For the safety and enjoyment of all guests, please read and agree to the following terms before entering our property.

1. Acknowledgment of Risks

  • Visitors acknowledge that Ellia’s Garden is a genuine agricultural operation with inherent risks, including but not limited to uneven ground, interaction with animals, use of farm equipment (e.g., hay ride tractor), water activities, and exposure to natural elements.
  • Visitors understand that participation in activities such as produce picking, animal feeding, hay rides, playground use, and row boating may involve risks of injury.

2. Assumption of Responsibility

  • All visitors enter Ellia’s Garden at their own risk.
  • Adults are responsible for supervising children at all times.
  • Visitors agree to follow all posted safety instructions, staff directions, and orientation briefings.

3. Release of Liability

  • By entering Ellia’s Garden, visitors release Ellia’s Enterprises Pty Ltd (trading as Ellia’s Garden), its owners, employees, and agents from any liability for injury, loss, or damage arising from participation in any farm activities or use of the facilities, except to the extent required by law.
  • This includes injuries resulting from animal interactions, participation in farm activities, use of playgrounds, water activities, and any other risks inherent to a working farm environment.

4. Insurance Disclosure

  • Ellia’s Garden maintains public and products liability insurance (Policy No. 118U218415BPK; QBE Insurance) with coverage up to $20,000,000.
  • This insurance covers incidents as outlined in the policy but does not remove the inherent risks associated with farm visits.

5. Agreement to Safety Protocols

  • Visitors agree to participate in a safety orientation upon arrival and comply with all emergency procedures and signage.
  • Closed footwear is required at all times on the property.
  • Entry to restricted or staff-only areas is prohibited.

6. Water Safety

  • Use of row boats and access to river/dam areas is at visitors’ own risk.
  • Life jackets must be worn by children and non-swimmers when using boats.
  • Children must be supervised by an adult near any water at all times.

7. COVID-19 or Infectious Disease Policy

  • Visitors agree not to attend if experiencing symptoms of illness or under quarantine orders.
  • All guests must comply with any current public health guidelines or requirements.

8. Consent to Photography/Media

  • Visitors consent to the use of photographs or video taken during their visit for promotional purposes, unless they notify staff otherwise.


9. Personal Property

  • Ellia’s Garden is not responsible for loss or damage to personal property brought onto the premises.


10. Agreement and Signature

  • By signing this waiver, visitors confirm they have read, understood, and agree to the terms outlined above.
  • For minors, a parent or legal guardian must sign on their behalf.
