GENERAL RELEASE AND ASSUMPTION OF RISK (“RELEASE”)

2026 Season

1. Acknowledgment of Inherent Risks

Notwithstanding any explicit or implied status as a social invitee, as a member of, or guest at, the Greenwood Club, Inc. ("Greenwood"), located at 261 Mossman Road, Sudbury, MA 01776, I understand and specifically acknowledge that there are risks inherent with social activities occurring at Greenwood, including, but not limited to: swimming; use of the propane gas grills; tennis courts (including during out-of-season play, when reduced supervision and staff may be present); pickleball courts; basketball court; clubhouse; ping pong tables; bathrooms; showers; the parking lot and driveway; and other facilities and equipment contained and commonly found within Greenwood. This Release is not limited to the aforementioned categories, but also includes injuries that may potentially arise from any occurrence within the context of the Greenwood property, including, but again not limited to: noxious insects, animals, wildlife; wet surfaces; natural disasters; fire; acts of God; consumption of food and alcohol; swimming or pool access when no lifeguard is on duty or when no second person is present; and activities undertaken in violation of or notwithstanding Greenwood’s House Rules.

2. House Rules Acknowledgment

I acknowledge that I have received or have had the opportunity to review Greenwood’s House Rules, including, without limitation: (a) the rule prohibiting any person from entering the pool unless another person is present; (b) requirements for adult supervision of minor children; (c) guest policies under which members are responsible for the conduct of their guests; and (d) all other rules governing use of Greenwood’s facilities during both in-season and out-of-season periods. I understand that the risks described in this Release apply whether or not those rules are followed, and I expressly assume all risks of injury arising from my own noncompliance, and the noncompliance of any person for whom I am responsible under this Release (including members of my household and any guests I bring to Greenwood), with any House Rule.

3. Assumption of Risk; Release and Indemnification

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself and, if I am signing as a member, the members of my household, including, but not limited to, any type of: personal injury; disability; death; illness; damage; loss; claim; liability; or expense of any kind, that I or my household members may experience or incur in connection with our attendance at Greenwood or participation in any Greenwood programming ("Claims"). On my behalf, and (if I am signing as a member) on behalf of all members of my household, I hereby release, covenant not to sue, discharge, indemnify, and hold harmless Greenwood, its employees, agents, representatives, officers, directors, committee chairs and members, and any member of Greenwood acting in an organizational or volunteer capacity (collectively, "Released Parties"), of and from the Claims, including all liabilities, other claims (known or unknown), actions, damages, costs, or expenses of any kind arising out of or relating thereto.

4. Minor Guests; Parental or Guardian Execution

No person under the age of 18 (a "Minor Guest") may access any Greenwood facility unless a parent or legal guardian of that Minor Guest has individually executed this Release on the Minor Guest's behalf prior to such access. By executing this Release on behalf of a Minor Guest, the signing parent or legal guardian: (a) represents and warrants that he or she is the parent or legal guardian of the Minor Guest and has full authority to execute this Release on the Minor Guest's behalf; (b) assumes, on behalf of the Minor Guest, all of the risks described in Section 1 of this Release; (c) releases, covenants not to sue, discharges, indemnifies, and holds harmless the Released Parties (as defined in Section 3) from and against any and all Claims (as defined in Section 3) arising out of or related to the Minor Guest's access to or use of Greenwood's facilities or participation in any Greenwood programming; and (d) acknowledges that this Release is executed as a condition of the Minor Guest's voluntary participation in recreational activities at Greenwood, a non-essential activity, and that this Release is valid and enforceable under Massachusetts law. The member who brings a Minor Guest to Greenwood accepts responsibility for ensuring that the applicable parent or legal guardian has executed this Release on behalf of the Minor Guest prior to the Minor Guest accessing Greenwood property.

5. Adult Guests; Responsibility for Guests

Every adult guest (a person 18 years of age or older who is not a permanent member of a member's household) must individually execute this Release before accessing any Greenwood facility. If I am signing as a member, I accept responsibility for ensuring that any adult guest I bring to Greenwood has executed this Release prior to accessing Greenwood property, and I acknowledge that my guest's failure to do so does not affect the validity or scope of my own obligations under this Release. If I am signing as a guest, I confirm that I am executing this Release on my own behalf, that my host member's execution of any release does not bind me or relieve me of my own obligations, and that I am not relying on any release executed by my host.

6. Rental Members

If I hold a rental membership approved by the Board of Governors pursuant to Greenwood’s Membership Rental Policy, I acknowledge that this Release applies to me in full and in the same manner as it applies to a fee-owning member. My rental membership status does not affect the scope, validity, or enforceability of this Release.

7. Photographic and Media Consent

I hereby grant the Greenwood permission to use my likeness in any photograph, video, or other digital media ("photo") in any and all of its publications, including web-based publications, without payment or other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed, and I waive the right to inspect or approve the finished product in which my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

8. Electronic Signature Consent

I, the undersigned, hereby voluntarily and without reservation acknowledge that my electronic acceptance and signature on this form is my own free act and deed and shall constitute a valid acceptance of all terms and conditions contained herein as if it were an original signature with fresh ink on a hardcopy.
