Liability Waiver

PLEASE READ CAREFULLY. THIS LIABILITY WAIVER (“Waiver”) is made effective as of the date set forth below by and between Elevate Wellness Coaching, LLC (“Business”) and the undersigned participant (“Participant”). 

In consideration of being allowed to participate in nutritional coaching, wellness advice, and access to ice baths and saunas provided by the Business, the undersigned acknowledges and agrees to the following terms and conditions: 

  1. Assumption of Risks: Participant understands and acknowledges that participation in the activities offered by the Business, including but not limited to nutritional coaching, wellness advice, and the use of ice baths and saunas, involves inherent risks and hazards. These risks include, but are not limited to, slipping, falling, injury from heat or cold exposure, dehydration, muscle soreness, overexertion, allergic reactions, exacerbation of medical conditions, and the possible transmission of contagious diseases and infections. Participant voluntarily assumes all risks associated with participating in these activities.
  2. Acknowledgement of Non-Medical Professional: Participant understands and acknowledges that the Business and its employees, staff and agents are not licensed medical professionals. The information, advice, and guidance provided by the Business are intended for general informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment. Participant should consult with a qualified healthcare professional before making any changes to their diet, exercise routine, or engaging in any activities offered or recommended by the Business.
  3. Medical Clearance: Participant acknowledges that it is their responsibility to obtain medical clearance from a qualified healthcare professional prior to making any dietary changes or participating in any physical activities, including the use of ice baths and saunas. The Business encourages all Participants, especially those with pre existing medical conditions or those who are pregnant, to seek medical advice before engaging in any activities.
  4. Health and Safety Guidelines: Participant agrees to comply with all health and safety guidelines provided by the Business, including but not limited to using the facilities and equipment properly, following instructions, and immediately reporting any injuries, discomfort, or concerns to the Business staff.
  5. Release and Waiver of Liability: Participant (or Participant’s parent or guardian if Participant is a minor), on behalf of themselves, and their heirs, assigns, agents, executors, personal administrators, personal representatives, relatives, successors and assigns, and next of kin, to the fullest extent permitted by law hereby forever releases, discharges, and agrees to indemnify, defend and hold harmless the Business, its owners, officers, employees, directors, consultants, shareholders, members, officers, directors, agents, representatives, related entities, affiliates, and successors from any and all liability, claims, damages of any sort, charges, expenses, attorneys’ fees, costs, demands, actions, or causes of action of any kind or nature arising out of or related to any loss, damage, injury, or death while participating in any of the activities offered by the Business, whether caused by the negligence of the Business or otherwise.
  6. Consent for Treatment: Participant (or Participant’s parent or guardian if Participant is a minor) authorizes the Business, its owners, employees, agents, or representatives to administer or seek medical treatment or emergency care for Participant in the event of an injury, accident, illness, or medical emergency that may arise during participation in the activities provided by the Business. Participant understands that the Participant will be responsible for any emergency care and medical expenses incurred as a result of such treatment.
  7. Scope and Severability. The Participant or the undersigned parent or legal guardian of the Participant, as applicable, understands that this Waiver, and the waivers and releases contained herein, are intended to be as broad and inclusive as permitted by the laws of North Carolina and that if any portion of this Waiver is held invalid or unenforceable for any reason, that the remainder of this Waiver shall, notwithstanding such invalid or unenforceable portion, continue in full legal force and effect.
  8. Minor Participant: If the Participant is under the age of 18, a parent or legal guardian must sign this Liability Waiver on their behalf and accept full responsibility for the Participant r's actions and well-being during participation in the activities provided by the Business. The undersigned parent or legal guardian of the Participant gives full consent and approval for the Participant, named below, to participate in activities offered or recommended by the Business, including use of all facilities and equipment. The undersigned parent or legal guardian, on behalf of the Participant named below, willingly and knowingly waives, releases, discharges and agrees not to sue the Business, its owners, officers, employees, directors, consultants, shareholders, members, officers, directors, agents, representatives, related entities, affiliates, and successors from all claims, causes of action, damages, costs, including, but not limited to, attorneys’ fees and costs, and other expenses, which they or -- 1 the Participant may have for bodily injury, sickness, mental or emotional injury, hospital or medical bills, death, or any other type of injury or damage arising out of or in any way connected with participation in activities offered or recommended by the Business and use of the Business facilities and equipment, to the fullest extent permitted by law. The undersigned parent or legal guardian, on behalf of the Participant named below, willingly and knowingly also agrees to fully indemnify and hold harmless the Business, its owners, officers, employees, directors, consultants, shareholders, members, officers, directors, agents, representatives, related entities, affiliates, and successors for all claims, causes of action, damages, costs, including, but not limited to, attorneys’ fees and costs, and other expenses, which may arise from any cause of action made by them or by, through or on behalf of the Participant, even if the damages, injuries, or death are caused in whole or in part by the negligence of the Business arising out of the Participant’s participation and utilization of the Business facilities, activities, and recommended actions or wellness practices. The undersigned parent or legal guardian of the Participant also acknowledges that this Agreement shall continue to be in full force and effect for so long as the Participant participates in Business activities and utilizes the Business facilities. The undersigned parent or legal guardian of the Participant acknowledges they have been advised to consult an attorney before executing this document. The undersigned parent or legal guardian of the Participant agrees to the contents of this Waiver on behalf of the below-named Participant under the age of 18 of which they certify that they are the parent or legal guardian.
  9. Governing Law and Jurisdiction: This Waiver shall be governed by and construed in accordance with the laws of the State of North Carolina. Any legal action or proceeding arising out of or relating to participation in any of the activities offered by the Business shall be filed in the courts situated in Wake County, North Carolina, and the parties consent to the exclusive jurisdiction of such courts. 

I HAVE CAREFULLY READ THIS LIABILITY WAIVER AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY SIGNING THIS WAIVER, I AM WAIVING CERTAIN LEGAL RIGHTS AND ASSUMING THE RISKS INVOLVED WITH PARTICIPATING IN THE ACTIVITIES OFFERED BY THE BUSINESS. I HAVE EXECUTED THIS WAIVER VOLUNTARILY OF MY OWN FREE WILL.
