WAIVER AND RELEASE OF LIABILITY 


In consideration of my use of the facilities operated by James Mae Enterprises LLC, d/b/a Axe Republic (“Axe Republic”), I understand and acknowledge the inherent risks of recreational axe-throwing. Accordingly, I acknowledge that my use of or presence at the facilities at Axe Republic carries an additional level of risk not only to me, but to those with whom I interact. By executing this Waiver and Release of Liability (“Release”) I expressly accept and assume all risks in the use of the facilities, including injury, death, or other harms, that arise from or are related in any way to my use of Axe Republic’s facilities. 

I acknowledge that recreational axe-throwing involves a test of a person's physical abilities and carries with it the potential for death, serious injury, and property damage. The risks include, but are not limited to, those caused by condition of participants, equipment, and actions of other people including, but not limited to, participants or employees of Axe Republic. I represent to Axe Republic that I am physically, emotionally, and mentally able to participate in all permitted activities at Axe Republic. I acknowledge that I will comply with all applicable rules, policies, and warnings, including but not limited to verbal instructions, (the “Rules, Policies, and Warnings”) and that I must strictly follow all such Rules, Policies, and Warnings for my own personal safety, and for the safety of others. I agree that I will follow and abide by all Rules, Policies and Warnings required by Axe Republic in order to use Axe Republic’s facilities. If I fail to do so, I acknowledge that Axe Republic has the immediate right to have me removed from its premises. 

I understand and acknowledge that I have responsibilities, including responsibility for my own safety and the safety of others while participating in any activity at Axe Republic’s facilities or by my presence at Axe Republic. I choose to be present or participate at Axe Republic’s facilities completely voluntarily in spite of such risks. I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness while at Axe Republic. 

I understand that while at Axe Republic, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Axe Republic or its assignees. 

I release, discharge, waive, and relinquish all claims, liabilities, causes of actions, injuries, demands, damages, against Axe Republic, its members, employees, agents, and representatives (cumulatively the “Released Parties”), resulting from my use of or presence at Axe Republic’s facilities. Further, I agree to indemnify the Released Parties for all costs, attorneys’ fees, and damages should a third party make a claim against Axe Republic that I caused injury or damages as a result of my use of or presence at Axe Republic’s facilities. I acknowledge that the risks of death, serious injuries, and property damage during recreational axe-throwing are clear and unambiguous to me, and that even if a specific injury or damage is not listed in this Release, I agree not to hold the Released Parties liable for negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorneys’ fees and costs to enforce this Release, I agree to reimburse them fully for such attorneys’ fees and costs, including the costs of any testifying expert witness. This Release shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. 

I have read this Release and fully understand its terms. I understand that I have given up substantial legal rights by signing this Release and have signed it without any inducement or assurance of any nature. I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. 


PARENT OR GUARDIAN OF MINOR CHILD (if applicable) 

I represent that I have complete and absolute authority to bind, contract for and legally act on behalf of the minor child listed above. I agree to all of the terms and conditions of this Waiver and Release of Liability for any claim I have for any personal injury, death or property damage to my minor child.
