WAIVER AND RELEASE OF LIABILITY Seas the Day Lummi Island www.seasthedaylummiisland.com 1. ASSUMPTION OF RISK I acknowledge that participating in outdoor recreational activities such as biking, kayaking, and paddleboarding involves inherent risks, including but not limited to: injury, illness, drowning, accidents with other participants or vehicles, weather-related hazards, wildlife encounters, tides, and unforeseen obstacles. I voluntarily assume full responsibility for all risks associated with renting and using equipment from Seas the Day Lummi Island. 2. RELEASE OF LIABILITY In consideration of being permitted to rent and use equipment from Seas the Day Lummi Island, I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, discharge, and hold harmless: - Seas the Day Lummi Island, - its owners, employees, agents, volunteers, and affiliates, from any and all liability, claims, demands, or causes of action for injury, damage, loss, or death arising from or related to the use of rental equipment or participation in any related activity. 3. EQUIPMENT RESPONSIBILITY I agree to operate all rental equipment in a safe and responsible manner and to comply with all posted rules, safety instructions, and local laws. I accept full financial responsibility for any damage to or loss of equipment while in my possession, excluding normal wear and tear. I agree to return the equipment in the same condition it was received. 4. HELMET AND LIFE JACKET POLICY I understand that: - Helmets are strongly recommended for all bike riders. - Personal Flotation Devices (PFDs) are required for all water activities and are provided with all kayak and paddleboard rentals. Failure to wear a helmet or PFD is done at my own risk, which might result in injury or death. 5. WEATHER, TIDES & WATER CONDITIONS I acknowledge that Lummi Island's weather, tides, and water currents can change rapidly and may pose serious hazards. - I agree to consult Seas the Day Lummi Island staff before entering the water. - I will follow all guidance related to tides, wind, water temperature, and weather alerts. - I understand that paddling or kayaking in unsafe conditions can lead to injury, capsizing, becoming stranded, hypothermia, or even death. I am solely responsible for determining whether I am physically and mentally prepared to proceed based on the current conditions at the time of my activity. 6. PARTICIPANT ELIGIBILITY I affirm that I and any minors under my supervision: - Are physically able to participate in these activities, - Are not under the influence of alcohol or drugs, - Will not allow any unauthorized persons to use the equipment. 7. MINORS If I am signing on behalf of a minor, I certify that I am the parent or legal guardian and that I have full authority to agree to this waiver. I accept full responsibility for the minor's safety and compliance. 9. GOVERNING LAW This agreement shall be governed by and interpreted in accordance with the laws of the State of Washington. ACKNOWLEDGMENT BY SIGNING BELOW, I CONFIRM THAT: - I have read and understood this waiver, - I voluntarily agree to its terms, - I am at least 18 years old, or am the parent/legal guardian of the minor participant(s).
