I agree that King's shall not be held liable for any damages to or loss of property, bodily injury, accident or loss of life while I am using craft or equipment that I have rented from King’s Sport & Tackle. I will inspect the craft/equipment issued to me and will only accept that in good condition. I am comfortable in the water and an adequate swimmer.I will wear foot protection to protect my feet from broken glass and/or other sharp objects that may be on the shore. I will wear my life vest, firmly fastened, when using the rental craft. I am taking a risk when paddling on the water and will operate in as safe a manner as possible.I realize that I may capsize my craft. If this happens, I will keep upstream of my craft. I will keep my feet up to avoid getting my foot stuck between large rocks and prevent being pinned between a rock and the craft. There are hazards in the water that pose risk to the paddler. If I see such danger, I will paddle close to the shallow shore and bypass it in the safest manner, which may be getting out on shore and walking my craft around. I hereby agree that I will not make a claim against King's Sport & Tackle or sue for bodily injury, emotional trauma, death and/or property damage resulting from negligence or other acts, however caused, as a result of renting the equipment. Upon payment of the rental, this agreement shall be deemed to have been entered into at Guerneville, California and shall be construed according to the laws of the State of California. In the unlikely event a legal dispute should arise, I agree the dispute shall exclusively be brought before the appropriate court in Sonoma County, California. I will return the craft / equipment clean and in the condition in which it was rented to me, or pay for replacement or repair. I will not paddle the rental craft on class 2+ (Int. River Classification) waters or above. DO NOT PADDLE BELOW THE ODDFELLOWS BRIDGE! If I paddle below the Oddfellows Bridge, I may not be able to paddle back up to the Schoolhouse Campground Beach. If I can't paddle back upstream, it is still my responsibility to return the paddleboard and will make my own arrangements to do so. I will return the rented equipment before dark. I will not be on the river in the dark. I will notify King's once the equipment has been locked up and returned. LOCK Code for the SUP is 2156. |
