Player Registration, Release and Indemnification Agreement, and Photography/Video Release Form


AGREEMENT AND WAIVER / RELEASE OF LIABILITY

I, the undersigned, do hereby agree to consult with a physician before starting SPLASH BOYZ ATHLETICS, LLC program or engaging in any of their Athletics classes.


I acknowledge that I have been advised of the risks involved in engaging in SPLASH BOYZ ATHLETICS, LLC classes and the use of the custom exercise program issued to me by SPLASH BOYZ ATHLETICS, LLC and I further acknowledge that I have been warned that following such a program could result in injury or harm to myself.


I acknowledge and assume such risk to my person should I engage in SPLASH BOYZ ATHLETICS, LLC classes or follow SPLASH BOYZ ATHLETICS, LLC exercise program.


In the event that I should sustain injury to myself as a result of my use of SPLASH BOYZ ATHLETICS, LLC Exercise/training program or while engaged in any of their Athletics classes, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assigns to:

1. Acceptance of Risk. By signing this agreement, I acknowledge the contagious nature of the novel coronavirus ("COVID-19") and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by my use of the exercise equipment and facilities provided by SPLASH BOYZ ATHLETICS, LLC Gym and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, SPLASH BOYZ ATHLETICS, LLC employees, other facility members, and their families.

2. Rules. I agree to comply with the Center of Disease Control (CDC), local health district, and SPLASH BOYZ ATHLETICS, LLC guidelines and policies including, but not limited to, the use of surgical masks or improvised masks such as scarves, bandanas, and handkerchiefs, to reduce the risk of exposure to myself or others; I agree to wash or sanitize my hands after using the restroom, sneezing, and coughing; I will properly wear and utilize sterile gloves; I agree to wipe all equipment that I come in contact with at SPLASH BOYZ ATHLETICS, LLC; I agree to inform SPLASH BOYZ ATHLETICS, LLC if I exhibit symptoms associated with COVID-19 or come in contact with a person diagnosed with or exhibiting symptoms.

3. Liability Release: I agree to waive, discharge, and covenant not to sue SPLASH BOYZ ATHLETICS, LLC, their respective owners, officers, directors, employees, or agents (the "Released Parties") and each of them from any and all claims for sickness, injuries, damages, or loss that I or my family may experience to my use of the exercise equipment and facilities provided by SPLASH BOYZ ATHLETICS, LLC.

4. Indemnification: I agree to indemnify and defend the Released Parties from and against all claims, causes of action, damages, judgement, costs and expenses, including attorneys' fees and other litigation costs which may arise due to my use of the exercise equipment and facilities provided by SPLASH BOYZ ATHLETICS, LLC.

I have read and fully understand the contents of this "hold harmless" agreement and execute same as my own voluntary act.


Therefore, intending to be bound and as a condition of being allowed to participate in the performance/fitness session, I have freely signed this waiver on the date indicated.

PHOTOGRAPHY AND VIDEO RELEASE FORM 

SPLASH BOYZ ATHLETICS, LLC requests your permission to photograph and video record. SPLASH BOYZ ATHLETICS, LLC will use the documentation for marketing for the company. The photographs and videos will be published exclusively on the below sites.

 SPLASH BOYZ ATHLETICS, LLC may also use the photographs for brochures, flyers and all social media created solely for marketing purposes.

Release Agreement/ Individual

I give my consent to SPLASH BOYZ ATHLETICS, LLC to use any photography/video containing my image in SPLASH BOYZ ATHLETICS, LLC promotional materials/media including: SPLASH BOYZ ATHLETICS, LLC website, brochures, flyers, videos, and other electronic media. I waive all claim to compensation for such use.

Release Agreement/ Parent or Guardian

I am the legal guardian of the minor(s) and hereby give my consent to SPLASH BOYZ ATHLETICS, LLC to use any photography/video containing his/her image in SPLASH BOYZ ATHLETICS, LLC promotional materials/media including: SPLASH BOYZ ATHLETICS, LLC website, brochures, flyers, videos, and other electronic media. I waive all claim to compensation for such use.
