IMPORTANT NOTICE

THIS IS A LEGALLY BINDING AGREEMENT. BY SIGNING THIS DOCUMENT, YOU MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO FILE A LAWSUIT OR SEEK DAMAGES FOR CERTAIN CLAIMS. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING.

1. ACKNOWLEDGMENT OF INHERENT RISKS

I understand and acknowledge that roller skating, roller sports activities, and participation in activities offered by Skateland 2 You LLC involve inherent and unavoidable risks that may result in property damage, serious injury, illness, disability, paralysis, or death.

These risks may include, but are not limited to:

  • Falls and collisions with other participants
  • Loss of balance or control
  • Equipment malfunction or failure
  • Uneven or slippery skating surfaces
  • Contact with walls, barriers, objects, or spectators
  • Participant negligence
  • Weather-related conditions for outdoor events
  • Physical exertion, fatigue, or dehydration
  • Injuries to the head, neck, back, bones, joints, muscles, or internal organs
  • Risks associated with transportation, setup, and mobile event operations

I voluntarily choose to participate despite these known and unknown risks.

2. ASSUMPTION OF RISK

I knowingly and voluntarily assume all risks, known and unknown, associated with participation in roller skating and related activities provided by Skateland 2 You LLC.

I understand that participation is entirely voluntary and that I may discontinue participation at any time.

3. RELEASE OF LIABILITY

To the fullest extent permitted by Oregon law, I hereby release, waive, discharge, and covenant not to sue:

Skateland 2 You LLC, its owners, members, managers, officers, directors, employees, contractors, volunteers, sponsors, event hosts, property owners, affiliates, agents, successors, and assigns (collectively referred to as the "Released Parties"),

from any and all claims, demands, causes of action, liabilities, losses, damages, costs, expenses, attorney fees, or judgments arising from or related to my participation in activities offered by Skateland 2 You LLC, including claims alleging ordinary negligence by any Released Party.

This release applies to personal injury, property damage, economic loss, illness, disability, death, or any other damages arising out of participation.

Nothing in this agreement is intended to release liability for gross negligence, reckless conduct, or intentional misconduct where prohibited by Oregon law.

4. MEDICAL AUTHORIZATION

In the event of an injury, illness, or emergency, I authorize Skateland 2 You LLC and its representatives to obtain emergency medical treatment on my behalf.

I understand that:

  • Emergency medical services may be summoned if deemed necessary.
  • I am solely responsible for all medical costs incurred.
  • Skateland 2 You LLC is not responsible for medical expenses.

5. PHYSICAL CONDITION

I certify that:

  • I am physically capable of participating in roller skating activities.
  • I have no medical condition that would make participation unsafe.
  • I will immediately stop participating if I experience pain, dizziness, illness, or unsafe conditions.

I accept full responsibility for determining my physical fitness to participate.

6. EQUIPMENT RESPONSIBILITY

I agree to inspect all skates, protective gear, and equipment before use.

I understand that:

  • Properly fitted equipment is essential for safe participation.
  • I am responsible for notifying event staff of any damaged equipment.
  • Skateland 2 You LLC does not guarantee injury prevention through equipment use.

7. RULES AND CONDUCT

I agree to:

  • Follow all posted rules and staff instructions.
  • Skate in a safe and responsible manner.
  • Refrain from reckless, dangerous, or disruptive conduct.
  • Respect other participants, staff, and property.

I understand that failure to follow rules may result in removal from the event without refund.

8. PHOTO, VIDEO, AND MEDIA RELEASE

I grant Skateland 2 You LLC permission to photograph, film, record, or otherwise capture my likeness during participation.

I authorize the use of such photographs, videos, recordings, and images for:

  • Marketing
  • Advertising
  • Social media
  • Website content
  • Promotional materials
  • Business publications

without compensation or further approval.

9. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, expenses, or attorney fees arising from:

  • My actions or omissions;
  • My violation of event rules;
  • Damage caused by me to persons or property;
  • Claims brought on my behalf contrary to this agreement.

10. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Oregon.

Any legal action arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located within the State of Oregon.

12. ACKNOWLEDGMENT OF UNDERSTANDING

I certify that:

  • I have carefully read this entire Agreement.
  • I fully understand its contents.
  • I understand that I am giving up certain legal rights.
  • I sign this Agreement freely and voluntarily.
  • No oral representations or statements have been made to alter this Agreement.
