Welcome to The Land. We hope that your time here will exceed your expectations. The Land is a retreat facility owned by The Land LLC and operated by The Land Sanctuary Inc., which hosts a variety of events and activities that are produced by various people and entities who license the use of all or part of the property (“Licensees”). Before you get settled, we ask that you carefully read, understand, and sign the below Visitor Waiver. This undertakings, agreements and releases made by signing this will be effective for any visit to the Land up to one year from the date of execution. In consideration of being permitted to visit The Land I hereby acknowledge and agree to the following terms and conditions of visitation (this “Waiver”). I hereby waive any and all liability and any right of action, whether legal, equitable or in any other form, against The Land Sanctuary Inc. and The Land LLC and, employers, managers, employees, staff, volunteers, officers, directors, servants, members, stockholders, principals, general and limited partners, agents, assigns, heirs, attorneys, representatives, and each of their respective predecessors and successors, subsidiaries, affiliates, divisions, sureties, guarantors, insurers, and all other related entities (collectively, the “Released Parties”), as a result of any action or omission connected with the conduct of the Released Parties, conduct of other visitors and my visit to The Land. 1. Assumption of Risk. I understand, acknowledge and agree to each of the following: I am (18) eighteen years of age or older. I voluntarily and knowingly accept and assume each of the risks and other matters set forth in this paragraph. I recognize that there are certain inherent risks associated with my visit to The Land and my participation in events or activities offered by Licensees on The Land, and I assume full responsibility for personal injury to myself and others, and release and discharge the Released Parties for injury, loss or damage arising out of my presence on The Land or my participation in events or activities offered by Licensees on The Land, whether caused by the fault of myself, the Released Parties or other third parties. I understand that the Land is a natural, rural environment and that this comes with a certain level of risk that comes with being a in a natural environment, including but not limited to rugged and potentially slippery terrain; ticks and other insects, snakes and spiders; and fast moving rivers and streams, and agree to accept the risks with being in such an environment. I understand that there are risks associated with using the pool and swimming in the river, and I agree to accept such risks. I agree to observe and obey all posted rules and warnings, and further agree to follow any reasonable oral instructions or directions related to the use of the facilities on the Land given by the Released Parties. In relation to any physical activities offered by Licensees on the Land or by the Released Parties that I choose to participate in, I do so of my own knowing and free will and I ASSUME AND ACCEPT ALL RISKS OF HARM, LOSS, OR INJURY THAT MAY ARISE FROM OR BE RELATED TO MY PARTICIPATION IN THAT ACTIVITY. I understand that the Land has a no drug and alcohol policy. I can neither bring nor use/consume alcohol or drugs on the property without the knowledge and permission of The Land Sanctuary Inc. If I might be having a medical emergency the Release Parties will call an ambulance at their discretion and all associated costs and expenses will be my full responsibility to bear. My agreement with this is evidenced by my initials below. 2. Release of Liability. I hereby forever release and hold harmless the Released Parties from any and all claims, causes of action, demands, obligations, breaches of duty, injuries, liabilities, losses, expenses, costs, attorneys fees, damages, or actions, of every type, kind, nature, description, or character, however defined or denominated, and however claimed or asserted, of any nature, known or unknown, asserted or not asserted, contingent or absolute, matured or unmatured, direct or indirect, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on The Land, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law. I am fully aware of the risks and hazards connected with visiting The Land, and I am aware that this includes the risk of injury and even death, and I hereby elect to voluntarily visit The Land and participate in activities on The Land knowing that the activities may be hazardous to me. I understand that the Released Parties do not require me to visit the Land or participate in any activities on The Land. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law. I execute this Release with the express intention of affecting the legal consequences provided by section 1541 of the California Civil Code, that is, the release of all liability associated with my visit to The Land. I hereby state that I have read and understand the following statutory language of section 1541 of the California Civil Code: A general Release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of execution of the release, which if known to him must have materially affected his settlement with the debtor. Having read the above, I hereby elect to and do assume the risk for claims heretofore or hereafter arising, known or unknown, from this release and from my visit to The Land. 3. Release As Defense. I understand and agree that this Waiver may be pleaded as a full and complete defense to, and the parties hereby consent that it may be used as the basis for an injunction against, any action, suit or other proceeding based on claims released by this Waiver. 4. Arbitration. Should any dispute remain or exist that is not covered by the terms of the Release, I further agree to forfeit the right to seek legal remedy in a court of law and agree to refer such dispute to binding arbitration before the Judicial Arbitration and Mediation Services (“JAMS”) in San Francisco, California in accordance with the laws of the California and the applicable JAMS Arbitration Rules to settle any and all disputes between myself and any of the Released Parties. JAMS shall appoint the Arbitrator(s) in accordance with its rules unless the parties mutually agree to another procedure. Judgment upon the award rendered by the Arbitrator(s) shall be entered in any court having jurisdiction pursuant to applicable law. Any party may seek compliance with these provisions by petition to any court of general jurisdiction. The prevailing party in any such proceeding shall be entitled to the Court’s order for payment of attorney’s fees and costs. 