GUEST WAIVER AND UNCONDITIONAL AND FULL GENERAL RELEASE


In consideration for being permitted to use the premises of, and participate in activities at, Brown Ranch, I, for myself and/or on behalf of my minor child/children listed below, agree to the following Guest Waiver and Unconditional and Full General Release.

In this agreement, "Brown Ranch" is defined to include all properties and interests that are owned, directly or indirectly, or leased by members of the Brown family or entities owned directly or indirectly by members of the Brown family. This encompasses, but is not limited to, Brown Ranch, LLC, Florida Resources, LLC, B. Alex Brown, II as Trustee of the Indrio Land Trust, Indrio Holdings, LLC, Burnett Land Company, LLC, and properties owned by Edgar A. Brown and Barbara L. Brown, his wife. This definition covers irrespective of the individual or specific entity holding title and includes all locations, assets, and interests that may be utilized or accessed by visitors in accordance with the terms of this waiver."



I understand that Brown Ranch is largely rough, unimproved land and that participating in certain activities, or being on the premises of Brown Ranch where others are participating in such activities, including, but not limited to, driving, walking, riding in or operating a swamp buggy, four- wheeler or other recreational vehicle, horseback riding, fishing, hunting with a bow or firearm from an elevated position, tree stand, or on the ground, shooting out of a vehicle, being in the vicinity of cattle and wildlife that carry Lyme’s disease, Brucellosis and other harmful diseases carried by the local wildlife, operating ranch equipment, and other recreational activities, is inherently dangerous and may expose me to hazards or risks that may result in my illness, personal injury or death, and I understand the nature of those hazards and risks and ASSUME ALL RISKS THAT MAY ARISE, NOT JUST KNOWN RISKS OR RISKS THAT ARE INHERENT TO CERTAIN ACTIVITIES OR THE CONDITION OF THE PREMISES OF BROWN RANCH.


 

 I acknowledge that, if I choose to participate in hunting from a tree stand or elevated position, I have been offered the use of (and have been recommended to utilize) certain equipment, such as, tree harnesses, restraint equipment, belts and other equipment specifically designed to help protect one from falling from elevated tree stands or an elevated position.


 

I, for myself, and for my minor child/children designated below, hereby ASSUME ALL THE RISKS as described above, and hereby RELEASE, WAIVE AND COVENANT NOT TO SUE

Brown Ranch LLC, a Florida limited liability company, or their respective partners, agents, employees, affiliates, principals, successors and assigns (collectively “Brown Ranch”), for any injury (including permanent disability and death) sustained by me or my minor child/children, as a result of our participating in any and all activities at Brown Ranch or the participation of others, WHETHER CAUSED BY THE NEGLIGENCE OF BROWN RANCH OR OTHERWISE.


 

 

I represent that my minor child/children and I are in sufficiently good health to participate in any and all activities at Brown Ranch without jeopardizing our health. Our participation in any and all activities at Brown Ranch is purely voluntary and with full knowledge of all risks that may arise, not just known risks or risks that are inherent to any activities or the condition of Brown Ranch.


 

 

 I further agree for myself and for my minor child/children to INDEMNIFY AND HOLD HARMLESS Brown Ranch from and against any and all claims, actions, causes of action, liabilities, suits and expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with being on the premises of Brown Ranch or the use of Brown Ranch by me or my minor child/children, or others.


 

I HAVE CAREFULLY READ, CLEARLY UNDERSTAND AND VOLUNTARILY INITIAL AND SIGN THIS GUEST WAIVER AND UNCONDITIONAL AND FULL GENERAL RELEASE ON BEHALF OF MYSELF AND FOR MY MINOR CHILD/CHILDREN.


 



NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

 

READ THIS GUEST WAIVER AND UNCONDITIONAL AND FULL GENERAL RELEASE COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY(IES). YOU ARE AGREEING THAT, EVEN IF BROWN RANCH USES REASONABLE CARE IN PROVIDING THIS ACTIVITY(IES), THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY(IES) BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY(IES) WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS GUEST WAIVER AND UNCONDITIONAL AND FULL GENERAL RELEASE YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM BROWN RANCH IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND BROWN RANCH HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
