2026/2027 SKI SEASON TERMS AND CONDITIONS OF USE

Skiing can be enjoyed in many ways. At ski areas you may see people using alpine, snowboard, telemark, cross country and other specialized ski equipment, such as that used by disabled or other skiers. Regardless of how you decide to enjoy the slopes, always show courtesy to others and be aware that there are inherent elements of risk in skiing that common sense and personal awareness can help reduce. All skiers are expected to understand and obey Your Responsibility Code and Montana Law:

KNOW THE CODE. IT’S YOUR RESPONSIBILITY.

●      Always stay in control. You must be able to stop or avoid people or objects.

●      People ahead or downhill of you have the right of way. You must avoid them.

●      Stop only where you are visible from above and do not restrict traffic.

●      Look uphill and avoid others before starting downhill or entering a trail.

●      Read and obey all signs, warnings, and hazard markings.

●      Keep off closed trails and out of closed areas.

DUTIES OF SKIERS-MONTANA STATUTES

Montana statutes, particularly §§23-2-702 and 23-2-736, Montana Code Annotated, define and delineate your duties as a skier at Glacier Nordic Club, Inc. 's groomed ski areas (“GNC Ski Areas”). These statutes also identify the inherent risks of skiing and they control issues of responsibility for events that result from the inherent risks of skiing. While using any GNC Ski Area, you are expected to understand and obey these and all applicable statutes and laws. A copy of §23-2-736, Montana Code Annotated is posted for your review at the trailheads at: the Glacier Nordic Center at the Whitefish Lake Golf Course and Meadow Lake Nordic Trails at the Meadow Lake Golf Course. For activities other than skiing for which you use your Glacier Nordic Club membership pass or day pass (the “Pass”), and with regard to the release and waiver stated below, the Montana Recreation Responsibility Act, Title 27, Chapter 1, Part 7, applies to your activities.

2026-2027 SEASON MEMBERSHIP PASS AGREEMENT

ACKNOWLEDGMENT OF INHERENT DANGERS AND RISKS OF SKIING AND RELEASE OF NEGLIGENCE LIABILITY

I acknowledge that skiing, which includes any activity that involves sliding or jumping on snow or ice, involves inherent dangers and risks that are part of the sport, including: freestyle terrain including but not limited to jumps, obstacle courses and any other constructed feature; paint ball courses, laser biathlon; changing weather conditions; snow conditions as they exist or may change including ice, hard pack, powder, wind pack, crust, slush, cut up snow and dirty snow; collisions with natural surface or subsurface conditions such as bare spots, forest growth, rocks, stumps, streambeds, trees and other natural objects; snow falling from trees; collisions with signs, posts, fences, closures, cart paths, tee boxes or other artificial structures and their components; variations in steepness and terrain; trail grooming equipment, and snowmobiles, whether or not the equipment is moving; collisions with other skiers and/or their equipment; the failure of a skier to ski within that skier’s ability; animals on the trail; skiing outside or off the designated trails and ski area boundary as shown on the ski area trail map.; and restricted visibility caused by snow, wind, fog, sun or darkness. I accept all legal responsibility for injury or damage of any kind to the extent that the injury or damage results from inherent dangers and risks of skiing.

I agree that I have a duty to ski at all times in a manner that avoids injury to me and others and to be aware of the inherent dangers and risks of skiing. The skier using the Pass shall: know the range of the skier’s ability and safely ski within the limits of that ability and the skier’s equipment so as to negotiate any section of terrain or ski slope and trail safely and without injury or damage; know that the skier’s ability may vary because of ski slope and trail changes caused by weather, grooming changes, or skier use; maintain control of speed and course so as to prevent injury to the skier or others; abide by the requirements of the skier responsibility code that is published by the national ski areas association; obey all posted or other warnings and instructions of the ski area operator; read the ski area trail map and be aware of its contents.

I further agree to waive and release any and all claims, actions or causes of action for damages or injuries resulting from Glacier Nordic Club Inc.’s ordinary negligence or for risks inherent in the sport or recreational opportunity.

 I understand that by signing this document I may be waiving my legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages I may suffer due to the provider’s ordinary negligence that are the result of the provider’s failure to exercise reasonable care.

I agree that this Agreement shall be governed by and interpreted solely in accordance with Montana law, and no other jurisdiction. Any litigation involving the parties to this Acknowledgement of Risk and Release of Liability must be brought solely within the Montana State or Federal Courts, which shall have the exclusive jurisdiction over any such cause.

Also, I hereby irrevocably consent to the use, by Glacier Nordic Club, Inc.’s advertisers, customers, successors and assigns, of my picture or likeness for advertising purposes or purposes of trade, and I waive the right to inspect or approve such completed portraits, pictures, or advertising matter used in connection therewith. I hereby waive any right that I may have to monetary compensation, royalties or other consideration and agree that no additional remuneration, financial or otherwise will be transacted.

I hereby authorize Glacier Nordic Ski Team and Glacier Nordic Club, including coaches and chaperones, (collectively “Glacier Nordic Club”) to obtain medical care for or transport me to a medical facility or hospital if, in the opinion of Glacier Nordic Club, medical attention is required, and I am unable to make such decisions for myself. My permission is granted to the attending physician to proceed with any necessary medical treatment and x-ray examinations. I agree to pay all costs associated with such medical care and related transportation and shall defend, indemnify, and hold harmless Glacier Nordic Club of and from the consequences of such decision and from any such costs incurred relating to the provision of medical care. 

