PENNSYLVANIA WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK &

COVENANT NOT TO SUE

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of

Pennsylvania. By entering Joy Island Playspace LLC ("Joy Island Playspace" or the "Facility"), located in Pottstown,

Pennsylvania, within Limerick Township, Montgomery County, Pennsylvania, I acknowledge that I have read,

understand, and agree to the following on behalf of myself and my child(ren).

1. ASSUMPTION OF RISK – GENERAL

I understand that participation in activities at Joy Island Playspace LLC, including but not limited to soft play

equipment, climbing, crawling, running, jumping, slides, interactive play structures, imaginative play, ride-on toys,

sandbox activities, and other recreational activities involves inherent risks. These risks include, but are not limited to,

slips, trips, falls, collisions, cuts, scrapes, sprains, strains, bruises, broken bones, and other injuries. I knowingly and

voluntarily assume all known and unknown risks, including risks arising from the ordinary negligence of Joy Island

Playspace LLC, to the fullest extent permitted by Pennsylvania law.

2. ASSUMPTION OF RISK – ILLNESS & INFECTIOUS DISEASE

I acknowledge that a shared indoor play environment carries an inherent risk of exposure to contagious illnesses

including influenza, RSV, COVID-19, stomach viruses, and other communicable diseases. I voluntarily assume these

risks. I agree that neither I nor my child(ren) will enter the Facility if experiencing symptoms of illness such as fever,

cough, vomiting, diarrhea, or other contagious conditions. Joy Island Playspace LLC reserves the right to refuse entry

to or request the departure of anyone who appears ill.

3. ASSUMPTION OF RISK – SANDBOX, SAND PLAY & BABY WIPES

I understand that sand play involves risks including slips, falls, eye irritation, allergic reactions, accidental ingestion of

sand, and contact with shared toys or other participants. Complimentary baby wipes or similar cleaning products may

be provided and may cause skin irritation or allergic reactions. I accept responsibility for determining whether I or my

child(ren) have sensitivities and voluntarily assume all risks associated with sand play and the use of such products.

4. ASSUMPTION OF RISK – COMPLIMENTARY COFFEE

As a courtesy to adult guests, complimentary coffee or other hot beverages may be available. I understand hot

beverages may cause burns, spills, stains, or other injuries. By choosing to handle or consume complimentary coffee,

I do so entirely at my own risk and will keep hot beverages out of the reach of children.

5. RELEASE OF LIABILITY, INDEMNIFICATION & COVENANT NOT TO SUE

To the fullest extent permitted by Pennsylvania law, I release, waive, discharge, indemnify, defend, hold harmless,

and agree not to sue Joy Island Playspace LLC, its owners, members, managers, employees, agents, volunteers,

contractors, equipment manufacturers, landlord, and affiliated entities for any claims arising from participation at the

Facility, including claims based upon ordinary negligence, except where prohibited by law. I further agree to indemnify

and defend Joy Island Playspace LLC against claims brought by or on behalf of my child(ren) or any third party arising

from our participation.

6. PARENT / LEGAL GUARDIAN REPRESENTATIONS

I represent that I am the parent or legal guardian of the participating minor(s), have authority to sign this Agreement,

my child(ren) are physically able to participate, and I will actively supervise them at all times.7. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize Joy Island Playspace LLC to obtain emergency medical treatment for me or

my child(ren). I understand that I am solely responsible for all resulting medical expenses.

8. RULES, SAFETY & REMOVAL

I agree to follow all posted rules and staff instructions. Guests engaging in unsafe, disruptive, or aggressive behavior

may be removed from the Facility without refund.

9. PHOTO & VIDEO RELEASE

I grant Joy Island Playspace LLC permission to photograph and/or record me and my child(ren) while at the Facility

and to use such images or recordings for marketing, advertising, social media, website, and promotional purposes

without compensation.

10. CONTINUOUS & ELECTRONIC WAIVER

I understand this Agreement may be signed electronically, stored by Joy Island Playspace LLC, and remain valid as a

continuous, multi-use waiver for future visits unless revoked by me in writing.

11. SEVERABILITY & VENUE

If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

Venue and jurisdiction for any dispute shall lie exclusively in Montgomery County, Pennsylvania.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT

BY SIGNING I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE, TO THE EXTENT

PERMITTED BY PENNSYLVANIA LAW.
