FIREARM SHOOTING RANGE

SAFETY WAIVER & RELEASE

PLEASE READ CAREFULLY. THIS IS A LEGAL AGREEMENT THAT AFFECTS YOUR RIGHTS

1. ASSUMPTION OF RISK

Firearm shooting is an inherently DANGEROUS ACTIVITY. By using the Range, you acknowledge and agree that you are VOLUNTARILY PARTICIPATING and ASSUME ALL RISKS of injury, death, or property damage, including but not limited to: FIREARMS DISCHARGE, RICOCHETS, AMMUNITION FAILURE, EQUIPMENT FAILURE, NEGLIGENCE OF OTHERS, OR CONDITIONS OF THE RANGE.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, you RELEASE, WAIVE, AND DISCHARGE Piru Holdings LLC, California Tactical Academy, its OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, AGENTS, AFFILIATES, AND REPRESENTATIVES from any and all claims, demands, causes of action, or liability for any loss, damage, injury, or death, including those caused by NEGLIGENCE, arising out of or related to your use of the Range.

WAIVER OF CALIFORNIA CIVIL CODE SECTION 1542

I acknowledge and agree that by reason of the Release set forth above, I am assuming all risk of bodily injury, death or property damage and all other unknown and unanticipated claims, and I agree that my Release of all Released Parties contained in this Release applies thereto. In connection therewith, I expressly WAIVE whatever benefits I may have under Section 1542 of the California Civil Code, which reads as follows: “A General Release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

3. INDEMNIFICATION

You agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties from any and all claims, damages, losses, expenses, attorney's fees, or costs (including court costs) arising from your use of the Range or YOUR VIOLATION OF ANY RANGE RULES or the law.

4. RANGE RULES & INSTRUCTIONS

You agree to OBEY ALL RANGE RULES, SAFETY SIGNS, AND INSTRUCTIONS given by Range Officers and staff at all times. Range Officers have FULL AUTHORITY to stop anyone at any time for safety violations. Failure to follow rules may result in IMMEDIATE REMOVAL and loss of privileges without refund.

CEASE FIRE PROCEDURE

The command “CEASE FIRE” means stop shooting IMMEDIATELY! There may be extenuating circumstances for a Cease Fire without our usual one minute warning. When “CEASE FIRE” is announced STOP SHOOTING! On this command, unload your weapon, open action, lay weapon down, and step back from the line. Do not move back into the booth for any reason until cleared to do so by the Range staff member or Line Officer.

RATE OF FIRE

NO RAPID-FIRE is permitted. Allow at least one second between shots. (Exception on training courses). No cross shooting allowed. Never cross over the firing line.

VISITORS & GUESTS

Visitors and guests do not have to pay but must complete the Release and Hold Harmless Agreement form. Visitors and guests MAY NOT SHOOT OR HANDLE ANY FIREARMS at any time and must remain BEHIND THE RED SAFETY LINE at all times.

5. SAFETY REQUIREMENTS

You are responsible for wearing APPROVED EYE AND EAR PROTECTION at all times. You are responsible for ensuring your firearm is in SAFE WORKING CONDITION and suitable for use on the Range. Use only APPROPRIATE AMMUNITION.

DRESS CODE

Shirts and shoes are required to be worn on the Range at all times. High necklines are recommended to avoid burns from hot ejected brass casings. Open toe shoes, low cut shirts, or pants worn below the waist are not allowed.

NO SMOKING, FOOD, OR DRINK

No smoking, food or drinks in the Range at any time. No smoking in the picnic area.

6. APPLICABLE LAW & VENUE

This Agreement shall be governed by the laws of the STATE OF CALIFORNIA. Any disputes shall be resolved EXCLUSIVELY in the courts of Ventura County, California.

7. AGE REQUIREMENT

You must be 18 YEARS OF AGE OR OLDER to use the Range. Minors (ages 8–17) must be ACCOMPANIED BY A PARENT OR LEGAL GUARDIAN AT ALL TIMES.

Parents or guardians must be WITHIN ARM'S REACH AT ALL TIMES of persons age 8 through 21 years, both on and off the Range. Only two minors may shoot at one time per adult present.

8. MEDIA RELEASE

You grant Piru Holdings LLC and California Tactical Academy the IRREVOCABLE RIGHT to use photographs and/or video recordings of you for promotional purposes.

Piru Holdings LLC reserves the right to send marketing and advertising materials to your email address of record. I grant the irrevocable right and permission to use photographs and/or video recordings of me on websites and in publications, promotional flyers, educational materials, derivative works, or for any other purpose WITHOUT COMPENSATION TO ME. I WAIVE THE RIGHT TO APPROVE THE FINAL PRODUCT. I agree that all such recordings REMAIN THE PROPERTY OF THE COMPANY. I release the Released Parties from any and all claims arising from the use of said recordings, including but not limited to claims for INVASION OF PRIVACY, APPROPRIATION OF LIKENESS, OR DEFAMATION.