If I am less than 18 years of age, my parents or legal guardian has read and agreed to the terms of this Agreement as indicated by their signatures below. The parent or legal representative signing below on behalf of a minor or incompetent person agrees and verifies that he/she has the legal authority to sign as the parent or legal representative of the minor or incompetent person. The parent or legal representative also agrees that (1) Glacier Nordic Club, Inc. or its representatives has permission and authority to treat and address medical conditions and emergencies as they deem appropriate; (2) the signing parent or legal guardian also agrees to pay any charges for such medical treatment and will indemnify Glacier Nordic Club, Inc., or its representative for the same. I have made no misrepresentations regarding my name or age.

GNC Warming Area Access and Use Agreement and Waiver

In consideration for, and as a condition of, being permitted to access and use the Glacier Nordic Club’s (“GNC”) member-only warming area located within or adjacent to GNC’s grooming facility (the “Warming Area”), I agree as follows (the “Agreement"):

1. Restricted Access. Access to the Grooming Facility Warming Area is limited to current, dues-paid members of GNC who have signed this Agreement ("Members"). Access shall be granted solely by means of a seasonal access code issued by GNC. This code is for winter access between December-March. The access code is confidential, and is provided for the exclusive use of the Members to whom it is issued, and may not be shared or disclosed by Members in any way whatsoever. GNC may change the access code at any time in its sole discretion

2. Hours of Operation. The Warming Area shall be accessible from 6:00 a.m. to 9:00 p.m. daily, subject to change in GNC’s sole discretion. Members shall not access or remain in the Warming Area outside of these posted hours, except as otherwise pre-authorized in writing by the Board.

3. No Overnight Use. The Warming Area is intended for temporary, daytime warming purposes associated with nordic skiing or other GNC activities only. Overnight use, sleeping, private events, commercial activities, or lodging in the Warming Area is strictly prohibited at all times.

4. Restricted Areas and Equipment. Members and guests may not operate, move, or tamper with grooming machines, vehicles, tools, fuel, controls, thermostats, electrical panels, mechanical equipment, fire-safety equipment, or GNC property, except for items specifically provided for Member use and used according to posted instructions.

5. Guests. A Member may invite a reasonable number of guests into the Warming Area, provided the Member personally lets the guest in and remains present with the guest for the duration of the visit. Guests under the age of 18 must be accompanied by a parent or legal guardian. Inviting a guest does not authorize the Member to share, disclose, or otherwise provide the access code to that guest or any other individual. Members are responsible for the conduct of any guest they invite and will be held accountable for any violation of these rules committed by their guest, including being liable for any damage caused by a guest.

6. Prohibited Conduct. No food, perishable items, or personal items may be stored in the Warming Area. No open flames, candles, portable grills, unauthorized space heaters, or other flame-producing devices are permitted. No smoking, vaping, use of tobacco or marijuana products, or use of illicit substances is permitted. Disorderly, threatening, or harassing conduct, or unsafe or illegal conduct, is prohibited.

7. Vandalism and Damage. Members and guests must clean up after themselves. No Member shall intentionally deface, damage, tamper with, or otherwise vandalize the Warming Area, its fixtures, equipment, signage, or any property contained therein. Members shall be responsible for the full cost of repair or replacement of any property damaged as a result of their intentional or negligent conduct.

8. Enforcement. Alleged violations of this Agreement will be investigated by GNC’s Board of Directors in accordance with GNC's disciplinary procedures. Members found to have violated this Agreement may be subject to disciplinary action, which may include but not be limited to suspension or termination of membership, or recovery of costs and damages from the responsible Member.

9. Acknowledgment and Assumption of Risks. Use of the Warming Area and surrounding property involves risks, including:

●      Slipping or falling on snow, ice, wet floors, stairs, or uneven surfaces;

●      Extreme cold, severe weather, falling snow or ice, and changing trail or property conditions;

●      Fire, smoke, carbon monoxide, electrical hazards, or malfunctioning heating or mechanical systems;

●      Contact with grooming machines, vehicles, tools, equipment, doors, furniture, or other property; and

●      Crowded conditions and the conduct of other Members or guests.

These risks may result in property damage, illness, serious injury, or death. I knowingly and voluntarily assume all inherent and other risks associated with my access to and use of the Warming Area and surrounding GNC property, except to the extent that applicable law does not permit a risk to be assumed or liability to be waived.

10. Waiver and Release. To the fullest extent permitted by Montana law, I release and agree not to sue GNC and its directors, officers, employees, volunteers, agents, property owners, and representatives (collectively, the “GNC Parties”) for personal injury, death, or property damage arising from:

  1. The risks inherent in the recreational activities and use of the Warming Area described above; or
  2. The tortious conduct of a GNC Party, including a failure to exercise reasonable care.

This release does not apply to any liability that cannot lawfully be released.

11. Responsibility for Claims and Costs. I agree to indemnify and reimburse the GNC Parties for reasonable claims, losses, damages, and expenses, including reasonable attorney fees, arising from:

●      My violation of this Agreement;

●      Damage caused by me or my guests;

●      My unauthorized disclosure of the access code; or

●      The acts or omissions of a guest whom I bring into the Warming Area.

Electronic Signature Consent

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. Your electronic signature on this document/agreement shall have the same effect and shall be as binding as an original wet-ink signature.

You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
