AGREEMENT FOR WAIVER AND RELEASE OF LIABILITY



JET SKI (PWC) RENTAL AGREEMENT & LIABILITY WAIVER

In consideration of ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES permitting me to rent a watercraft and/or participate as a passenger and/or operator in a rental from ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES , I,

 (please print full name), individually, and for my personal representatives, and heirs, agree as follows: 

I HEREBY UNDERSTAND AND ACKNOWLEDGE THERE ARE INHERENT RISKS, DANGERS AND HAZARDS IN WATER SPORTS ACTIVITIES. These risks include, but are not limited to serious bodily injury, death and/or property damage. I agree I am renting, operating and/or using rental equipment at my own risk. I VOLUNTARILY ASSUME ALL SUCH RISKS OF BODILY INJURY, ILLNESS, DEATH, DAMAGE OR LOSS WITH FULL KNOWLEDGE AND APPRECIATION OF THE RISKS THAT MAY RESULT.

I HEREBY VOLUNTARILY AND KNOWINGLY RELEASE, WAIVE, AND DISCHARGE ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES , its past, present and future officers, directors, stockholders, attorneys, agents, servants, representatives, employees, subsidiaries, affiliates, partners, predecessors and successors in interest, and assigns and all other persons, firms or corporations with whom any of the former have been, are now, or may hereafter be affiliated, from all liability for any such loss, damage, bodily injury or death arising out of or related to said rental, EVEN IF SAID LOSS, DAMAGE, BODILY INJURY OR DEATH RESULTS FROM THE NEGLIGENCE OR FAULT OF ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES .

 

I HEREBY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, now and forever, arising out of or related to said rental, to myself or any third parties, whether foreseen or unforeseen and agree to INDEMNIFY and HOLD HARMLESS ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES from any and all past, present or future claims, demands, obligations, actions, causes of action, wrongful death claims, rights, damages, costs, losses, expenses and compensation of any nature whatsoever, whether based on a tort, contract or other theory of recovery which may accrue or otherwise be acquired on account of or related to the rental, operation or use of equipment provided by ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES , EVEN IF CAUSED BY THE NEGLIGENCE OR FAULT OF ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES OR ANY OTHER PERSON.

 

I HEREBY AGREE I WILL NOT ALLOW ANY NON-DISCLOSED PERSONS TO OPERATE, PARTICIPATE IN OR USE SAID RENTAL EQUIPMENT. I HEREBY ASSUME FULL RESPONSIBILITY for all liability for any loss, damage, bodily injury or death arising out of or related to operation or participation in rental activities by any such NON-DISCLOSED OPERATORS, PASSENGERS AND USERS.

 

I agree I have reviewed the rules and regulations of ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES and further agree I will abide by those rules and regulations while participating in the rental offered by ROWDY RIDES LLC D/B/A ROWDY’S WILD RIDES . If a first time renter and/or operator of rental, I certify I have received an instructional orientation related to the operation of the equipment, rules of the waterway systems and other regulations specific to personal watercrafts.

 

I agree that the release and discharge set forth above is a general release. I expressly state I have read this Waiver and Release of Liability, fully understand its terms, understand I have given up substantial rights by signing it, and have signed it freely and voluntarily without any inducement, assurance or guarantee being made to me and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. I have had sufficient time and opportunity to discuss and ask questions regarding this release.

This Agreement is entered into between Rowdy Rides LLC d/b/a Rowdy’s Wild Rides and the undersigned renter.

RENTAL TERMS

Renter agrees to pay all rental fees, charges, and applicable costs. All equipment must be returned in the same condition as received, excluding normal wear and tear.

ELIGIBILITY

Renter must be 21+ years old. Operators must be 18+. A valid driver’s license is required. Maximum 2 riders per unit and 375 lbs combined weight.

PROHIBITED USE

Renter agrees not to operate under the influence of alcohol or drugs, operate recklessly, leave designated riding areas, allow unauthorized operators, tow objects or persons, or operate at night or in unsafe conditions.

DAMAGE RESPONSIBILITY

I accept full financial responsibility for the rented equipment during my rental period. I authorize Rowdy Rides LLC to charge my payment method for any damage, loss, recovery, or related costs beyond normal wear and tear.

ASSUMPTION OF RISK

I understand that operating a personal watercraft (jet ski) involves inherent and significant risks, including but not limited to collision with other vessels or objects, loss of control, falling or being thrown from the watercraft, changing water conditions, weather hazards, and injury resulting from jet propulsion.

I voluntarily and knowingly assume all risks associated with participation, including the risk of serious injury, death, or property damage.

RELEASE OF LIABILITY

To the fullest extent permitted by the laws of the State of Tennessee, I hereby release, waive, and hold harmless Rowdy Rides LLC d/b/a Rowdy’s Wild Rides, including its owners, officers, employees, agents, and affiliates, from any and all claims, demands, damages, or causes of action arising out of or related to my use or operation of the rented equipment.

This release includes, but is not limited to, claims arising from negligence, except in cases of gross negligence or willful misconduct.

INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Rowdy Rides LLC from and against any and all claims, damages, liabilities, costs, and expenses (including attorney’s fees) arising from:

  • My use or misuse of the equipment
  • My violation of any laws or safety rules
  • Any injury or damage caused to third parties

COMPETENCY

I certify that I am physically and mentally capable of safely operating a jet ski. I confirm that I understand all instructions provided and agree to comply with all safety requirements.

I acknowledge that staff may deny or terminate my rental at any time if I am deemed unsafe.

SAFETY RULES

I agree to:

  • Follow all safety instructions and applicable boating laws
  • Remain within designated riding areas at all times
  • Operate only during daylight hours and safe weather conditions
  • Never operate under the influence of alcohol or drugs
  • Avoid reckless, negligent, or unsafe behavior

THIRD-PARTY LIABILITY

Renter is responsible for any damage or injury caused to others.