9. AGREEMENT

By signing below, you ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, and AGREE TO BE BOUND by its terms.

YOUR SAFETY AND THE SAFETY OF OTHERS DEPENDS ON YOU.

ADDITIONAL TERMS & CONDITIONS (FULL AGREEMENT)

USE OF THE RANGE:

The Range shall be used for the sole purpose of a firearms training and practice and for no other purpose without the express written consent of Licensor, which consent may be withheld in the sole discretion of Licensor. All federal, state and local firearm laws must be obeyed. All persons using Range must check in at the office.

AMMUNITION & FIREARMS:

Only ammunition appropriate for the firearm and the Range may be used. Armor piercing, incendiary, tracer rounds, steel core, or any illegal ammunition is strictly prohibited. ABSOLUTELY NO STEEL JACKET OR STEEL CORE AMMUNITION (armor piercing, incendiary rounds, tracer rounds) or BI-METAL ROUNDS may be used or on the Range at any time. The use of full auto firearms is prohibited. No weapons may be removed from the case until at the firing line.

SAFETY OF OTHERS:

All shooters and spectators must keep firearms pointed in a safe direction. Do not handle firearms when others are downrange. No horseplay, alcohol, or drugs are permitted on the premises. Anyone under the influence will be removed. Shooters are responsible for their children and guests at all times.

TARGETS:

Targets must be brought into the Range ONLY if approved by the Range staff. No cross draw shooting. No rapid fire. No shooting at steel targets or Main Counter. No firearms are permitted in the Range Office at any time. Exceptions are only made for law enforcement officers on duty.

BRASS COLLECTION POLICY:

Police your own brass. CLEAN after usage. You may ONLY collect spent brass that is your own. You may not take brass from any buckets that may be secured to any poles. VISITORS MAY NOT take or ask for brass from other shooters or anywhere else on the ranges. Exceptions CAN ONLY be granted by a Senior Line Officer. Clean up after yourself. Brush all brass forward of the firing line. Pick up your brass after shooting and place them in the buckets secured to the poles that say BRASS ONLY. Shotgun hulls and trash are to be deposited in the large barrels at the rear bench. Cleaning of firearms is allowed ONLY on the rear benches. You must clean the ground of all cleaning patches prior to returning to the shooting.

FACILITY & PROPERTY:

You are responsible for any damage to the Range, equipment, or property caused by you or your guests. Clean up after yourself. Remove all trash, brass, and personal items. Failure to do so may result in additional charges or loss of privileges. You agree to pay to Piru Holdings LLC upon demand a $500.00 CLEANING FEE if you do not clean up the portion of the Range covered by this Agreement after each use.

ANIMAL & WILDLIFE POLICY:

No animals are allowed on any of the ranges, with the exceptions of service dogs. DO NOT tie up your animal(s) in the picnic area; this is for your animal's safety. Piru Holdings LLC WILL NOT be held responsible for what may happen to your animal should it escape from its tether, nor are animals to be left unattended in your automobile BY LAW. Fish and Game or any other appropriate law enforcement agencies will be called if any animal is shot on our property. All animals are protected by law. If you encounter a rattlesnake, do not attempt to kill or capture it. Notify a Line Officer or the Range staff member.

PHOTOGRAPHY & RECORDING:

Piru Holdings LLC and its staff assume no liability for any harm, or potential harm, caused to the pregnant and/or nursing women or their babies. Photographing shooters who are not part of your party IS STRICTLY PROHIBITED without their consent. IF IN DOUBT REGARDING ANY OF OUR RULES, PLEASE ASK ANY OF THE RANGE OFFICERS OR RANGE MASTER.

PERSONAL PROPERTY:

Piru Holdings LLC is not responsible for lost, stolen, or damaged personal property. Vehicles and contents are left on the premises at owner's risk. Any property left anywhere on the premises of the Range becomes the property of Piru Holdings LLC.

SEVERABILITY: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and representations, whether written or oral.

ACKNOWLEDGEMENT: By using the Range, I acknowledge that engaging in sport shooting is dangerous. I further acknowledge that no matter what precautions I may take, including but not limited to the wearing of protective gear, I could experience an injury, of a very serious nature and/or die as a result of an accident or incident. I knowingly and freely assume all such risks.

I have read and fully understand all of the above terms and conditions. By entering the Range or signing in, I agree to be bound by this entire Agreement.
