READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

In consideration of being permitted to participate in axe throwing or any related activities (the “Activity”) organized and operated by Big Axe Company LLC, I, the undersigned participant (or parent/guardian, if applicable), agree to the following:

1. ASSUMPTION OF RISK

I acknowledge that axe throwing involves inherent risks, including but not limited to: serious bodily injury, permanent disability, paralysis, property damage, or death. Risks may arise from my own actions, the actions of others, the use or misuse of equipment, uneven or unsafe surfaces, weather, or negligence.

I voluntarily participate, fully aware of these risks, and accept full responsibility for my own safety and any resulting injuries or damages.

2. RELEASE AND WAIVER OF LIABILITY

I hereby release, waive, discharge, and covenant not to sue Big Axe Company LLC, its owners, employees, agents, contractors, representatives, insurers, affiliates, successors, and assigns (“Released Parties”) from any and all liability, claims, demands, losses, or damages arising out of or related to my participation in the Activity — including, but not limited to, those caused by the negligence of the Released Parties.

3. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorney’s fees) arising from my participation or the participation of any minor under my care.

4. RULES AND SAFETY ACKNOWLEDGMENT

I agree to follow all posted rules, verbal instructions, and safety guidelines provided by Big Axe Company LLC staff.

I understand that failure to follow safety instructions may result in removal from the activity without refund.

5. ALCOHOL AND SUBSTANCE USE

I affirm that I am not under the influence of alcohol, drugs, or any substance that may impair my judgment, coordination, or reaction time.

I understand that the consumption of alcohol before or during axe throwing increases the risk of injury, and I assume full responsibility for any resulting harm.

6. PHOTO & VIDEO RELEASE

I grant Big Axe Company LLC permission to photograph or record my participation for promotional, social media, and marketing purposes, without compensation.

If I do not wish to be photographed, I will notify a staff member prior to participating.

7. HEALTH ACKNOWLEDGMENT

I certify that I am physically able to participate safely and have no known medical conditions that would increase my risk of injury. I agree to notify staff immediately of any injury or unsafe condition.

8. SEVERABILITY

If any part of this agreement is found unenforceable, the remaining portions shall remain valid and enforceable to the fullest extent allowed by Texas law.

9. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Texas.

By signing below, I acknowledge that I have read and fully understand this waiver, and I voluntarily agree to its terms.

I have read and understand this waiver and agree to all terms on behalf of the minor participant.
