PARTICIPANT RELEASE, WAIVER, AND ASSUMPTION OF RISK

PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE PLANET K TEXAS, ITS AFFILIATES, AND THE EVENT VENUE.

1. Age Verification and Legal Compliance

I certify that I am either:

(a) eighteen (18) years of age or older and legally authorized to sign this Agreement; or

(b) under eighteen (18) years of age and this Agreement is being executed by my parent or legal guardian.

I further acknowledge that no person under twenty-one (21) years of age may possess, purchase, consume, or be provided alcohol, cannabis, hemp-derived intoxicating products, or other age-restricted substances at the Event.

2. Acknowledgment of Risk

I understand that participation in activities on the property 3109 E. Cesar Chavez Austin TX 78702 may involve inherent risks of injury, illness, property damage, or death.

3. Assumption of Risk

I voluntarily assume all risks, known and unknown, associated with my participation in any activities on the property, whether caused by negligence or otherwise.

4. Release of Liability

To the fullest extent permitted by Texas law, I release, waive, and discharge the property owner (and any agents, employees, or representatives) from any and all liability, claims, demands, or causes of action arising out of or related to my participation in activities on the property, including those arising from negligence.  THIS RELEASE INVOLVES THE RELEASE OF THE PROPERTY OWNER FROM THEIR OWN NEGLIGENCE AND FROM HARM ASSOCIATED WITH PROPERTY CONDITIONS AND DEFECTS. 

5. Indemnification

I agree to indemnify and hold harmless the property owner from any claims, damages, costs, or expenses (including attorney’s fees) resulting from my actions or participation.

6. Medical Treatment

I consent to receive emergency medical treatment if necessary and agree that I am financially responsible for any such treatment.

7. Rules and Compliance

I agree to follow all posted rules and instructions provided by the property owner and understand that failure to do so may result in removal from the property.

8. Governing Law

This agreement shall be governed by and interpreted under the laws of the State of Texas.

9. Severability

If any portion of this agreement is found to be invalid, the remaining provisions shall continue in full force and effect.

10. Acknowledgment

I have read this waiver, fully understand its terms, and sign it voluntarily.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
