1. GeneralThese Terms and Conditions form a Rental and Test Ride Agreement (herein "Agreement"), which consists of this Agreement and the Terms and Conditions stated herein. This Agreement is between the bicycle renter as identified in this Agreement (herein "Renter") and PVB, LLC dba E-Bike Alley (“E-Bike Alley”) and covers the rental or test ride of the bicycle equipment ("Bicycle") for the purpose of this Agreement at E-Bike Alley Williamsburg and Norfolk locations. The word "Bicycle" means the two-wheeled electric bicycle provided to Renter by E-Bike Alley and includes the frame, two tires, seat, electric power, battery, lights, miscellaneous equipment, accessories (bike rack, lock) and safety gear (helmet, braking system). Renter acknowledges that certain Bicycles (e.g., Freego X2 Pro) are capable of speeds exceeding 28 mph. Provider does not restrict the Bicycle’s top speed electronically and disclaims liability for any operation above 28 mph. Renter agrees that any operation above 28 mph is at Renter’s sole risk, and Provider will not be liable for injuries, damage, or legal consequences resulting from operation above 28 mph. 2. Authorized Drivers/Prohibition on PassengersNo other person may drive or otherwise operate Bicycle except the Renter. Renter is prohibited from carrying any passengers on the Bicycle at any time unless authorized by E-Bike Alley. Renter may not add any kind of seat or modification to allow someone to ride on the rear fender, and no one may ride on the handlebars at any time. Renter is prohibited from pulling or towing any passenger or object with the Bicycle at any time. Renter must be 16 years old or older. Riders under 18 must be accompanied by a guardian present during the rental or test ride activity. No one other than the Renter is allowed to ride the Bicycle at any time. 3. Bicycle ReturnRenter agrees to return the Bicycle to E-Bike Alley in the same condition as received, except for ordinary wear and tear (which does not include flat tires), on the due date and time and at the location specified by E-Bike Alley at the time of rental or test ride. Renter agrees to return the Bicycle sooner if demanded by E-Bike Alley. Renter understands that there may be rate or special charges if the Bicycle is returned at a different time, date, or location than indicated in this Agreement. Condition Acknowledgment. Prior to departure, Renter and Provider representative will inspect the Bicycle together. Renter acknowledges receipt of the Bicycle in good working order and free of damage, except as noted on the checkout condition form. Renter agrees to initial/sign the checkout condition form prior to operation. 4. Rental/Test Ride ChargesFrom the time identified on the front side of this Agreement until the Bicycle is returned, Renter agrees to pay the minute, hourly, and daily rates as indicated on the front side of this Agreement. Renter agrees to pay all charges for miscellaneous service and all sales, use, rental and excise taxes including any applicable tax-related surcharges. Renter also agrees to pay a reasonable fee for cleaning the Bicycle if the Bicycle is returned with excessive stains, dirt, or soilage attributable to Renter's use. 5. Start of Rental/Test RideThe rental or test ride commences after the E-Bike Alley representative has informed the Renter of the proper and safe operation of the Bicycle and any additional instructions as requested. Renter is aware of all dangers associated with operation of the Bicycle, including riding in traffic, on streets, or other locations, and acknowledges natural and man-made hazards may exist. Renter agrees to assume all risks associated with operating the Bicycle, including the risk of operating above 28 mph. 6. Repossessing the BicycleE-Bike Alley may repossess the Bicycle at any time if: The Bicycle is used in violation of law; appears abandoned; is used in violation of any term or condition in this Agreement; Renter made a misrepresentation to E-Bike Alley; or Renter fails to return the Bicycle when due. E-Bike Alley is not required to notify Renter in advance of repossession. 7. Prohibited Use of the BicycleRenter shall not use the Bicycle: - For hire, racing, stunts, contests, or illegal purposes
- On unpaved roads, through water, or in restricted areas
- In public parks or on bicycle trails if prohibited
- To transport controlled substances or contraband
