WAIVER, INDEMNITY AND RELEASE OF LIABILITY


I acknowledge and accept the risks inherent in my use of the Lost Sauna Co, LLC’s sauna, and its associated trailer, equipment and accessories (“Sauna System’). I voluntarily assume the risk of property damage/loss, fire, illness, personal injury, accident and/or death, which may arise from and/or in any way relate to my use of the Sauna System. 


I shall defend, indemnify and hold Lost Sauna Co, LLC and its owners, officers, employees, and/or agents (“Released Parties”) harmless from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including attorneys’ fees, arising out of, connected with, and/or in any way associated with my rental, transportation and use of the Sauna System.  I understand that this clause applies, without limitation, to any claim related to the design and/or manufacture of the Sauna System.  I fully recognize and agree that included in this waiver, indemnity and release of liability clause, but not by way of limitation, is my assumption of any and all risk, liability for injury, disability and/or death of myself and/or any other persons caused by the operation, use, control, handling, and/or transportation of the Sauna System during the rental period.


I shall further indemnify the Released Parties for all loss and damage to the Sauna System during the rental period.  




By signing this waiver, I freely accept and assume responsibility for all such dangers and risks and possibility of personal injury, death, property damage or loss resulting therefrom.


In consideration of utilizing Lost Sauna Co, LLC’s facilities and for other good and valuable consideration, I hereby agree as follows:


  1. TO WAIVE ANY AND ALL CLAIMS for personal injury including death, illness, and/or property damage that I may have against Lost Sauna Co, LLC whom is hereinafter collectively referred to as “the Releasee.”


  1. TO RELEASE THE RELEASEE FROM ANY AND ALL LIABILITY for any loss, damage, injury, death, medical or other expense that I may suffer or that any other party may suffer as a result of my use of Lost Sauna Co, LLC’s property or in my participation in the use of the sauna and other activities, due to any cause whatsoever.


  1. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEE from any and all Liability for any property damage or personal injury to any third party, resulting from my use of Lost Sauna Co, LLC’s property or by my participation in the use of the sauna, and any other activity(ies).


  1. THIS RELEASE OF LIABILITY SHALL BE EFFECTIVE AND BINDING upon my heirs, next of kin, executors, administrators, successors and assigns in the event of my personal injury including death, illness, and/or property damage.


  1. I ADDITIONALLY AGREE not to take unreasonable risks while participating in use of the sauna and other activities, including but not limited to using the sauna while impaired, staying in the sauna past a reasonable time, tampering with the stove in an attempt to make it hotter than it is designed to be.


  1. I ADDITIONALLY AGREE that I shall exercise due care for my personal safety and the safety of others when using Lost Sauna Co, LLC’s property.

  

I CERTIFY THAT I am covered by my own Medical Insurance, and that I have read and understand this Release of Liability prior to signing it, and I am aware that by signing this Release of Liability I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, successors, and assigns may have against the Releasees. I also acknowledge and agree that I have had an opportunity to obtain legal advice before executing this Liability Waiver.







BY SIGNING THIS LIABILITY WAIVER, RELEASE, INDEMNIFICATION, & HOLD HARMLESS AGREEMENT, I CERTIFY THAT I HAVE READ THE ENTIRE AGREEMENT AND FULLY UNDERSTAND IT AND THAT I AM NOT RELYING ON ANY STATEMENTS OR REPRESENTATIONS OF ANY OF THE RELEASED PARTIES.