5. Severability and Effect of Partial Invalidity. I understand and agree that the provisions of this Waiver are severable. In the event a court or other adjudicative body of competent jurisdiction should find any provision or the application of any provision to any person, place or circumstance to be wholly or partially invalid or unenforceable under the law of any jurisdiction, such finding shall not affect the validity and enforceability of the remaining provisions. The remaining provisions shall continue in full force and effect. The provision found to be invalid or unenforceable shall continue to be applicable to the extent permitted under the law of the finding jurisdiction and shall continue in full force and effect under the laws of any other jurisdiction. 6. I shall comply with all of the Released Parties' production guidelines, procedures, and protocols (including, without limitation, compliance with and execution of all of Company’s harassment and COVID-19 safety and production guidelines, procedures, and protocols). 6 (a). COVID-19 REQUIRED DISCLOSURES: In addition to the above, I acknowledge and agree that it is of the essence of this Waiver that I IMMEDIATELY notify Released Parties in writing in the event I know or have a good faith reason to believe any of the following has occurred (and to follow all Released Party's, CDC, government, legal, and medical orders, statutes, guidelines, and requirements in connection thereto including, without limitation, mandated self-quarantine and isolation): 6 (a)(i). I have experienced symptoms commonly associated with COVID-19 (or mutations thereto) any time prior to, during, or within fourteen (14) days after my visit; or
6 (a)(ii). I test positive for or am diagnosed with COVID-19 (or a mutation thereof) at any time prior to, during, or within fourteen (14) days after my visit; or
6 (a)(iii). I am apprised of facts or have good faith reason to believe that I have come into contact with someone with a confirmed case of COVID-19 (or mutation thereof) or have symptoms commonly associated with COVID-19. 6 (b). Violation of this Paragraph 6 shall be deemed a material breach of this Waiver. 7. Entire Agreement. I understand and agree that this Waiver constitutes the sole and entire agreement between the parties with respect to the matters covered in it. This Waiver supersedes any prior or contemporaneous agreements, understandings or undertakings, written or oral, by or among the parties regarding such subject matter. I understand and represent that this Waiver is made without reliance on any inducement, statement, promise or representation other than those contained within this Waiver. I also understand and agree that any statements by Released Parties regarding my visit to The Land are statements of opinion and do not constitute a representation, warranty or guarantee. 8. Modification and Waiver: I understand and agree that no term or provision of this Waiver may be varied, changed, modified, waived, discharged or terminated orally, but only by an instrument in writing, signed by the party against whom the enforcement of the variation, change, modification, waiver, discharge or termination is sought. The waiver by any party hereto of any breach of any provision of this Waiver shall not constitute or operate as a waiver of such provision or any other provision hereof, nor shall any failure to enforce any provision hereof operate as a waiver at such time, or at any future time, of such provision or any other provision hereof. 9. Voluntary Execution of Waiver: I acknowledge and agree that I am executing this Waiver voluntarily, knowingly, and without duress or undue influence. I have read this Waiver and understand the terms and consequences of it. I am fully aware of the legal and binding consequences of it.
OM Circle Agreement and Release for Participants Orgasmic Meditation (OM) is a partnered consciousness practice where one partner strokes the other one's clitoris for 15 minutes with no goal other than to feel and be present. OM Circles are events where there is more than one stroker-strokee pair, who have one or more OMs. OM Circles are may be led by trained OM practitioners known as Practice Holders. This Agreement and Release is designed to ensure that OM Circles have a consistent format, and consistent standards of behavior and conduct by participants. As a condition of your participation at any OM Circle you agree to every term in this Agreement and Release in respect of every OM Circle you attend. If you would like to take additional time to consider any of these terms before signing this Agreement and Release and participating, we encourage you to review it at your own pace before making a decision. You may be asked to sign another copy of this agreement and release at a later date. The conditions for participation in OM Circles may change from time to time. CONDITIONS OF PARTICIPATION: I understand and agree I must meet one of the following conditions before I will participate in OM Circles on the Land: A. Completed OM Basics on OM App AND taken an additional one (1) OM training session with an Eros Coaching Collective Certified Coach. OR B. Been OM trained by a Certified OneTaste / OMLife Coach AND taken an additional one (1) OM training session with an Eros Coaching Collective Certified Coach. OR C. Attended a OneTaste What is OM class, Intro to OM class or How to OM class AND taken an additional one (1) OM training session with an Eros Coaching Collective Certified Coach. OR D. Been OM trained by an Eros Coaching Collective Certified Coach over three (3) sessions. OR E. Attended any of the following OneTaste programs: Coaching Program, Intensive, Magic School, Mastery. OR F. Lived in and attended OM Circles at the 1080 or Warehouse residences. Note: In all cases where one additional coaching session with an Eros Coaching Collective certified coach is required, if that coach says that additional sessions are needed before participation in an OM Circle, those additional sessions must be completed. AGREEMENT: I understand and agree to each of the following. I understand that if any of the following are not true or I am not agreement, then I may not participate in the OM Circle: 1. I am over 18 years of age. I will permit OM Circle Holders to verify my age by showing them a form of government-issued photo identification such as a State Driver’s Licence the first time I attend an OM Circle, and at any time when an OM Circle Holder requests that I do so. 2. I will never OM at an OM Circle with any person who I know or have reason to believe is under the age of 18. 