Happy Play Sickness Policy

  1. For the health and safety of all the children, visitors and staff we ask that only "well" children and adults enter our facility. If you or your child has a fever, a sore throat, runny nose, is coughing or sneezing or exhibiting any other typical "cold" like symptoms, please keep your child at home. 
  2. If you visit our facility and we notice visible signs of illness, we reserve the right to ask you to return a different day. 


Happy Play Rules & Policies

  1. Shoes are not permitted in the play area at Happy Play and must be removed and stored in the entrance/lobby. All adults and children must wear socks at all times. Socks are available for purchase.                                      
  2. Parents & guardians are responsible for their children and must remain on-site and with their children at all times. Happy Play employees are not responsible for children during open play sessions, private events or birthday parties. 
  3. No outside food or drinks are permitted at Happy Play, however we do permit the use of water bottles and baby bottles for infants/children/adults. These must be consumed in the designated cafe seating area. Only closed water bottles are permitted in the play area. 
  4. Climbing onto the train table or putting toys down the enclosed slide is not permitted.
  5. Happy Play is not responsible for any lost, broken or stolen items. We have the right to donate items that have been left unclaimed for over 30 days.
  6. For the health and safety of all the children, visitors and staff, if anyone has visible signs of illness (coughing, runny nose, fever etc.) will be asked to return when they are no longer symptomatic.
  7. Happy Play reserves the right to update pricing & polices without notice.


Assumption of Risk, Wavier, Release from Liability

I desire and choose to use the facilities of Happy Play (HAPPY PLAY LLC, dba Happy Play) located at 30860 NW Pacific Street Suite A, North Plains, OR 97133 

I understand and acknowledge that inherent risks and hazards may be present by participating in all activities and overall use of Happy Play LLC, dba Happy Play, located at 30860 NW Pacific Street Suite A, North Plains Oregon, 97133

Such risks, for example, but without limitation, may include: illness, risk of loss, property damage, collisions with other visitors/customers, slipping, tripping, falling, bodily injury or harm, permanent disability, paralysis and death. I assume full responsibility for all risks that may arise from using the facilities or participating in activities at Happy Play.

On the behalf of the participant(s) under my care, that enter the Happy Play space, as well as their executors, heirs, and successors do hereby acknowledge, understand and agree to the following:

  1. Responsible for Minor Participant – I hereby certify that I am the parent, caretaker, legal guardian or responsible party of the participant who enters the premises with me and I have authority to waive rights on behalf of the minor participant. I understand that the employees of Happy Play LLC, dba Happy Play, are not responsible for the participants who utilize the space and it is the responsibility of the undersigned individual to supervise any minors they bring into the facility at Happy Play LLC, dba Happy Play.                                         
  2. Health Statement – Both myself and the minor children with me, utilizing Happy Play have no illness, or condition that will affect the health or safety of other guests.                                                                         
  3. Acknowledgement of Policies & Procedures – I acknowledge that I have read, know and agree to all the policies relating to the use of Happy Play. I agree to comply with all rules and regulations of Happy Play, and that Happy Play and its employees have the right to terminate my use of the Happy Play facilities, if I violate said rules and regulations.                                                                                                                     
  4. Security Camera Usage – I understand that security cameras installed around and within Happy Play are for the safety of all participants and may be referenced if needed.                                                                                                                                    
  5. Insurance/Liability for Injury – Happy Play is not liable for any injury, while at Happy Play facilities. I also understand that I am solely responsible for any medical, health, or personal injury costs related to my or my minor child/(ren)’s use of Happy Play.                                                                           
  6. Photo Release – I approve the use of any pictures that may be taken at Happy Play in which myself and/or the minor(s)/child(ren) in my care are a part of, to be used on any Happy Play social media, website, print media or marketing advertisements.                                                                           
  7. Payment for Damages – I agree to pay for any and all damages to any property or equipment as a result of my or my minor child(ren)’s willful actions, neglect, or recklessness and agree to be held liable for all such costs associated with such damages.                                                                  
  8. Arbitration – All parties to this agreement agree to mediate, in good faith, any dispute prior to arbitration or litigation based on the laws of the state of Oregon.                                                                              
  9. Release, Indemnify, and Defend – I hereby release, waive, discharge, and hold harmless Happy Play LLC, dba Happy Play and all employees, past or present, from any claims, suits, liabilities, judgments, costs, and expenses for any property damage, loss or theft, personal injury or illness, death, or other loss arising from the use of Happy Play.    
  10. Idea appropriation- By entering Happy Play, you agree not to enter with the intent to steal ideas, concepts, layout and are restricted from measuring equipment for the purpose of replicating or using such information for personal or third-party gain. Any attempt to do so will result in immediate expulsion from Happy Play premises without a refund or the ability to return to our facility permanently. Happy Play reserves the right to take legal action against any individual or entity found in violation to this.              
  11. COVID-19 Acknowledgment - I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that myself and the minor child/ren, in my care, may be exposed to, or infected by COVID-19 while visiting Happy Play. Happy Play is not liable for any exposure to the COVID-19 virus while visiting Happy Play.

I hereby certify that I have read and understand this entire agreement and agree to and accept the terms and conditions of this agreement. I do so freely and voluntarily on behalf of myself and any minor child/children for which I am the parent, legal guardian or otherwise responsible, named below.