PERSONAL PROPERTY

Company is not responsible for lost or damaged personal items.

PHOTO RELEASE

Renter grants permission for photos and video use for marketing purposes.

DISPUTE RESOLUTION

All disputes shall be resolved by binding arbitration in Tennessee. Renter waives the right to jury trial and class action participation.

GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Tennessee. Any legal proceedings shall be brought in Davidson County, Tennessee.

I understand that minors must be accompanied by a legal guardian. I accept full responsibility for any minor participants associated with my rental.

I understand I am waiving my right to sue Rowdy Rides LLC, Rowdy’s Wild Rides, and their owners, employees, and affiliates. 


I understand the risks associated with jet ski operation, including serious injury or death. 


I confirm that I am NOT under the influence of alcohol or drugs and am capable of safe operation. 

By signing, I acknowledge that I have read, understand, and agree to all terms of this waiver. I understand that I am giving up substantial legal rights, including the right to sue, and I sign this agreement freely and voluntarily.

General Operation
I understand that the PWC I am renting is a high-performance boat, not a toy, and assuch I will carefully observe and follow the instructions and safety rules I receive from my rental operator.
I will ensure I have enough gas for my return back to the rental livery. I understand a good rule of thumb regarding fuel use is one-third out, one-third back in, and one-third in reserve.
Safety Equipment
I will pay close attention to the required safety equipment instructions provided by my rental livery operator so that I am able to use it in the case of an emergency.
Life Jackets/Protective Wear
I will ensure my passengers and I each have a U.S. Coast Guard approved life jacket that is the proper size for the intended wearer, is in good and serviceable condition (including straps and zippers) and is properly stowed.
I understand that the U.S. Coast Guard recommends that I always wear a life jacket while underway on a boat and that many states require life jacket wear while operating a PWC. It is my responsibility to check with my livery operator or local Marine Patrol agency regarding state requirements.
I understand that it is highly recommended to wear protective clothing such as a wetsuit or wetsuit bottom while operating the PWC due to the risk of internal injuries if water is forced into body cavities as a result of falling into the water or being near the jet thrust nozzle.
Starting/Stopping the PWC
Before starting the engine, I will securely attach the engine shut-off cord/ lanyard to my wrist or life jacket and wear it at all times, keeping it free from the handlebars so that if I fall off of the PWC, the engine will stop.
I understand that in order to turn off the engine, I need to push the stop button. I understand that the throttle controls the speed of my PWC. I understand that I should apply the throttle lever on the handle to accelerate and release it to slow down.
Braking/Stopping
I understand that stopping the engine will not stop the forward motion of the PWC, and that on most PWC’s, steering control is lost when the throttle is released or when the engine is turned off.
Riding at Night
I will not ride at night, as I understand that my PWC does not come equipped with navigation lights and most states do not allow PWC operation at night.
Safe Operation
When operating my PWC, I will maintain a proper lookout and scan constantly with sight and hearing, being alert for conditions that limit my visibility or block my vision of others..
I will always operate my PWC at safe speeds, taking into consideration the conditions around me, including other boats, weather, and visibility.
I will refrain from weaving through vessels that are underway, stopped, moored or at anchor while exceeding a reasonable speed. I will not operate my PWC at an excessive speed in a slow speed area or in a swimming area with swimmers present.
Negligent Operation
I will avoid making sharp turns and other maneuvers that make it difficult for others to avoid colliding with me or to understand where I am going.
I will not jump wakes or waves, nor will Isteer toward an object or person and then turn sharply in close proximity to that object or person in order to spray or attempt to spray them with the wash or jetspray of the watercraft, asthisis unsafe operation.
Towing
I will not tow with my PWC
I have been notified by my rental livery operator about state/local requirements related to towing.
Children and PWC’s
I have been notified by my rental livery operator what the minimum age requirement is for children to operate a PWC, and I understand that just because a child can reach the throttle of a PWC doesn’t mean that they should.
Jet Drive Intake
I understand that the jet drive intake has tremendous suction and will pull loose items, such as long hair, sand, stones, fishing line, loose clothing, or life jacket straps through the jet drive. I will keep these objects away from the intake grate.
I will not apply the throttle when anyone is standing or swimming anywhere near the PWC.
Capsizing
If I capsize in open water, I understand I should swim to the rear ofthe PWC and turn it upright. I am aware that a most PWC’s have a decal at the bottom or rear of the vessel that indicates the direction to roll your PWC to return it to an upright position.

Do you understand the following General PWC Safety Items?
1. Dangers of water being forced into body cavities from the jet thrust nozzle – wetsuit or wetsuit bottoms recommended
2. Never apply throttle if any participants are in the water near the PWC
3. Dangers of loose items (i.e. clothing, hair, stones, etc.) being sucked into the jet drive intake
4. A life jacket must always be worn with kill switch lanyard attached
5. Horseplay is never allowed – no spraying or splashing others; no wake or wave jumping
6. Stopping the engine will not stop forward motion
7. Steering control is lost when the throttle is released, or when the engine is shut off
8. How to respond to a capsized PWC
I agree and understand
1. I have received sufficient instruction and training, including, but not limited to, the pertinent areas listed above. I am prepared to safely operate the rented PWC .
2. All participants must complete and sign all rental forms; there are to be no additional participants after the checkout procedure is completed.
3. Operation of the boat is not allowed by anyone that is under the influence of any legal or illegal drugs or alcohol.
4. No PWC operations from dusk to dawn.
5. In addition to the terms noted above, I have been given an opportunity to ask any additional questions regarding the operation of the rented PWC.
6. I have been provided emergency contact information.
