WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

Including Minors

In consideration of being permitted by Springfield Incredible Pizza Company, LLC d/b/a Springfield Incredible Food and Fun, all attractions at the Springfield location (“Facility”) to participate in or observe any activities or attractions (including Go Karts, Trampoline Park, Laser tag, Lost In Space, Bumper Cars, Tagada Ride, Dodgeball, or other games or activities in restricted and public accessible areas), the undersigned, for themselves, their minor child(ren), heirs, and representatives, agrees as follows:

1. Inspection and Responsibility: I acknowledge that I, and if applicable my minor child, have inspected or will inspect all areas before participating. If I believe any area or activity is unsafe, I will immediately notify Facility staff and refrain from participation.

2. Independent Operation: I understand the Facility is independently owned and operated and that neither Incredible Pizza Franchise Group, LLC, the property owner, nor lessor has any duty to inspect or supervise activities.

3. Release and Waiver: I hereby release, waive, discharge, and covenant not to sue the Facility, Incredible Pizza Franchise Group, LLC, the property owner/lessor, and their affiliates, employees, agents, or representatives (“Releasees”) for any and all claims, losses, or damages, including injury, property damage, or death, arising from participation or presence in restricted areas, whether caused by negligence or otherwise.

4. Assumption of Risk: I understand participation involves inherent and serious risks, including but not limited to slips, falls, collisions, equipment failure, bodily injury, paralysis, or death. I knowingly and voluntarily assume all such risks for myself and my minor child(ren).

5. Medical Responsibility: I acknowledge that I am solely responsible for any medical expenses resulting from injury to myself or my minor child and that injuries may be worsened by negligent rescue operations, for which I release all Releasees.

6. Indemnification: I agree to indemnify and hold harmless the Releasees from any claims, losses, or costs, including attorney’s fees, arising from me or my minor child’s participation, whether caused by negligence or otherwise.

7. Governing Law and Enforceability: This agreement is governed by Missouri law and is intended to be as broad and inclusive as permitted by law. If any portion is held invalid, the remainder shall continue in full force and effect.

8. Minors: If the participant is under 18, this waiver must be completed by the parent or court-appointed legal guardian. By signing below, the Parent or Court-Appointed Legal Guardian (if applicable) acknowledges and agrees that they, and the minor participant, are bound by all terms and conditions of this document as set forth above.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.  Additionally, all parties over the age of 18 must sign a waiver, but up to 10 minors can be included on each waiver.