3. If I know or have reason to believe someone attempting to OM at an OM Circle is under the age of 18 I will immediately bring this to the attention of an OM Circle Practice Holder or Land Sanctuary Staff. 4. I am familiar with the practice of OM, the steps of an OM, and with the nature of the practice, which involves a strokee, who is undressed from the waist down, and a stroker, who remains fully clothed. The stroker makes contact with the strokees genitals with gloved hands, using the specific technique, steps, format and protocol of Orgasmic Meditation as set out as the Form and Container document. 5. I agree to follow the Form and Container of OM as it is described in the Form and Container Document, a copy of which is available online at https://instituteofom.com/container and at all OM Circle. 6. I understand that consent is the cornerstone of OM. I am participating of my own free will. I agree that I will not place any direct or indirect coercion or duress on any person to OM with me or with any other person. 7. I will always arrange my own OM partner. 8. I will follow the instructions of the Practice Holder during the OM Circle. 9. I will respect that OM Circles are a practice space, and treat my fellow participants with respect. 10. I will cease any conduct at an OM Circle when requested to do so by a Practice Holder. 11. If I feel that my stroker or strokee is not within the OM Form and Container or I am not comfortable with what is happening in the OM, it is my responsibility to make adjustments (requests for changes) to my stroker or strokee. 12. If my stroker or strokee asks me to make an adjustment or to stop while we are OMing, it is my responsibility to do so, even if I do not believe that I am breaking the Form or the Container of the OM. 13. I will not film, photograph or record any part of an OM Circle. 14. I will participate an OM Circle orientation session on the Land. I understand that my agreement to the below release and additional terms below are required as a condition of my participation in OM Circles. Each of the below terms each of which are an essential condition of permitting me to participate in OM Circles. RELEASE OF LIABILITY: I agree to waive any and all liability and any right of action, whether legal, equitable or in any other form, against any Practice Holder at any OM Circle, Land Sanctuary Inc., The Land LLC and each of their respective managers, employees, staff, volunteers, officers, directors (collectively, the Released Parties), as a result of any action or omission connected with the conduct of Released Parties, the conduct of other participants and/or my participation in any OM Circle I may attend, regardless if the nature of such claims be monetary, emotional, mental, psychological or physical. For participants in California - I execute this Release with the express intention of effecting the legal consequences provided by section 1541 of the California Civil Code, that is, the release of all liability associated with the Event. I hereby state that I have read and understand the following statutory language of section 1541 of the California Civil Code: A general Release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of execution of the release, which if known to him must have materially affected his settlement with the debtor. Having read the above, I hereby elect to and do assume the risk for claims heretofore or hereafter arising, known or unknown, from this release and from my participation in OM Circles. RELEASE AS DEFENSE: I understand and agree that this Release and Agreement may be pleaded as a full and complete defense to, and the parties hereby consent that it may be used as the basis for an injunction against, any action, suit or other proceeding based on claims released by this Release. ARBITRATION: Any disputes arising out of or in connection with this Agreement and Release will be interpreted and construed in accordance with the laws of the State of California and the United States of America, without regard to conflict of law principles. Any party may refer any disputes arising out of or in relation to this Agreement and Release to final and binding arbitration by submitting a request for arbitration to JAMS. By entering into this Agreement and Release, I acknowledge and agree that binding arbitration shall be the exclusive method for resolving any disputes that may arise between, and I expressly waive any entitlement I may have to have such controversies decided by a court or a jury. As a part of my stay at The Eros Monastery on The Land I agree to the following: I will not bring any alcohol, marijuana or any illicit drugs on property during my stay at The Eros Monastery at The Land. I will not consume alcohol, marijuana, or any illicit drugs and I will not put myself in the position of detoxing from substance use during my stay at The Eros Monastery at The Land. I understand that The Land is not a facility for detoxing from alcohol or drug use. I have talked to my doctor or mental health professional about my prescription medication and am clear that I am taking them as prescribed and will continue to do so during my stay at The Eros Monastery at The Land. I will not cause harm or damage to myself, another person or the property. I am confident that I can and will make my voice heard and only say yes to things I want to partake in and no to things I do not want to partake in during my stay at The Eros Monastery at The Land. I understand that violating any of the above protocols will result in my being asked to leave The Land, for which I will not be refunded.
I, the undersigned, certify that I have read the above Land, OM Circle & Participant Agreement and agree and accept the terms as stated above.