Violation of this paragraph automatically terminates the rental/test ride and makes Renter liable to E-Bike Alley for any penalties, fines, or related legal expenses. 8. Damage to BicycleRenter shall pay E-Bike Alley for all losses and/or damage to the Bicycle, regardless of fault. Renter is responsible for theft, vandalism, repair costs, diminution in value, administrative fees, towing, storage, and "Loss of Use." If Renter operates the Bicycle above 28 mph, Renter accepts full responsibility for any resulting damage, injury, or legal consequences. 9. AccidentsRenter fully assumes all risks of injury, including death or serious bodily harm. Renter is responsible for third-party claims or damages arising from operation of the Bicycle. Renter agrees to indemnify and defend E-Bike Alley from all claims associated with personal injury, damage, or death. 10. Payment & Credit AuthorizationRenter agrees to pay all applicable charges, including rental/test ride fees, loss/damage, taxes, and surcharges. Renter authorizes E-Bike Alley to charge the payment method on file, including credit card, for any amounts due. Payment, Deposit & Credit Authorization. Renter agrees to pay all applicable charges, including rental/test ride fees, loss/damage, cleaning fees, taxes, fines, and surcharges. Renter authorizes E-Bike Alley to place a credit hold or charge the payment method on file for an estimated deposit equal to the anticipated rental/test ride charges. Renter further authorizes E-Bike Alley to charge Renter’s payment method for any amounts due under this Agreement, including but not limited to damage, loss, loss-of-use, administrative fees, towing, storage, fines, and collection expenses. 11. Property Left in BicycleE-Bike Alley is not responsible for personal property left on the Bicycle. Renter assumes all risk of loss. 12. Collections & FinesAll charges, fees, and expenses are due upon E-Bike Alley’s demand. Late charges, collection costs, and attorney fees apply as described in the original agreement. Renter is responsible for any fines, tickets, or recovery expenses incurred during rental or test ride. Collections & Late Charges. All charges, fees and expenses are due upon E-Bike Alley’s demand. Unpaid balances will accrue interest at 1.5% per month (18% per annum) or the maximum permitted by law. If collection or legal action is required, Renter agrees to pay collection costs and reasonable attorneys’ fees. Returned checks will be assessed a $35 service fee. 13. Helmets & Safety GearE-Bike Alley requires helmets for all participants under 18, provided free of charge. Riders/guardians must indicate YES or NO to wearing a helmet. Helmets may prevent permanent brain injury in an accident. 14. Waiver/ReleaseRenter understands bicycling can result in injury or death. Renter releases and holds harmlessE-Bike Alley, its employees, and agents from any claims, including those arising from negligence, maintenance, selection, or use of the Bicycle. Renter accepts full responsibility for any injury, damage, or death. 15. General ProvisionsRenter represents that the information contained in this Agreement is true, accurate, and complete. If any information is not true, accurate, or complete, E-Bike Alley has the right to terminate this Agreement with or without notice. Renter agrees to be responsible for any unauthorized repairs or modifications to the Bicycle. E-Bike Alley will not reimburse Renters for any unauthorized repairs without valid receipts. Renter understands that under no circumstances shall they be deemed an agent, servant, or employee of E-Bike Alley for any purpose. E-Bike Alley does not waive any rights under this Agreement except in writing signed by an officer. E-Bike Alley requires all users to wear a helmet and other safety gear and to seek instruction from staff in the safe operation of the Bicycle. Participants under 18 years old are required to wear a helmet; helmets are provided free of charge. Governing Law & Venue. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Venue for any dispute arising under this Agreement shall lie exclusively in the state or federal courts located in Williamsburg, Virginia. Entire Agreement and Modification. This Agreement constitutes the entire agreement between the parties. No waiver, amendment or modification of this Agreement shall be effective unless in writing and signed by an authorized representative of E-Bike Alley and the Renter. If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. 16. Speed Acknowledgment I Agree I understand that the Bicycle may exceed 28 mph, but I am only permitted to operate up to 28 mph during rental or test ride.
I Agree I understand that any speed above 28 mph is at my own risk and I accept full responsibility for injury, damage, or legal consequences.
Renter acknowledges that operating above 28 mph is done at their own risk and outside of Provider liability.
