RECREATIONAL ACTIVITY RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK, HOLD HARMLESS AND MEDICAL AUTHORIZATION

Please read carefully and be certain you understand the implications of signing this Release and the Express assumption of risk associated with this recreational activity.

ADULT: I, [Adult's Name], wish to voluntarily participate in Revolution Snowsports' activities including ski and snowboard school, skiing, snowboarding, ski and snowboard simulation, ski and snowboard conditioning and other fitness classes, training, other recreation, renting equipment, and using the skis and snowboard, and other facilities, including the ski and snowboard slope simulator, jib bar, jib and/or trampoline board, and any and all related products and services.

MINOR: I am the parent or legal guardian of [Minor's Name]. He/She has my permission and wishes to voluntarily participate in Revolution Snowsports' activities. We accept the risks inherent to His/Her participation.

I AM VOLUNTARILY PARTICIPATING IN THIS RECREATIONAL ACTIVITY. I AM AWARE THAT PARTICIPATING IN THIS ACTIVITY CAN BE HAZARDOUS, AND I AM AWARE OF THE DANGERS INVOLVED, WHICH MAY INCLUDE PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, PROPERTY DAMAGE, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND/OR DEATH, AND I UNDERSTAND THAT THESE OR OTHER INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHER’S ACTIONS, INACTION, OR NEGLIGENCE; CONDITIONS RELATED TO TRAVEL; OR THE CONDITION OF THE ACTIVITY LOCATION(S) AND I HEREBY AGREE TO ACCEPT AND ASSUME FOR MYSELF OR MY CHILD, ANY AND ALL SUCH RISKS, INCLUDING SUCH RISKS UNKNOWN TO ME.

In exchange for the benefits derived by my or my child’s participation in Revolution Snowsports' activities, I hereby agree that I or my child, my or my child’s heirs, distributees, guardians, legal representatives, and assigns do hereby release, indemnify, hold harmless, protect, defend, and not sue: Revolution Snowsports, Inc., Electric Snow, AEG Management LACC, the City of Los Angeles, Todd Alston, and each of their respective affiliates, licensees, lenders, and contractors, as well as each of their respective officers, directors, partners, members, shareholders, employees, agents, representatives, successors and assigns and volunteers (hereinafter referred to as “Hold Harmless Group” or “Released Parties”) for any liability, claims, or actions for injury, death, or damage to personal property, including claims of negligence, except for intentional wrongdoing or gross negligence, arising out of or in conjunction with my or my child’s participation in the activities from whatever cause except for intentional wrongdoing or gross negligence of the Hold Harmless Group.

Should I or my child sustain an injury during my or my child’s participation in this activity which renders me or my child unable to direct my or my child’s own immediate medical care, I hereby consent for me or my child to receive medical treatment, which may be deemed advisable by a Paramedic on the premises. The Hold Harmless Group or their officers, employees, representatives, agents, servants, or volunteers shall not be responsible for the medical care received.

I HAVE CAREFULLY READ THIS AGREEMENT AND I UNDERSTAND THE LEGAL CONSEQUENCES OF SIGNING THIS DOCUMENT, INCLUDING (A) RELEASING SKI DAZZLE LLC AND REVOLUTION SNOWSPORTS INC FROM ALL LIABILITY, (B) PROMISING NOT TO SUE SKI DAZZLE LLC AND REVOLUTION SNOWSPORTS INC, (C) AND ASSUMING ALL RISKS OF PARTICIPATING IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THE ACTIVITY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND SIGN IT OF MY OWN FREE WILL OR AS THE PARENT OR GUARDIAN OF MY CHILD, ON BEHALF OF MY CHILD’S OWN FREE WILL.

I UNDERSTAND THAT THIS DOCUMENT IS WRITTEN TO BE AS BROAD AND INCLUSIVE AS LEGALLY PERMITTED BY THE STATE OF CALIFORNIA. I AGREE THAT IF ANY PORTION IS HELD INVALID OR UNENFORCEABLE, I WILL CONTINUE TO BE BOUND BY THE REMAINING TERMS.
