boards, skates, scooters, wheels, trucks, bearings, brakes, helmets or protective gear) and/or participant error; the negligence of visitors, participants, or other persons who may be present; my own physical condition and the physical exertion associated with this activity; exposure to transmissible pathogens or diseases; transportation-related accidents while traveling to and from the facility; and accidents or illnesses occurring at times when medical care is not immediately available.

  1. Assumption of risk. I participate voluntarily and I expressly assume all of the risks described above and any other risks, known or unknown, foreseeable or unforeseeable, related to the activity, including those arising from the ordinary negligence of MUP, to the fullest extent permitted by law.
  2. Release of claims. I release, discharge and waive any and all claims against MUP for injury, illness, property damage, loss or death related to the activity or to the use of the facility or its equipment, including claims for ordinary negligence in design, maintenance, supervision, instruction or first aid. This release does not apply to damages caused by fraud (dolo), intentional acts or gross negligence of MUP.
  3. Indemnification. I agree to defend, indemnify and hold harmless MUP from any claim, lawsuit, expense or attorney's fees arising from my conduct, my failure to follow the rules, or damage I cause to other persons or to MUP's property. MUP is not responsible for loss, theft or damage to personal belongings.
  4. Protective equipment and rules. At all times while on a board, skates or scooter, I will wear a certified, buckled helmet, knee pads, elbow pads and wrist guards in good condition and of proper size, and closed-toe shoes (except when on skates). I will follow the posted rules and staff instructions, including: one rider at a time on the ramp, taking turns; no sitting, standing or leaving objects on the ramp or landing area; no riding when the ramp is wet or closed; and no modifying the ramp. MUP may deny me access or remove me without refund if I do not comply.
  5. Physical condition, alcohol and drugs. I certify that I am in adequate physical condition and health for this activity, that I have the basic skills to stop and fall in a controlled way, and that I am not under the influence of alcohol, drugs or medications that affect my judgment, balance or reflexes.
  6. Medical care. I authorize MUP to provide first aid and to call 9-1-1 or arrange transportation to a medical facility if it deems necessary. I understand that staff are not medical professionals, and I assume all costs of medical care, ambulance and hospitalization.
  7. Photo release and video surveillance. I authorize MUP to take and use photos and videos of me at the facility for promotion and social media, without compensation. ☐ I do NOT authorize the use of my image. I acknowledge that the facility has security cameras and that recordings may be used for safety and for the investigation and defense of claims.
  8. Governing law and severability. This agreement is governed by the laws of Puerto Rico, and any dispute shall be heard in the Court of First Instance, San Juan Judicial Region. It shall be interpreted as broadly as the law allows; if any clause is held invalid, the remaining clauses shall remain in full force and effect.
  9. Entire agreement. I have read this entire document, I understand it, and I sign it voluntarily. I understand that I am giving up important legal rights, including the right to sue.

Minors. If I am signing as the parent or legal guardian, in consideration of the following minor(s) being permitted by MUP to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless MUP from any and all claims which are brought by, or on behalf of, the minor(s), and which are in any way connected with such use or participation by the minor(s). I understand that I am responsible for supervising the minor while at the facility.
