PowerPed Waiver PowerPed ELECTRIC BICYCLE & SCOOTER AGREEMENT AND RELEASE FROM LIABILITY
I, (Customer) Agrees to rent an electric bicycle from PowerPed.
1. Voluntary Participation:
I hereby request to ride a PowerPed Electric Bike from PowerPed, LLC. From henceforth, PowerPed, LLC will be referred to by its DBA PowerPed. 2. Assumption of Risk: I am aware that the activity will carry with it inherent risks that cannot be eliminated regardless of the level of care and precaution taken. Such risks will require my extra care and attention to detect and avoid. The risks of said activity will include but are not limited to bruising, scrapes, scratches, sprains, broken bones and other injuries of possibly greater severity such as paralysis or death. I hereby accept and assume all such risks, and do so for any minors under my care, as indicated by my signature below. I also agree to be legally responsible should any accident occur during my operation of the electric bike or scooter. This responsibility includes damage to other property or injury to another party whether willful or of my own negligence. I am aware that from the moment I sign this waiver to the moment I checkout I am in possession and responsible for the electric bike or scooter. If the electric bike or scooter is stolen while in my possession, I am liable to pay up to the full retail price as shown on www.PowerPed.com. The payment amount, for the stolen or missing bike, is up to the complete discretion of the owner(s) of PowerPed but no greater than the full retail price of the bike. 3. Conduct of Rider I agree to ride the bicycle or scooter in compliance with all traffic laws in the state of Florida, and will exercise care to insure the safe operation of the bicycle or scooter. I agree not to perform stunts, or to attempt any "trick" riding during my use of the bike or scooter. I also agree to not allow any other party to ride the bike or scooter without the prior written permission of the owner(s) of PowerPed. I agree to wear a helmet anytime I am on a PowerPed electric bike or scooter. I agree to not ride the bike or scooter on the beach or sand. I understand that if I were to ride in the sand or mud that I will pay a cleaning fee of up to $200.00. The cleanliness of the electric bike will be determined at the point of rental drop off by a PowerPed employee and is completely subject to their discretion. I agree that an employee/representative of PowerPed has provided me with a helmet to use at all times and a bike lock with combination. I have been made aware of when and where to return the electric bike back to the possession of PowerPed at the end of the agreed upon rental time. I agree to return the electric bike in the condition in which it was rented to me. I agree to keep my method of payment on file with PowerPed in case I need to be charged the $200 cleaning fee and/or lost lock/helmut fee of $50 or $800 for excessive damage/stolen bike. (Excessive damage is defined as any breaks or cracks to the bike frame or wheels, any damage to the motor and all its pieces that causes it to no longer turn on or accelerate, severing or breaks to the wiring to the controls, controller/throttle breaks or stops functioning) 4. Release In consideration for being permitted by PowerPed to rent and ride a PowerPed electric bike or scooter, I hereby release PowerPed from all actions, claims or demands which I may now or hereafter have, and I agree that I, my assignees, heirs, personal representatives and other agents will not make a claim against, or sue, or attach the property of PowerPed on account of injury or other damage resulting during the ride or from the negligence or other acts (including gross negligence and intentional acts), however caused, of their employees, contractors, or other agents. I hereby confirm that I have been given the opportunity to carefully read this agreement and release, and have done so and understand it, or I have voluntarily elected not to read it. I am aware this is a release of liability and, hereby sign it by my own free will. Today's Date: October 4, 2023
